Raval, learned<br \/>\nAdditional Public Prosecutor waives service of notice of Rule on<br \/>\nbehalf of the respondent.  In the facts and circumstances of the case<br \/>\nand with the consent of learned advocate appearing for respective<br \/>\nparties, present revision application is taken up for<br \/>\nfinal hearing today.\n<\/p>\n<p>2.\tPresent<br \/>\nCriminal Revision Application has been preferred by the applicant &#8211;<br \/>\noriginal accused challenging the impugned order dated 29.04.2011<br \/>\npassed by the learned Sessions Judge, Surendranagar in Criminal<br \/>\nMiscellaneous Application No.149\/2011, by which the learned Sessions<br \/>\nCourt has rejected the said application submitted by the applicant to<br \/>\ncondone the delay in preferring the Criminal Appeal challenging the<br \/>\njudgment and order dated 06.07.2010 of conviction passed by the<br \/>\nlearned JMFC, Lakhtar in Criminal Case No.32\/2010.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocate appearing on behalf of the respective<br \/>\nparties and considering the impugned order passed by the learned<br \/>\nSessions Court, it appears that learned Sessions Judge has taken a<br \/>\ntoo technical view while considering the application submitted by the<br \/>\napplicant to condone the delay in preferring the Criminal Appeal<br \/>\nagainst the order of conviction.  The learned Sessions Court ought to<br \/>\nhave appreciated that by delay, the applicant was not going to be<br \/>\nbenefited and\/or there was no malafide intention on the part of<br \/>\napplicant in not preferring Criminal Appeal within the period of<br \/>\nlimitation.  By not condoning the delay, the valuable right of the<br \/>\napplicant to challenge the order of conviction has been taken away.<br \/>\nIn the facts and circumstances of the case and so as to enable the<br \/>\napplicant to submit the case on merits,<br \/>\nthe delay caused in preferring the Appeal deserves to be condoned and<br \/>\nthe Appeal is to be considered on merits.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated above, present Revision<br \/>\nApplication succeeds.  Impugned order dated 29.04.2011 passed by the<br \/>\nlearned Sessions Judge, Surendranagar in Criminal Miscellaneous<br \/>\nApplication No.149\/2011 is hereby quashed and set aside and delay<br \/>\ncaused in preferring the Criminal Appeal against the judgment and<br \/>\norder dated 06.07.2010 of conviction passed by the learned JMFC,<br \/>\nLakhtar in Criminal Case No.32\/2010 is condoned.  Rule is made<br \/>\nabsolute accordingly.  Now, the learned Sessions Court to consider<br \/>\nthe Appeal preferred by the applicant in accordance with law and on<br \/>\nmerits.
