After<br \/>\nthe    &#8216;number of ballot papers<br \/>\n  &#8220;those5remalned unused were<br \/>\nlrluly. the concerned officer at each<br \/>\n  form No.22 as required under<\/p>\n<p>__Rule&#8221;-.30 .oi&#8217;. the&#8221;~~&#8211;1*5lgricultural Produce Marketing<\/p>\n<p> (ifEegniatien)v__l_&lt;juies,  (hereinafter  to as<\/p>\n<p>E<br \/>\nI&#039;<br \/>\nI&#039;<br \/>\nI<br \/>\nE<\/p>\n<p>&#039; Iirit&#039;-\ufb01g 1&#039; V0 .23 was l1el_<\/p>\n<p>.11 31-03-2005 by the<\/p>\n<p>..  Officer in the presence of the <\/p>\n<p>After the ballot boxes from the<\/p>\n<p> respective polling stations were opened counting of<\/p>\n<p>the votes was commenced but the number of ballot<br \/>\npapers recorded in form No.22 were not tallied with<br \/>\nthe number of ballot papers recorded in form<br \/>\nNo.23.\n<\/p>\n<p>E ii <\/p>\n<p>cl) From out of total 3530 votes from all <\/p>\n<p>stations, 49 votes were found   the 4_<br \/>\nappellant was found secured _128&#8217;5&#8211;::&#8217;.&#8217;troizes;.VV   <\/p>\n<p>respondent No.3   1282f. .&#8217;  <\/p>\n<p>u &#8212; \u00bb-.,  .t _ so<br \/>\n.-ze.-.;.\u00ab~\u00ab.r=&#8230;.g _\ufb01.oe_r_,=..  declaring the<br \/>\ns.ppel\u00a3ont;Veiectl2:d,g vrentViiiside___his chambers with 4<br \/>\n   east in favour of the<br \/>\n:;,A_t   first respondent received<br \/>\nte!ophoiile.._::&#8221;co;ll_\ufb01&#8217;to   the effect that the third<br \/>\n who was supported by<br \/>\n congxsss-i  should be declared elected by<\/p>\n<p>&#8221;   or  &#8216;l&#8217;herei&#8217;ore  \ufb01rt rsrrndent<\/p>\n<p>  another form No.23 mentioning ..here.__<br \/>\n that  35% %ot pamrs  found from all<\/p>\n<p>ht-Jlot mxes, resulting in shortage of 4 ballot<\/p>\n<p>&#8221; _ E&#8217;.&#8217;.9.f.&#8217;|.&#8217;151&#8217;EL<\/p>\n<p>2 V\u00bb  &#8216;J 4,:-.\\ lmmediately aiter noticing the some the appellant<\/p>\n<p>\ufb01led his protest petition at about 12.30 p.m. on<br \/>\nthat day itself before the \ufb01rst respondent Returning<br \/>\nOfficer requesting him to recount the votes in<br \/>\nterms of the votes found in form No.22. The first<br \/>\nrespondent, on receipt of the said pe\ufb01\ufb01on, instead<\/p>\n<p>C&#8217;:-&#8216;~*&#8211;&#8216;-&#8220;&#8221;\\&#8212;-\n<\/p>\n<p><span class=\"hidden_text\">6<\/span><\/p>\n<p>of resorting to Rule 37 of the Rules, took othltaform<br \/>\nNo.23 which was earlier prepared<br \/>\ntherein the total number of ballot papers 4_<br \/>\nthe ballot boxes as 3530&#8230; and  .\n<\/p>\n<p>another form No.23     &#8221;<br \/>\nnumber of ballot papers asp_&#8217;35&#8217;2&#8242;:6 sifioirv&#8217;ingV  4<\/p>\n<p>baiiot papers were <\/p>\n<p>I&#8212;l<\/p>\n<p>mmediately on n-ti:L.a_;:,  acts of the tirst<\/p>\n<p>-&#8216;.&#8217;9<\/p>\n<p>ree,_ee1eet, his agent \ufb01led<\/p>\n<p>_ rotest&#8217;    day but the \ufb01rst<br \/>\n  not &#8216;consider the same but<br \/>\n  see-.e er the elections illegally<br \/>\n declariI1g._  respondent was elected.<br \/>\n~1*1_1ererez+e, A3[tbe*~ ..:apI;1ellant &#8216;filed the said Election<br \/>\n Mise.t_&#8217;etiti&#8211;on~._: No.4\/05 before the Triai Judge<\/p>\n<p>D<\/p>\n<p>~  __pAseelcin&#8217;g&#8221;*~the_A declaration that the eiection of ti&#8217;<\/p>\n<p>I&#8230;\n<\/p>\n<p>_ third~.e1&#8217;espond&#8217;nt LU the post of mrecmr of $99..<\/p>\n<p>I3.\n<\/p>\n<p>&#8221;  ;-&#8216;.P.*.&#8217;l(.1 from \u00abNu!-&#8216;st&#8217;;-&#8216; Amen.-lu<br \/>\n .~co_n;stit=.ieney is t.r..i_ and, that the appellant be<br \/>\nit  elected to the said post.\n<\/p>\n<p>    The first respondent-Tahsildar-Returning Officer \ufb01led<br \/>\nT writ.en objections to the election petition and the second<\/p>\n<p>respondent AFMC adoperd the same. &#8216;. he contenti-ms .1&#8217; she<\/p>\n<p>\ufb01I&#8217;St respondent in the said objections are as under:<\/p>\n<p>C&#8221;&#8221;&lt;T&quot;&#8211;L.&#8211;\u00ab&#8230;&#8211;\n<\/p>\n<p><span class=\"hidden_text\">7<\/span><\/p>\n<p>&#8211; 1) in all the 9 polling stations totally 35\u00a7.3{):.:&#8221;vote1&#8217;s<br \/>\ncast their votes and the details in the<br \/>\nsame were mentioned in Form   4_<br \/>\nof each polling station,_,at   I<br \/>\nrequired under Rule 30.__of   V<br \/>\nvotes was held in  <\/p>\n<p>Er-ea,<\/p>\n<p>of Rules 35 and 3&#8242;?&#8221;~eo &#8220;me eaid&#8217; i~\u00a3ul_ee;g The &#8216;mm-&#8220;et<\/p>\n<p>boxed \ufb01e&#8221; all th&#8221; etatlene wen \ufb01ne-.1<br \/>\n&#8220;&#8216;1 the  Kefi &#8216;t..e.p[e,;11r.l..datee and <\/p>\n<p>a.ge1&#8217;1t.,_  that was put to<\/p>\n<p>   papers from each<\/p>\n<p> Totally 3526 ballot e<br \/>\n ~~~~  all the ballot boxes.\n<\/p>\n<p>ii)   ml the :\u00a7;eaae ballot papers were taken into<br \/>\neeesmeeattentes provided under Rule 35(4) of&#8217; the<br \/>\nl{L1lesat.1d.i-&#8216;onn No.23 was prepared mention<\/p>\n<p>ll   the  of ballot papers feund in<\/p>\n<p>A  uau t  mr*alnir.5; in respective pellmg<\/p>\n<p>+ 11<\/p>\n<p>~ :lete..tie&#8230; &#8230;.ne&#8230;.1&#8230;ne- 11.). .a h- copy of&#8217;lv&#8217;orm No.23.<\/p>\n<p>No mi_t_alce occurred as alleged by the petitioner<\/p>\n<p>iii) Counting was held legally and impartially. From<br \/>\nout of 3,526 votes the Appellant N.G.PuttaswaIny<br \/>\nwas found secured 1,281 votes and the other two<br \/>\ncandidates namely 4* respondent<\/p>\n<p>(&#8212;&#8216;$&#8221;&#8216;&#8221;g&#8212;\n<\/p>\n<p><span class=\"hidden_text\">8<\/span><\/p>\n<p>Mallilcaljunappa and 5&#8243;&#8216; respondent<br \/>\nKumar were found secured<br \/>\n615 votes and 49 votes were    p_<br \/>\nSince the 3&#8243;&#8221; respondent;   &#8221; \u00bb<br \/>\none vote more than<br \/>\nthe former was declared eleeted. V. hp<br \/>\nat para 5 of the   tl&#8217;1&#8243;&#8216;V&#8217;<br \/>\nresults of tile\u00bb  A\ufb01rgst  talked<\/p>\n<p>iv) &#8216;l&#8217;t;wont_.;ia  sought for recounting, his<br \/>\n&gt;\\!1 V  :&#8217;  npotilconsidered because, as per the<br \/>\n mgujlesmts, ppneitner the candidate nor his agent<\/p>\n<p>  during the counting of<br \/>\nthe&#8221; xms. l&#8217;=Aoc&#8217;o1dingly \ufb01rst respondent issued<\/p>\n<p>Ll- _A.\n<\/p>\n<p> ___eI1_dorsement. Annexures-2 to 1&#8217;2 establish U181&#8243;.<\/p>\n<p> Vt.he&#8217;~fi_1&#8217;st respondent i&#8217;oli&#8221;*ed th&#8221; 9 mrisions of<\/p>\n<p><span class=\"hidden_text\">1<\/span><br \/>\n&#8216;iii 37 at&#8217; the l-miss in J3&#8230; process of<br \/>\n_ \ufb02ee votes. &#8216;1&#8217;.h._. _.rst respondent never<br \/>\n&#8216;~ V &#8220;:.collud..d ,,-_.- t__e  respondent as alleged by<\/p>\n<p>V) Though 3,530 ballot papers were given to the<br \/>\nvoters at the polling stations only 3,526 ballot<br \/>\npapers were found from all the ballot boxes taken<br \/>\ntogether. Besides this it is  <\/p>\n<p>appellant candidate that the l-{eturnirg   the d <\/p>\n<p>original form No.23 with a new  <\/p>\n<p>showing that there was shonage\ufb01niissing of  &#8216;V ,<\/p>\n<p>tron: one ballot box and one   1 another ballot<\/p>\n<p>box &#8216;pertaining m   A&#8221;i+al11va1&#8217;thi polling<\/p>\n<p>stations respectiveiy.  .ng .eu_I1d that<br \/>\nthe appellant  and the third<br \/>\nrespondent  &#8221; said four votes were\n<\/p>\n<p>&#8211;an_L1l_.ntly    the said ballot boxes just<br \/>\nto d&#8221;&#8216;lare as  .._ected by majority of &#8216;one<\/p>\n<p>   ~V.lf&#8217;vv..ti1e\u00ab~.i:above allegations made by the appellant<\/p>\n<p>   candidate first respondent Returning Of\ufb01cer, who<\/p>\n<p>&#8212;  eras req_1iredv to act fairly and impartially in conducting the<\/p>\n<p>  coun\ufb01igg of the sates, are .eund pm-wed, it has to be held that<\/p>\n<p>  first respondent, being a resporrihl&#8221; &#8220;fiiwr, acted in<\/p>\n<p>  fgross violation of principles of natural justice and also quite<\/p>\n<p>unfairly towards the appellant. Point Nosxg and  Having heid that the iearned<br \/>\nV , jjsingle Judge was not justified dismissing the writ petition of<\/p>\n<p>the appellant, we have now to examine whether the learned<\/p>\n<p>c.._!&#8217;\\r&#8221;:.&#8211;~..&#8212;-\n<\/p>\n<p><span class=\"hidden_text\">16<\/span><\/p>\n<p>Trial Judge was justiiied in dismissing the election petviijoo &#8216;f<br \/>\nthe appellant. As to merits of the<br \/>\nKdchannabasappa, the learned Senior<br \/>\nappellant, strongly contended that ..*lfillll\\Iie*.I.rp_   9 T. l<\/p>\n<p> . ed :lr&#8217;sl+.:e_.\n<\/p>\n<p>fem, that in mtal, 3,530 ha rs nran&#8217;-av&#8217;-5i*.V_=-re.<\/p>\n<p>voters at all the 9 polling<br \/>\nballot papers were polled&#8221;&#8216;a_s  ll&#8217;}l)l:VsV7;&#8217;P&#8217;1ll to P9 the<br \/>\nforms No.22,  were  with the<br \/>\n11 1.ri.___ne. sf big,  Vtheilttresidm O\ufb01ioer of<br \/>\nr  ll  after the Miling<br \/>\nand, in  l&#8217;residing Officer as to the<br \/>\nincident &#8216;away of any of the ballot papers<\/p>\n<p>issued  the at &#8220;of the 9 polling stations during the<\/p>\n<p>  geese in View of the fact that before<\/p>\n<p>&#8220;&#8216;:11&#8243;i_f-1;&#8217;  &#8216;*&#8221; tn&#8221; vetes, the E-{et-.-..-new bi&#8217;E.w.<\/p>\n<p>     that was put to each ballot box by the<br \/>\nW H &#8216;T of the respective polling station was intact<br \/>\n tee&#8217; such there was no tampering of any of the ballot<\/p>\n<p>9 feexes, Lh\ufb02e. could M no r_xnce._ _n 0 the s\ufb01eged  or<\/p>\n<p>(&#8216;\\.f&#8217;*~&#8221;&#8221;&#8221;&#8216;-&#8220;&#8221;\n<\/p>\n<p>1&#8242;!<\/p>\n<p>missing, of any ballot paper from any ballot box as contended<\/p>\n<p>by the Returning Officer.\n<\/p>\n<p>.6<\/p>\n<p>1 1, _-_ .K.o..}b.9.nnabasappa, learned <\/p>\n<p>wnt\ufb01ided that even  it is assun1ed&#8230;that  eiaslmissmgllof  <\/p>\n<p>four ballot papers, it was for   1 mg  J<\/p>\n<p>Officer to ascertain from the respective  of the<\/p>\n<p>respective polling stations    c-tint the<\/p>\n<p>votes a- to h.;. when    those<br \/>\nballot papers  &#8216;be   &#8216;boxes, but it was<br \/>\nnot for the    While contending<br \/>\nso, he  being positive evidenc-<br \/>\nof P.Ws\u00a7zI_ to cf&#8217; the apmllant tl&#8221;*t the first<\/p>\n<p>res,oonde:1.Q&#8221;  after having found that the<\/p>\n<p>.-appei_la:nt   1,285 votes and the nearest rival<\/p>\n<p>AV&#8217;r;a:adidate.__i;~eg,vrespondent No.3 had secured 1,282 votes, in<\/p>\n<p>  order.   declare the 3rd respondent elewed, the<\/p>\n<p> &#8216; l~r:etu1&#8217;x1in_gv&#8221;{\u00a2)\ufb02icer hops a-&#8230;de without taking into account 4<\/p>\n<p>  halllogpamrs &#8216;&#8221;otes) which were cast in favour of the<\/p>\n<p>  and prepared a false form No.23 showing therein<\/p>\n<p>.  V    4 ballot papers were found short\/missing from the said<\/p>\n<p>i (&#8220;H-1,.-k;_.&#8211;I<br \/>\nC&#8212;&#8211;\n<\/p>\n<p><span class=\"hidden_text\">18<\/span><\/p>\n<p>ballot boxes, the learned Trial Judge comrnitted seriojs erro<\/p>\n<p>L; &#8230;_._._n :1. &#8216;;,-_q;\n<\/p>\n<p>tuc pcutiil  V *<\/p>\n<p>&#8216;1 U4 mi 1 L11 l&#8221;&#8221;&#8221;&#8221;&#8221;1 &#8220;&#8216;l&#8217;.l&#8217;\ufb01&#8217;i&#8217;1 &#8216;f<\/p>\n<p>considering this important and relevant   4_<\/p>\n<p>determines the real controversy tl1at&#8211;has this   &#8216; <\/p>\n<p>12. They furth er<\/p>\n<p>contended  ,V_:&#8217;the&#8217;.*~appeliant failed to establish that all the<\/p>\n<p> werel\ufb02found from all the ballot boxes taken<\/p>\n<p>&#8216;  1 |&#8217;)QFA\\&#8217;.,\\&#8217;I-1-:1-1:1:-.::|Il3*i&#8217;.&#8217;.~:AV&#8217;.1 _ -ruacu-\\.r-n-1rI:.n-sf had my-nnuy-I<br \/>\nJ.&#8217;\u00a3\u00a2lJ\\l  &#8216;:0 tI.l.l.u. tr<\/p>\n<p>  \ufb01nding that the appellant had secured<\/p>\n<p>&#8221;  respondent falsely prepared form No.23 showing therein<\/p>\n<p>  of 4 ballot papers (votes), only with a view to declare<\/p>\n<p>  respondent elected and therefore the learned Trial<\/p>\n<p> A&#8221;  dludge riytly dismissed the election petition of the appellant,<\/p>\n<p>Wx<\/p>\n<p>In<\/p>\n<p><span class=\"hidden_text\">19<\/span><\/p>\n<p>13. Thus, it is quite clear  <\/p>\n<p>Rule 24 and Section 35 of the Act&#8211;~that&#8221; as e<\/p>\n<p>the contesting candidates at  &#8221; by the<\/p>\n<p>.. &#8230;&#8230; I.-.&#8221;.:..  -19 _.-|u._._ L- _|_-<br \/>\n1&#8217;1UBl.\\.l.l.l,Jg {}$&#8221;s.2&#8217;c&#8217;;1 b\ufb01fuuzi tn &#8220;T .Ll1Ll_.1l.&#8217;\u00a3l.|.?u&#8217;C out 0.]. ml ti t &#8216; 1<\/p>\n<p>ballot box which&#8217;_:isv__ to  be    g the ballot<br \/>\npapers(votes) by_en1ptyt jtsnau be locked and<br \/>\nsealed with as-pipl\u00e9xesiclingoorricer and those of the<\/p>\n<p> gt &#8212;_-1 1-; 91% in ft&#8230;\n<\/p>\n<p> It is clear from the said provisions that<br \/>\n&#8216;receiving the ballot paper for the purpose of<\/p>\n<p>  the ballot paper into the ballot box after<\/p>\n<p>5-\u00bb<br \/>\nE-\u00ab-\n<\/p>\n<p>(&#8216;I<\/p>\n<p>andidate<br \/>\n  as oiee and after folding it, and ifrauciuientiy takes<br \/>\n   or attempts to take away the said ballot paper, such an<\/p>\n<p>it   of the voter would certainly be witnessed by the Presiding<\/p>\n<p>  Ol\ufb01cer and also the polling agents of the respective contesting<\/p>\n<p>F&#8217;f\\&#8221;.&#8217;.\/&#8221;\n<\/p>\n<p>Jig.&#8217;<br \/>\n\u00a30<\/p>\n<p>candidates and other persons and, in that event the<\/p>\n<p>Officer sh&#8230;&#8221; ha.e 1:. proceed to arrest such voter;&#8221;and&#8217;.reooiier-<\/p>\n<p>from his posses*&#8217;*n s&#8221;&#8221;-h ballot page it is  to z1.&#8217;.&#8217;tcp <\/p>\n<p>that it is not the case of any of the i:espo1ideizts&#8217;.ti&#8217;1at~ at &#8216;<\/p>\n<p>1-laluvarthi polling station or  <\/p>\n<p>occurred such an i11(:ide1it of  with him<\/p>\n<p>&#8220;&#8216;|-.\n<\/p>\n<p>C<br \/>\nC<\/p>\n<p>&#8220;er any hallo. paper i_;.3.1L.__ L. la;n&#8221; ._for the purpose of<br \/>\nvoting. As to the allegged shortag, _r xnissing oi&#8217;<\/p>\n<p>.._&#8230;_.I:._J_L<\/p>\n<p>&#8230;_!L,t papers, the apmliant uiuulu Le, * t_\u00a7sides&#8221;&#8211;.<\/p>\n<p>necessary averments in his electio_n&#8230;.pe\ufb02\ufb01e1&#8243;1}  _ <\/p>\n<p>clear terms at para 6 of his it   this<\/p>\n<p>examination-in&#8211;chief as P.W.   tiled&#8217; <\/p>\n<p>I0<br \/>\nF<\/p>\n<p>from out of 3,530 votes {:9  oftt._.d;&#8211;\u00bb..i..vslid,v-.,.e\u00bb it&#8217;<\/p>\n<p>all 1,235 votes, the ti&#8221;&#8221;&#8216;d   1,282 votes and<br \/>\nthe other two ueandida.tes:&#8217;  it and 615 votes<br \/>\nrespectively  fae.t_IespondenL instead of<br \/>\ndeclaring him (appease; candidate, declared<br \/>\nthird  $,as. ..:&#8230;her stated mm-sin ti&#8211;t<\/p>\n<p>at ti&#8221;-&#8216;t time o1&#8243;iicer who was subordinate to first<\/p>\n<p> iiiside&#8230;the chambers of the \ufb01rst respondent<\/p>\n<p>{vitI1.:.4&#8243;  wherein the voters had cast their votes in<\/p>\n<p> e\u00bb&#8230;__._favoi1r:&#8221;of &#8216;jafqoellant and that on seeing the sense he<\/p>\n<p> questio__ed t:,.e &#8230;.id ..f!&#8217;im as to  he&#8217; &#8216;&#8221;&#8221;s taking the baiiot<\/p>\n<p> F&#8221;-?_*rsi&#8221;&#8221;&#8216;jto the chambers of&#8217; the first respondent but he told<\/p>\n<p>   aappellant that he was so taking them for getting&#8217; the<\/p>\n<p>V  _een\ufb021ma\ufb01on as to the validity of the said votes.
