Bali, CJ. (Oral):\n<\/p>\n<\/p>\n<p>             Santhosh,   the   petitioner   herein,   has   been   held   guilty<\/p>\n<p>under Section 279 of Indian Penal Code and sentenced to undergo<\/p>\n<p>simple imprisonment for six months. He has also been held guilty<\/p>\n<p>under   Section   304-A   of   Indian   Penal   Code     and   sentenced   to<\/p>\n<p>undergo simple   imprisonment for one year. The sentences were<\/p>\n<p>ordered   to   run   consecutively,   as   would   be   clear   from   the   order<\/p>\n<p>dated 25th May, 1996 passed by the Judicial Magistrate of I Class-<\/p>\n<p>III, Thrissur.  The appeal carried against this order was dismissed<\/p>\n<p>by   the   learned   I   Additional   Sessions   Judge,   Thrissur,   vide   order<\/p>\n<p>dated 10th  August,  1998.  It  is against these two  orders  that  the<\/p>\n<p>revision has been filed.\n<\/p>\n<\/p>\n<p>             2.   Learned   counsel   representing   the   petitioner   had<\/p>\n<p>urged   that   the   present   case   may   border   on   a   pure   and   simple<\/p>\n<p>accident and rash and negligent driving. He referred to the other<\/p>\n<p>circumstances of the case and prayed that the petitioner may not<\/p>\n<p>be   sent   to   serve   a   jail   term   at   this   distance   of   time,   the<\/p>\n<p>occurrence     pertaining   to   the   year   1994.   On   these   contentions,<\/p>\n<p>the legal heir of the defacto complainant has been impleaded and<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.672 of 1998               &#8211; 2 &#8211;<\/span><\/p>\n<p>issued notice.  She has entered appearance through counsel, who<\/p>\n<p>prays that the matter be given quietus if some compensation is<\/p>\n<p>paid.\n<\/p>\n<\/p>\n<p>             3. The occurrence pertains to the year 1994 and in the<\/p>\n<p>manner   aforesaid,   the   petitioner   has   undergone   the   agony   of<\/p>\n<p>protracted   trial   spanned   over   a   period   of   12   years.   Considering<\/p>\n<p>the facts and circumstances  of the case, this Court is of the view<\/p>\n<p>that interest of justice would be served if the petitioner instead of<\/p>\n<p>serving   the   jail   term,   be   sentenced   to   pay   compensation.<\/p>\n<p>Accordingly, while maintaining the order of conviction against the<\/p>\n<p>petitioner, the petitioner is sentenced to pay a compensation of<\/p>\n<p>Rs.35,000\/- (Rupees thirty five thousand only) to the added 2nd<\/p>\n<p>respondent within three months from today.<\/p>\n<p>             The   Criminal   Revision   Petition   is   disposed   of   as<\/p>\n<p>indicated above.\n<\/p>\n<\/p>\n<p>                                                            V.K.Bali<\/p>\n<p>                                                          Chief Justice<\/p>\n<p>vku\/-\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Santhosh vs State Of Kerala on 29 November, 2006 IN THE HIGH COURT OF KERALA AT ERNAKULAM Crl Rev Pet No. 672 of 1998() 1.
