{"id":246809,"date":"2011-11-11T00:00:00","date_gmt":"2011-11-10T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/pramod-kumar-jamuar-vs-the-state-of-bihar-ors-on-11-november-2011"},"modified":"2016-07-01T09:12:27","modified_gmt":"2016-07-01T03:42:27","slug":"pramod-kumar-jamuar-vs-the-state-of-bihar-ors-on-11-november-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/pramod-kumar-jamuar-vs-the-state-of-bihar-ors-on-11-november-2011","title":{"rendered":"Pramod Kumar Jamuar vs The State Of Bihar &amp; Ors on 11 November, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Pramod Kumar Jamuar vs The State Of Bihar &amp; Ors on 11 November, 2011<\/div>\n<pre>             IN THE HIGH COURT OF JUDICATURE AT PATNA\n                       CWJC No.8812 of 2011\n                        Pramod Kumar Jamuar\n                               Versus\n                     The State Of Bihar &amp; Ors\n                            -----------\n<\/pre>\n<p>07\/   11.11.2011          Heard counsel for the parties.<\/p>\n<p>                         The prayer of the petitioner in this<\/p>\n<p>                  writ application reads as follows:-<\/p>\n<p>                       &#8220;1(i) For     a      direction                 to      the<br \/>\n                            respondents to reimbursement of<br \/>\n                            medical       expenditures                bills    of<br \/>\n                            Rs.    3,88,048\/-             (Three           Lakhs<br \/>\n                            eighty eight thousand and forty<br \/>\n                            eight Rupees only.)\n<\/p>\n<p>                       (ii) Further for a direction to the<br \/>\n                            respondent          to        sanction            Rs.\n<\/p>\n<p>                            30000\/- (Rupees thirty thousand<br \/>\n                            per    month)       for       the     period       of<br \/>\n                            six    month        and         Rs.        15000\/-<\/p>\n<pre>\n                            (Rupees       Fifteen          thousand           per\n                            month)        for        life        time         for\n                            expenditure         of       medical        of    the\n                            petitioner,              as          per          the\n                            certification             of         the         Post\n                            Graduate      Institute              of    Medical\n                            Education                &amp;            Research,\n<\/pre>\n<p>                            ChandiGarh, Department of Renal<br \/>\n                            Transplant Surgery.\n<\/p>\n<p>                       (iii) Further for a direction to the<br \/>\n                            respondent to pay the interest<br \/>\n                            @ of 12% compoundable interest<br \/>\n                            on the amount of expenditure of<br \/>\n                            medical of petitioner from the<br \/>\n                            date    of    surgery           to        till    the<br \/>\n                            date     of    payment          because           the<br \/>\n                            petitioner          has       compelled            to<br \/>\n                            take    the     loan         Rs.     5,00,000\/-\n<\/p>\n<p><span class=\"hidden_text\">                    2<\/span><\/p>\n<p>            (Rupees         Five       Lakhs    only)     from<br \/>\n            the State Bank of India, Jamui<br \/>\n            which is evident from the pay<br \/>\n            slip       of    the       petitioner    as     on<br \/>\n            acquaintance roll, laying with<br \/>\n            the department.\n<\/p>\n<p>      (iv) To     grant          the    compensation        of<br \/>\n            Rs.      100000\/-           for     unnecessary<br \/>\n            harassing to the petitioner.&#8221;<\/p>\n<p>       The petitioner is working as a clerk<\/p>\n<p>in Primary Health Centre, Jamui is said to<\/p>\n<p>be seriously suffering from Nephrological<\/p>\n<p>and Cardiological disorder. It is said that<\/p>\n<p>the petitioner has already spent a sum of<\/p>\n<p>Rs.   6,10,600\/-            on     the     head      of    kidney<\/p>\n<p>transplant in the Post Graduate Institute<\/p>\n<p>of    Medical          Education               and      Research,<\/p>\n<p>Chandigarh by arranging loan from bank and<\/p>\n<p>other sources and that he has been further<\/p>\n<p>advised to undergo Cardiological treatment<\/p>\n<p>in the same institute for which a further<\/p>\n<p>sum of Rs. 3.5 lacs                 is required. Learned<\/p>\n<p>counsel     for        the        petitioner         has         also<\/p>\n<p>submitted that due to paucity of fund the<\/p>\n<p>petitioner was removed from Post Graduate<\/p>\n<p>Institute       of          Medical            Education         and<\/p>\n<p>Research,    Chandigarh            and     brought        back    to<\/p>\n<p>Jamui from where he has been again referred<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>to P.M.C.H on 10.11.2011.                 Counsel for the<\/p>\n<p>petitioner        has        submitted    that    till    date<\/p>\n<p>Government has released a sum of Rs. 1.60<\/p>\n<p>lacs    by     way      of     advance    for    the   entire<\/p>\n<p>treatment and too by way of sending the<\/p>\n<p>said amount directly to the Post Graduate<\/p>\n<p>Institute         of         Medical      Education        and<\/p>\n<p>Research, Chandigarh.\n<\/p>\n<p>        Learned counsel for the State on the<\/p>\n<p>other hand has submitted that as per the<\/p>\n<p>Government rules the amount of advance on<\/p>\n<p>the medical expenditure cannot be directly<\/p>\n<p>paid into the hands of the petitioner but<\/p>\n<p>only to the institute where he is being<\/p>\n<p>treated. He has further submitted that the<\/p>\n<p>writ application was confined only to the<\/p>\n<p>payment      of        bills      of    the   Cardiological<\/p>\n<p>treatment of the petitioner but now a new<\/p>\n<p>issue     as      with        regard     to   Cardiological<\/p>\n<p>treatment         in       view    of    an     undated    and<\/p>\n<p>unnumbered certificate of the Post Graduate<\/p>\n<p>Institute         of         Medical      Education        and<\/p>\n<p>Research,      Chandigarh          allegedly      issued    on<\/p>\n<p>08.08.2011 is still to be verified by the<\/p>\n<p>Competent Authority.\n<\/p>\n<p>        Considering all these aspects and in<br \/>\n<span class=\"hidden_text\">                      4<\/span><\/p>\n<p>order    to     give      immediate         relief      to     the<\/p>\n<p>petitioner,         this      Court         would      deem     it<\/p>\n<p>expedient      to    constitute         a    team      of    three<\/p>\n<p>specialist Doctors at P.M.C.H namely:-<\/p>\n<pre>         1.     Head       of     the        Department         of\n\nMedicine.\n\n         2.     Director          of        Indira          Gandhi\n\nInstitute of Cardiology.\n\n         3.         Head     of       the    Department         of\n\nNephrology.\n\n<\/pre>\n<p>which would not only examine the petitioner<\/p>\n<p>but     also    look       into       all    the       documents<\/p>\n<p>relating       to    his     previous        treatment         and<\/p>\n<p>expenditure         already      incurred      by      him.    The<\/p>\n<p>said expert team will also look into the<\/p>\n<p>prescriptions              and         undated\/unnumbered<\/p>\n<p>certificate of Post Graduate Institute of<\/p>\n<p>Medical Education and Research, Chandigarh<\/p>\n<p>dated     08.08.2011,            as     with        regard      to<\/p>\n<p>requirement          of      undergoing            a     special<\/p>\n<p>treatment      at     Post      Graduate       Institute        of<\/p>\n<p>Medical Education and Research, Chandigarh<\/p>\n<p>involving      further       expenditure        of      Rs.    3.5<\/p>\n<p>lacs.\n<\/p>\n<p>         If the aforesaid expert committee is<\/p>\n<p>of the opinion that the petitioner needs<br \/>\n<span class=\"hidden_text\">                       5<\/span><\/p>\n<p>immediate Cardiological treatment by being<\/p>\n<p>treated only at Post Graduate Institute of<\/p>\n<p>Medical Education and Research, Chandigarh,<\/p>\n<p>it    would    also        indicate       the     same    in     its<\/p>\n<p>report        after         making        full     assessment,<\/p>\n<p>including the present physical condition of<\/p>\n<p>the petitioner.\n<\/p>\n<p>              As it is claimed by the petitioner<\/p>\n<p>that the petitioner is arriving only today<\/p>\n<p>from     Jamui       for        being     admitted       in     the<\/p>\n<p>P.M.C.H,       let        the    aforesaid        exercise        be<\/p>\n<p>completed by 18th of November, 2011 and if<\/p>\n<p>expert     body        of       P.M.C.H     in     its        report<\/p>\n<p>recommends for treatment of the petitioner<\/p>\n<p>at     Post    Graduate           Institute        of     Medical<\/p>\n<p>Education        and        Research,       Chandigarh           for<\/p>\n<p>treatment        of        the     petitioner           at      Post<\/p>\n<p>Graduate Institute of Medical Education and<\/p>\n<p>Research, Chandigarh, the advance amount of<\/p>\n<p>Rs.     1.6    lacs              would     be     sufficiently<\/p>\n<p>supplemented          and       sent      directly       to     Post<\/p>\n<p>Graduate Institute of Medical Education and<\/p>\n<p>Research,       Chandigarh           to    meet    the        entire<\/p>\n<p>estimated cost of expenditure of Rs. 3.5<\/p>\n<p>lacs which of course would be subject to<\/p>\n<p>all the other terms and conditions of the<br \/>\n<span class=\"hidden_text\">                          6<\/span><\/p>\n<p>advance       as    already          incorporated           in    the<\/p>\n<p>letter      of     the       State     Government         Memo    NO.<\/p>\n<p>2505 dated 29.09.2011.\n<\/p>\n<p>              List           this      case        on     21st     of<\/p>\n<p>November, 2011 at the top of the list as a<\/p>\n<p>tied up matter on which date the report of<\/p>\n<p>the    said       committee          and    the    consequential<\/p>\n<p>decision of the State Government shall be<\/p>\n<p>made available to this Court by the learned<\/p>\n<p>counsel for the State who would immediately<\/p>\n<p>transmit          this       order      to    the       Principal,<\/p>\n<p>P.M.C.H       for        constituting             the    aforesaid<\/p>\n<p>specialist team. The Principal P.M.C.H in<\/p>\n<p>absence       of    any        of     the     aforesaid         named<\/p>\n<p>member of the team will have the liberty to<\/p>\n<p>substitute         any        of     them    by    a     person    of<\/p>\n<p>equivalent rank in the same discipline so<\/p>\n<p>that    a     final          report    after       the    physical<\/p>\n<p>examination of the petitioner as also the<\/p>\n<p>examination          of        the      documents          of     the<\/p>\n<p>relating to treatment of the petitioner is<\/p>\n<p>submitted by the team of specialist Doctors<\/p>\n<p>within the aforementioned time limit.<\/p>\n<p>              It is also made clear that nothing<\/p>\n<p>said    in       this        order    shall       prejudice       the<\/p>\n<p>right        of     the         petitioner          in     getting<br \/>\n<span class=\"hidden_text\">                               7<\/span><\/p>\n<p>         reimbursement         of       all   the      amount    already<\/p>\n<p>         spent    by    him       for    his     treatment       in    the<\/p>\n<p>         replacement      of      his      Kidney      and\/or    related<\/p>\n<p>         Nephrologocial           diseases       at    Post     Graduate<\/p>\n<p>         Institute        of           Medical        Education        and<\/p>\n<p>         Research, Chandigarh and\/or other approved<\/p>\n<p>         institutes\/hospitals.
