THE DISTRICT SUPERINTENDENT OF EDUCATION,\n                   MADHEPURA\n                                          -----------\n<\/pre>\n<p>03.   03.12.2010                Heard learned counsel for the petitioner and learned counsel<\/p>\n<p>                   for the State.\n<\/p>\n<p>                                The reason for the petitioner to file the writ application is<\/p>\n<p>                   because by a common recommendation the District Compassionate<\/p>\n<p>                   Appointment Committee had made                for appointment of all those<\/p>\n<p>                   candidates, whose case was considered           under the compassionate<\/p>\n<p>                   appointment head. Name of the petitioner has also figured in that list,<\/p>\n<p>                   which is evident from Annexure-2. However, when the matter           came<\/p>\n<p>                   down finally for appointment, four persons came to be appointed on<\/p>\n<p>                   Class-III post. Petitioner was directed to approach the authorities for his<\/p>\n<p>                   accommodation as a Panchayat Teacher on the ground that no vacancies<\/p>\n<p>                   are available for the respondents to offer.\n<\/p>\n<p>                                Counsel for the petitioner has very categorically asserted in<\/p>\n<p>                   para 8 of the writ application with regard to availability of the post,<\/p>\n<p>                   based on information he has obtained. This fact has not been<\/p>\n<p>                   controverted      in the counter affidavit, which has been filed on behalf<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>      of the respondents.
