NO. 23074 OF 2007\n                             ---------------------\n\n                 Dated this the 27th day of July, 2007\n\n                            J U D G M E N T\n<\/pre>\n<p>      Petitioner retired from an aided college at Tirurangadi on June<\/p>\n<p>30, 2003 while he was working as Senior Superintendent. According<\/p>\n<p>to the petitioner, he joined service in the college as Lab Attender in<\/p>\n<p>the year 1968. Thereafter, he was appointed as Lower Division Clerk<\/p>\n<p>with effect from July 1, 1970 and was promoted as Upper Division<\/p>\n<p>Clerk on June 24, 1975. He got promotion again in the year 1977and<\/p>\n<p>was granted Higher Grade in 1987. He was again given a regular<\/p>\n<p>promotion as Senior Superintendent with effect from August 20, 1992<\/p>\n<p>while he was drawing basic pay of Rs.1,830\/- in the scale of<\/p>\n<p>Rs.1370-2660.      Petitioner further claims that he was entitled to<\/p>\n<p>fixation under Rule 28A Part I KSR at Rs. 1990 on promotion as<\/p>\n<p>Senior Superintendent.\n<\/p>\n<p>      2.   His grievance is that he was not given the benefit of pay<\/p>\n<p>revision of the year 1992. His request in this regard was rejected<\/p>\n<p>ultimately by the Government, as revealed from Ext.P4. It appears<\/p>\n<p>WPC NO.23074\/07               Page numbers<\/p>\n<p>that petitioner&#8217;s successor was in fact given the benefit for which<\/p>\n<p>petitioner had been clamouring for, as could be seen from Ext.P5.<\/p>\n<p>      3.   Learned counsel submits that the stand taken by the<\/p>\n<p>Government is a clear instance of hostile discrimination. I do not<\/p>\n<p>propose to deal with any of the contentions raised by the petitioner at<\/p>\n<p>this stage in view of the limited prayer made by learned counsel for<\/p>\n<p>the petitioner at the Bar. He submits that petitioner will be satisfied if<\/p>\n<p>an appropriate direction is issued to respondent No.1 to take a<\/p>\n<p>decision on Ext.P6 representation submitted by the petitioner, in<\/p>\n<p>which he has highlighted all his grievances and the relevant aspects<\/p>\n<p>of the issue.\n<\/p>\n<p>      4. Learned Government Pleader submits that as far as Ext.P5<\/p>\n<p>is concerned, it might have been a mistake. He further submits that<\/p>\n<p>an appropriate decision will be taken in the matter after considering<\/p>\n<p>the entire issue in detail, and if necessary, Ext.P5 order will also be<\/p>\n<p>reviewed by the Government.\n<\/p>\n<p>      In the above facts and circumstances, the writ petition is<\/p>\n<p>disposed of with a direction to respondent No.1 to consider and pass<\/p>\n<p>orders on Ext.P6 strictly on its merit and in accordance with law, as<\/p>\n<p>expeditiously as possible, at any rate, within three months from the<\/p>\n<p>WPC NO.23074\/07              Page numbers<\/p>\n<p>date of receipt of a copy of this judgment. Respondent No.1 shall<\/p>\n<p>consider under what circumstance Ext.P5 order was issued giving<\/p>\n<p>the benefit which the petitioner was denied.       The beneficiary of<\/p>\n<p>Ext.P5 shall also be afforded sufficient opportunity to be heard, if the<\/p>\n<p>Government decides to review the said order. Needless to mention,<\/p>\n<p>petitioner shall be given sufficient opportunity to be heard when<\/p>\n<p>Ext.P6 is being considered. Petitioner shall produce a certified copy<\/p>\n<p>of the judgment along with a copy of the writ petition before<\/p>\n<p>respondent No.1 for compliance.<\/p>\n<pre>\n\n\n\n\n                                            A.K.
