{"id":246748,"date":"2009-05-05T00:00:00","date_gmt":"2009-05-04T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/azad-mohd-vs-state-of-raj-ors-on-5-may-2009"},"modified":"2016-01-14T16:26:17","modified_gmt":"2016-01-14T10:56:17","slug":"azad-mohd-vs-state-of-raj-ors-on-5-may-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/azad-mohd-vs-state-of-raj-ors-on-5-may-2009","title":{"rendered":"Azad Mohd vs State Of Raj. &amp; Ors on 5 May, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Rajasthan High Court &#8211; Jodhpur<\/div>\n<div class=\"doc_title\">Azad Mohd vs State Of Raj. &amp; Ors on 5 May, 2009<\/div>\n<pre>                                                              1\n\n  IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR\n  --------------------------------------------------------\n\n\n                      WRIT REVIEW No. 16 of 2009\n\n                                  AZAD MOHD.\n                                V\/S\n                          STATE OF RAJ. &amp; ORS.\n\n    Mr. JL PUROHIT, for the appellant \/ petitioner\n\n\n\n    Date of Order : 5.5.2009\n\n                       HON'BLE SHRI N P GUPTA,J.\n                       HON'BLE SHRI H.R.PANWAR,J.\n\n                               ORDER\n<\/pre>\n<p>                               &#8212;&#8211;\n<\/p>\n<p>            Heard learned counsel for the petitioner, and<\/p>\n<p>perused the judgment dt. 16.1.2009 which is sought to be<\/p>\n<p>reviewed.\n<\/p>\n<\/p>\n<p>            May be that accidentally the earlier suit no. 4\/79<\/p>\n<p>was described to have been filed in Civil Court, and the<\/p>\n<p>decree passed therein having been confirmed upto the Board<\/p>\n<p>of Revenue, while as a matter of fact the suit was filed in<\/p>\n<p>the Court of Sub Divisional Officer, whose decree was<\/p>\n<p>affirmed by the Revenue Appellate Authority, and the matter<\/p>\n<p>was not carried further. Thus the fact does remain, that<\/p>\n<p>appropriate suit was filed before competent court, and that<\/p>\n<p>decree attained finality, on account of having not been<\/p>\n<p>challenged further. Therefore, nothing much turns on this<\/p>\n<p>accidental slip.\n<\/p>\n<p><span class=\"hidden_text\">                                                               2<\/span><\/p>\n<p>            Then, so far as the arguments on merits are<\/p>\n<p>concerned, a look at the document Annexure-1 of the writ<\/p>\n<p>petition which is judgment rendered in earlier suit no.<\/p>\n<p>4\/79 does show, that the issue no. 1 and 2 very much<\/p>\n<p>comprehended the question about Kamla Devi being the<\/p>\n<p>Khatedar tenant, and about Kamla Devi having purchased the<\/p>\n<p>land by registered sale deed dt. 7.2.1975 for a sum of Rs.<\/p>\n<p>8000\/- from Kale Khan, and the learned trial court in that<\/p>\n<p>judgment found, that the plaintiff had produced the<\/p>\n<p>certified copy of the sale deed, which is registered<\/p>\n<p>document, and only challenge to the document was, that the<\/p>\n<p>sale deed is forged, as some imposter was produced to get<\/p>\n<p>the document registered, therefore, F.I.R. was lodged, but<\/p>\n<p>then nothing was shown to substantiate the submission about<\/p>\n<p>lodging of F.I.R., so much so that even copy of the F.I.R.<\/p>\n<p>was also not produced. Thus, considering this, and other<\/p>\n<p>attending circumstances this issue no. 2 was decided in<\/p>\n<p>favour of the plaintiff. Likewise, considering material on<\/p>\n<p>record issue no.1 was also decided in favour of the<\/p>\n<p>plaintiff, holding the plaintiff to be Khatedar. It is<\/p>\n<p>significant to note, that this judgment was appealed<\/p>\n<p>against, which appeal was dismissed, and then was not<\/p>\n<p>challenged any further. Thus, the judgment acquired<\/p>\n<p>finality.\n<\/p>\n<\/p>\n<p>            On the face of this the submission made by the<br \/>\n<span class=\"hidden_text\">                                                               3<\/span><\/p>\n<p>learned counsel for the petitioner, that Kamla Devi had not<\/p>\n<p>produced the original sale deed, whether in the present<\/p>\n<p>suit, or in the previous suit, with the result, that it<\/p>\n<p>cannot be said that the sale in favour of Kamla Devi is<\/p>\n<p>proved, cannot be entertained in the review petition.<\/p>\n<p>           As noticed above, the certified copy of the<\/p>\n<p>registered sale deed was produced, and no objection was<\/p>\n<p>raised about production thereof.\n<\/p>\n<\/p>\n<p>           No other submission was made.\n<\/p>\n<p>           Consequently, we do not find any force in the<\/p>\n<p>review petition.
