He submitted that<br \/>\nconsidering the role attributed to the applicant, which is reflected<br \/>\nin the FIR to the application, this is a fit case to enlarge the<br \/>\napplicant on regular bail. Learned advocate for the applicant relied<br \/>\nupon the order dated 18.2.2010 passed by this Court in Criminal Misc.<br \/>\nApplication No.1275 of 2010 in support of the submissions and<br \/>\nsubmitted that since the main culprit, who has been already enlarged<br \/>\non bail by the aforesaid order, the applicant deserves to be enlarged<br \/>\non bail.\n<\/p>\n<p>\tLearned<br \/>\nAPP Mr. Devang Vyas appearing on behalf of the State, opposed the<br \/>\nsubmissions made by the learned advocate for the applicant and<br \/>\nsubmitted that the applicant has committed serious offence, which is<br \/>\npunishable under Sections 467,<br \/>\n471 and 114 of the Indian Penal Code. Considering the manner<br \/>\nin which the applicant has committed the offence along with other<br \/>\naccused, he is not entitled for any discretionary relief  and the<br \/>\napplication be dismissed.\n<\/p>\n<p>\tHaving considered the<br \/>\nrival submissions canvassed by the learned counsel for both the<br \/>\nsides, the role of the applicant which is reflected in the FIR,<br \/>\npolice papers and considering the fact that the main culprit is<br \/>\nalready enlarged by this Court vide order dated 18.2.2010 passed in<br \/>\nCriminal Misc. Application No.1275 of 2010, I am of the view that the<br \/>\nthe applicant is required to be enlarged on bail without entering<br \/>\ninto the merits of the case and without discussing the evidence in<br \/>\ndetail at this stage. However, stringent terms and conditions are<br \/>\nrequired to be imposed on the applicant while releasing him on bail.\n<\/p>\n<p>\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with  C.R.<br \/>\nNo. I &#8211; 82 of 2009  filed before the Western Railway Police Station,<br \/>\nAhmedabad on executing a bond of Rs.20,000\/- [Rupees twenty thousand<br \/>\nonly] with one surety of the like amount to the satisfaction of the<br \/>\ntrial court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender his<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot leave the State<br \/>\nof Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>[e].\tmark his presence at<br \/>\nWestern Railway Police Station, Ahmedabad twice in a week, i.e. on<br \/>\n1st and 15th of each English calendar month<br \/>\nbetween 9.00 AM and 2.00 PM. till the trial is over;\n<\/p>\n<p>[f].\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain law and<br \/>\norder.\n<\/p>\n<p>\tIf breach of any of the<br \/>\nabove conditions is committed, the Sessions Judge concerned will be<br \/>\nfree to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>\tBail bond to be executed<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tAt the trial, the trial<br \/>\nCourt shall not be influenced by the observations of preliminary<br \/>\nnature, qua the evidence at this stage, made by this Court while<br \/>\nenlarging the applicant on bail.\n<\/p>\n<p>\tRule is made absolute to<br \/>\nthe aforesaid extent.\n<\/p>\n<p>\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t(H.B.ANTANI,<br \/>\nJ.)<\/p>\n<p>ynvyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ismail vs State on 6 April, 2010 Author: H.B.Antani,&amp;Nbsp;
