PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 16\/11\/2011\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of present application, filed under Section 439 of the Code of<br \/>\n\tCriminal Procedure, 1973, the applicant has prayed to release him on<br \/>\n\tregular bail in connection with CR No.I-61 of 2009 registered with<br \/>\n\tBayad Police Station for the offence punishable under Sections 465,<br \/>\n\t468, 471 , 219, 166, 167 read with Section 120(B) of the Indian<br \/>\n\tPenal Code.\n<\/p>\n<p>Heard<br \/>\n\tMr.Vaibhav Sheth, learned counsel for the applicant and Ms.C.M.<br \/>\n\tShah, learned Additional Public Prosecutor for respondent-State.\n<\/p>\n<p>Mr.Sheth,<br \/>\n\tlearned counsel for the applicant, has contended that the applicant<br \/>\n\tis innocent and has not committed any offence. He has also contended<br \/>\n\tthat if the allegations made in the FIR be taken as it is, then also<br \/>\n\tit does not disclose any prima-facie case against the present<br \/>\n\tapplicant.  He has further contended that 10 different FIRs are<br \/>\n\tlodged against the applicant, out of which in six FIRs the present<br \/>\n\tapplicant is already released on bail by this Court. Facts of those<br \/>\n\tcase are similar to the facts of the present case. He has further<br \/>\n\tcontended that the investigation is over and charge-sheet is filed;<br \/>\n\tall the offences are magistrate triable offences and prima-facie the<br \/>\n\tallegations levelled against the applicant is that he was not duly<br \/>\n\tauthorised to put the properties in auction. He has further<br \/>\n\tcontended that all the cases against the applicant is transferred<br \/>\n\tbefore the learned Additional Chief Judicial Magistrate,<br \/>\n\tHimmatnagar. He, therefore, contended that looking to the facts of<br \/>\n\tthe case and overall circumstances, applicant may kindly be released<br \/>\n\ton bail.\n<\/p>\n<p>Ms.C.M.\n<\/p>\n<p>\tShah, learned Additional Public Prosecutor, read the police papers<br \/>\n\tand order of the learned trial Court and vehemently opposed the<br \/>\n\tpresent application.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts and circumstances of the case, the nature of<br \/>\n\toffence, the role attributed to the accused-applicant and the fact<br \/>\n\tthat the investigation is over and charge-sheet is filed, I am<br \/>\n\tinclined to exercise my discretion in favour of the<br \/>\n\taccused-applicant.\n<\/p>\n<p>Hence,<br \/>\n\tthe applicant is ordered to be released on bail in connection with<br \/>\n\tCR No.I-61 of 2009 registered with Bayad Police Station, for the<br \/>\n\toffence alleged against him in this application on his executing a<br \/>\n\tbond of Rs.10,000\/- (Rupees ten thousand only) with one solvent<br \/>\n\tsurety of the like amount to the satisfaction of the trial Court and<br \/>\n\tsubject to the conditions that he shall &#8211;\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or\tabuse \this liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution \twitnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the \tInvestigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of\tthe prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the State of Gujarat without prior\tpermission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>f)\tmark<br \/>\nhis presence twice at Modasa Rural Police \tStation on every 15th<br \/>\nand 30th day of each English \tcalendar\tmonth between 09.00<br \/>\nhours and 14.00 \thours;\n<\/p>\n<p>g)\tfurnish<br \/>\nthe address of his residence to the\tInvestigating Officer\tand also to<br \/>\nthe Court at the \ttime of execution of \tthe bond and shall not\tchange<br \/>\nthe residence without prior permission of\tthis Court;\n<\/p>\n<p>h)\tsurrender<br \/>\nhis passport, if any, to the lower Court\twithin a week.\n<\/p>\n<p>If<br \/>\n\tthe breach of any of the above conditions is committed, the<br \/>\n\tconcerned Court will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.
