NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     These special  leave petition  have been  filed against<br \/>\nthe judgement  and  orders  dated  May\t27,1996\t and  August<br \/>\n20,1996 passed by the Division Bench of the Punjab &amp; Haryana<br \/>\nHigh Court  in the write petition and the Review Petition in<br \/>\nRegular Appeal No.191 of 1996 respectively.\n<\/p>\n<p>     The  admitted  position  is  that\tthe  petitioner\t was<br \/>\nappointed on  ad had basis to the post of Legal Assistant in<br \/>\nthe respondent-organisation  . Rule 8 of the Punjab Roadways<br \/>\n(Ministerial) State  Serve Class-III Rules ,1997 provides as<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;8. No person shall be appointed to<br \/>\n     the service unless he has requisite<br \/>\n     qualification  and\t  experience  as<br \/>\n     specified in  column 3  of Appendix<br \/>\n     &#8216;B&#8217;  to  these  rules  in\tcase  of<br \/>\n     direct appointment\t and appointment<br \/>\n     by transfer  and those specified in<br \/>\n     column 4  of the aforesaid Appendix<br \/>\n     in case of appointment by promotion<br \/>\n     .\n<\/p><\/blockquote>\n<blockquote><p>     9 (1).  appointment to  the service<br \/>\n     shall  be\tmade  in  the  following<br \/>\n     manner namely:-\n<\/p><\/blockquote>\n<pre>     a)\t *    *\t    *\t  *\t *     *\n     *\n     b)\t  in\tthe   case    of   legal\n     Assistants:-\n     i)\t      20   percent   by\t  direct\n     recruitment; and\n     ii) 80  percent by\t promotion  from\n<\/pre>\n<blockquote><p>     amongst the  Law Graduates\t serving<br \/>\n     in the  Deptt. including  employees<br \/>\n     of the Punjab Roadways on the basis<br \/>\n     of merit-cum-seniority; or\n<\/p><\/blockquote>\n<blockquote><p>     iii) by transfer or   deputation of<br \/>\n     an official  already in  service of<br \/>\n     Government of  India, if a suitable<br \/>\n     candidate is  not available  by the<br \/>\n     methods mentioned\tin  sub\t clauses\n<\/p><\/blockquote>\n<blockquote><p>     (i) and (ii).&#8221;<\/p><\/blockquote>\n<p>     A reading of Rule 8 would clearly indicate that all Law<br \/>\nGraduates  serving   in\t the  Department  are  eligible\t for<br \/>\nconsideration of  promotion as Legal Assistants on the basis<br \/>\nof merit-cum-seniority\tsubject to the qualification and the<br \/>\ncondition mentioned  in the Rules. Rule 9 (1) (b) postulates<br \/>\nthat 20%  of the  posts of Legal Assistants are reserved for<br \/>\ndirect recruitment.  Admittedly,   the petitioner came to be<br \/>\nappointed as  direct recruit  on ad hoc basis to the post of<br \/>\nLegal  Assistant   within  that\t  quota.  When\t the  direct<br \/>\nrecruitment is\tmade, the  Government has  no power to relax<br \/>\nthe conditions\trequired to  be fulfilled for being eligible<br \/>\nfor appointment\t by direct  recruitment and  to give further<br \/>\npromotion to  the petitioner  as Legal\tAssistant exercising<br \/>\nthe power under rule 22 relaxing rules 8 and 9 of the Rules.<br \/>\nThe Division Bench of the High Court, therefore, is right in<br \/>\nits conclusion\tthat the  petitioner , having been appointed<br \/>\nas Legal  Assistant on\tad hoc basis, could not continue any<br \/>\nlonger unless  a regular  recruitment was made. a direction,<br \/>\nthere fore,  was given\tto the\trespondents to\tmake regular<br \/>\nrecruitment and\t in the\t event of  regular  appointment\t not<br \/>\nbeing made  within three  months, the  petitioner would\t not<br \/>\ncontinue any  longer after the expiry of three months. Under<br \/>\nthese circumstances, we do not think that the High Court has<br \/>\ncommitted any  error of\t law  in  the  above  interpretation<br \/>\nwarranting interference.  it is\t for the  Government to take<br \/>\nappropriate action under the law.\n<\/p>\n<p>     The special leave petitions are accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sodagar Singh vs State Of Punjab &amp; Ors on 24 January, 1997 Bench: K.
