In<br \/>\npursuance to the said FIR, the police sealed the godown of the<br \/>\npetitioner wherein 2860 kgs. of jaggery was lying. Thus, the<br \/>\npetitioner filed Miscellaneous Criminal Application before learned<br \/>\nJMFC, Ankleshwar under Section 451 of Indian Penal Code in C.R.No.<br \/>\nIII 841\/2010 for release of muddammal of 2860 kgs. of jaggery lying<br \/>\nin the godown sealed by the police.  Learned JMFC passed order dated<br \/>\n25.10.2010 to release the muddammal but imposed condition of<br \/>\nproducing bank guarantee of Rs.71,500\/- before the Court. Being<br \/>\naggrieved by the said order, the petitioner filed Criminal Revision<br \/>\nApplication No.159 of 2010 before the learned Additional Sessions<br \/>\nJudge, Bharuch camp at Ankleshwar. However, the learned Additional<br \/>\nSessions Judge, Fast Track Court, Bharuch rejected the revision<br \/>\napplication and confirmed the order passed by learned JMFC. Hence,<br \/>\nthis petition.\n<\/p>\n<p>\t\tHeard<br \/>\nlearned advocates for the parties and perused the orders passed by<br \/>\nboth the Courts below.\n<\/p>\n<p>\t\tOn<br \/>\nreading the order passed by learned JMFC, prima facie, the order is<br \/>\nvery harsh and amounts to rejection of the prayer made by the<br \/>\npetitioner and the learned lower appellate Court ought to have<br \/>\nallowed the revision application and ought to have modified the<br \/>\ncondition of producing the bank guarantee as imposed by the learned<br \/>\nJMFC.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above, this petition is partly allowed. The order dated<br \/>\n28.1.2011 passed by learned Additional Sessions Judge, Fast Track<br \/>\nCourt, Bharuch in Criminal Revision Application No.159 of 2010 is<br \/>\nhereby set aside. The order dated 25.10.2010 passed by learned JMFC<br \/>\nis modified to the extent that the muddammal as described in the<br \/>\norder be handed over to the petitioner on furnishing personal bond of<br \/>\nRs.71,500\/- (Rupees seventy one thousand five hundred only) and<br \/>\nsurety of like amount instead of bank guarantee. The rest of the<br \/>\norder remains unaltered.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute to the aforesaid extent.
