DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMrs. Krina Calla,  learned APP, waives service of notice of Rule for<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I-35 of 2010 with Panshina Police Station,  for the offences<br \/>\n\tpunishable under Sections 465, 467 and 471 of the Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the applicants submits that petitioner No.1 is doing<br \/>\n\ttransportation business and owner of both the trucks.  It is further<br \/>\n\tsubmitted that due to bonafide mistake of the painter, number plates<br \/>\n\twere wrongly affixed.  Learned advocate for the applicants further<br \/>\n\tsubmits that charge sheet is already filed and, therefore, the<br \/>\n\tapplicants deserve to be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, I am inclined to enlarge the<br \/>\n\tapplicants on bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I-35 of 2010<br \/>\n\twith Panshina Police Station on executing bond of Rs.5,000\/- (Rupees<br \/>\n\tFive thousand only) each with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\tthey shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10.00 a.m. and 3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicants only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail bond to<br \/>\n\tbe executed before the lower court having jurisdiction to try the<br \/>\n\tcase.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
