The Applicant filed an RTI application dt.21.2.08 with the ADM, N.F.Railway requesting<br \/>\n      for the following information:\n<\/p>\n<p>      i)      Certified true copy of the FIR submitted by the Railway Department in<br \/>\n      connection with missing\/theft of Master Sheet Gang No.MN-2(CMA) submitted            on<br \/>\n      16.6.05 or on a later date\n<\/p>\n<p>      ii)     Your opinion on the issue whether it was missing or lost or theft\n<\/p>\n<p>      iii)    The dates on which he was shown absent on the muster sheets with effect<br \/>\n      from 8\/2004 to 1\/2008\n<\/p>\n<p>      iv)     The dates on which the Mate concerned marked him present but the PWI<br \/>\n      marked as absent.\n<\/p>\n<p>      On not receiving any reply, he filed an appeal dt.28.3.08 with the DRM, N.F.Railway,<br \/>\n      Tinsukia reiterating his request for the information. The Appellate Authority provided<br \/>\n      a detailed reply    on 8.5.08.   Being aggrieved with the reply, the Applicant filed a<br \/>\n      second appeal on 30.1.09 before CIC.\n<\/p>\n<p>2.    The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing<br \/>\n      for December 22, 2009.\n<\/p>\n<p>3.    Shri   P.C.Madhukar,    PIO   and   Shri    Anandkumar.S.Ganvir,   Appellate   Authority<br \/>\n      represented the Public Authority.\n<\/p>\n<p>4.    The Appellant was not present during the hearing.\n<\/p>\n<p>Decision<\/p>\n<p>5     The Respondents submitted that information against point 2 was provided on 19.11.08<br \/>\n      and that new points 1 and 3 seeking additional information were added later and were<br \/>\n      not included in the original application.\n<\/p>\n<p>6.    The Commission after hearing the submissions of the Respondent holds that available<br \/>\n      information has been provided and accordingly disposes off the appeal.\n<\/p>\n<p> 7.     The PIO to showcause as to why penalty should not be levied on him for not providing<br \/>\n       the information within the mandatory period.
