Notice was issued on<br \/>\n9th July 2009 and later on, on 8th September<br \/>\n2009, the Court issued Rule,<br \/>\nreturnable on 30th September 2009 with a direction to<br \/>\nplace in the First Board.\n<\/p>\n<p>3.0\tToday,<br \/>\nthe matter came up for consideration on Civil Application No. 9178 of<br \/>\n2010 being filed in the present matter.  In the Civil Application, it<br \/>\nis prayed that:\n<\/p>\n<p>&#8220;6(A)\t\tRelease<br \/>\nthe amount of Rs.82,300\/-, Rs.97,734\/- and Rs.1,80,034\/- representing<br \/>\ngratuity, commuted pension and leave encashment, in all<br \/>\nRs.2,06,151\/- in favour of the applicant.&#8221;\n<\/p>\n<p>4.0\tLearned<br \/>\nadvocate Mr. Supehia for the petitioner submitted that the present<br \/>\nCivil Application is filed as the main matter is not being heard due<br \/>\nto paucity of time.\n<\/p>\n<p>5.0\tLearned<br \/>\nadvocate Mr. Raval invited attention of the Court to Page 8 of the<br \/>\nCivil Application, which is an &#8216;Appointment Order&#8217;. It is dated 23rd<br \/>\nJuly 1981.  In this Appointment Order it is specifically mentioned<br \/>\nthat, &#8216;the petitioner is given appointment as a &#8216;Midwife&#8217; in<br \/>\n&#8216;Primary Health Center&#8217; run by the District Panchayat.  After she<br \/>\nsuccessfully cleared the interview held on 11th<br \/>\nMarch 1980 and she is given appointment in the pay-scale of<br \/>\n196-3-232, with the initial pay of Rs.196\/-&#8216;.  Later on, the<br \/>\npetitioner made a Representation to the Medical Officer, Primary<br \/>\nHealth Center, Bamanbor dated 11th January 1999, a copy of<br \/>\nwhich is produced at Annexure &#8216;E&#8217; to the Civil Application.  In this<br \/>\nRepresentation, the petitioner described herself as a &#8216;Trained Dayan&#8217;<br \/>\n(Trained Midwife) and it is specifically mentioned that, &#8216;she was<br \/>\nappointed as a &#8216;Trained Dayan&#8217; (Trained Midwife) w.e.f. 24th<br \/>\nMarch 1981&#8242; and then she claimed the benefits of the pay-scale of the<br \/>\n&#8216;Trained Midwife&#8217;.\n<\/p>\n<p>5.1\tIt<br \/>\nappears that, by means which are not known to law, the petitioner was<br \/>\nable to obtain pay-scale of &#8216;Trained Midwife&#8217;, which later on came to<br \/>\nthe notice of the authorities and therefore, the authorities passed<br \/>\nthe impugned orders, which are under challenge in this petition.\n<\/p>\n<p>5.2\tLearned<br \/>\nadvocate Mr. Raval submitted that what is produced at Annexure &#8216;F&#8217; to<br \/>\nthe Civil Application is an order dated<br \/>\n15th January<br \/>\n1999.  He submitted that this order is issued by the Medical Officer,<br \/>\nPrimary Health Center, Bamanbor, who had no authority to issue any<br \/>\nsuch order and therefore, the authorities having learnt about the<br \/>\nsame, have ordered inquiry into the matter.\n<\/p>\n<p>5.3\tLearned<br \/>\nadvocate Mr. Supehia was asked to explain as to when the petitioner<br \/>\nwas given appointment as &#8216;Trained Midwife&#8217; as mentioned in the<br \/>\nRepresentation dated 11th January 1999 (Annexure &#8216;E&#8217; to<br \/>\nthe Civil Application) when the Appointment Order was specifically<br \/>\nissued for the post of only &#8216;Midwife&#8217; and not &#8216;Trained Midwife&#8217;<br \/>\n(Annexure &#8216;D&#8217; to the Civil Application), Learned advocate Mr. Supehia<br \/>\ncould not dislodge the submissions made by learned advocate Mr.<br \/>\nRaval.  In view of that, the Court finds that the petitioner has<br \/>\nmisrepresented before the authorities as early as on 15th<br \/>\nJanuary 1999 and obtained an order in her favour from the<br \/>\nauthorities, who was not having the competence to issue any such<br \/>\norder (Annexure &#8216;F&#8217; to the Civil Application).\n<\/p>\n<p>6.0\tIn<br \/>\nview of that, this petition is dismissed.  As the petitioner has<br \/>\nalready retired from service and is already out of job, the Court<br \/>\nrestrains itself from imposing any cost on the petitioner.\n<\/p>\n<p>6.1\tRule<br \/>\nis discharged with no order as to costs.\n<\/p>\n<p>[<br \/>\nRavi R.
