The respondent<br \/>\nauthorities denied appointment to the petitioner on the ground of not<br \/>\nfulfilling requisite qualifications.  The petitioner thereafter<br \/>\nacquired the requisite qualification and reapproached the respondent<br \/>\nno. 2.  However, the respondent no. 2 vide order dated 10.07.2009<br \/>\nrejected the application and therefore the present petition is filed.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Gohil, learned advocate appearing for the petitioner has submitted<br \/>\nthat the respondent has passed the impugned order rejecting the<br \/>\napplication of the petitioner on the ground that the petitioner was<br \/>\nnot possessing educational qualification of tenth standard as per<br \/>\nG.R. dated 16.03.2005.  Meanwhile the petitioner appeared at the SSC<br \/>\nexamination and passed the same in March 2009 and therefore the case<br \/>\nof the petitioner ought to have been considered on compassionate<br \/>\ngrounds.\n<\/p>\n<p>4.\tThis<br \/>\nCourt has considered the materials placed on record.  It is an<br \/>\nadmitted position that pursuant to the death of the petitioner&#8217;s<br \/>\nfather on 18.03.2006, the application for compassionate appointment<br \/>\nwas preferred on 12.05.2006.  However, the application of the<br \/>\npetitioner was rejected by the respondent authority vide order dated<br \/>\n01.06.2006 on the ground that he did not fulfill the requisite<br \/>\nqualification of standard ten at the relevant time.\n<\/p>\n<p>4.1\tThe<br \/>\npetitioner thereafter cleared SSC examination in March 2009 i.e.<br \/>\nafter about three years.  The purpose of providing a compassionate<br \/>\nappointment is to mitigate the hardship due to the death of the<br \/>\nbreadwinner of the family.  It cannot be claimed as a matter of<br \/>\nfundamental or statutory right.  Moreover, it is also a well settled<br \/>\nlaw that the respondent is required to consider the application for<br \/>\ncompassionate appointment on the basis of the scheme which was<br \/>\nprevailing at the time of the application.  The financial<br \/>\nimplications which arise on the part of the government is also<br \/>\nrequired to be considered.\n<\/p>\n<p>5.\tAs<br \/>\na result of hearing and perusal of records, it appears that the<br \/>\nrespondent authority has passed the order rejecting the application<br \/>\nof the petitioner  considering various factors more particularly the<br \/>\nfact that the petitioner was not qualified for the post in question<br \/>\nat the time of the death of the petitioner&#8217;s father.  Subsequent<br \/>\nacquisition of the qualification shall not make the petitioner<br \/>\neligible fundamentally for the appointment.  The appointment on<br \/>\ncompassionate ground not being a fundamental or statutory right<br \/>\ncannot be enforced upon any authority.  Moreover, considering the<br \/>\ndecision of the Apex Court in the case of Santosh Kumar Dubey vs.<br \/>\nState of Uttar Pradesh and others reported in 2009(6) SCC 481,<br \/>\nthis Court is not inclined to exercise its discretionary power in<br \/>\nfavour of the petitioner and the petition requires to be dismissed.\n<\/p>\n<p>6.\tIn<br \/>\nthe premises aforesaid, petition is dismissed.
