Kamra of Bikaner filed an RTI-application with the Public<br \/>\nInformation   Officer,    RITES,   Gurgaon,   on   7   November   2007,   seeking<br \/>\ninformation\/documents on six counts relating to the Rajasthan Urban<br \/>\nInfrastructure Development Project of Rs.1500 crores.\n<\/p>\n<p>2.    Not getting any reply from the PIO within 30 days of filing his RTI-<br \/>\napplication, the Applicant approached the Central Information Commission with<br \/>\na Complaint on 23 December 2007 which was received in the Commission on 10<br \/>\nMarch 2008.\n<\/p>\n<p>3.    The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the<br \/>\nmatter on 23 October 2008.\n<\/p>\n<p>4.    Shri AKM Sharma, GM\/MCS &amp; PIO, Shri Rahul Jha, GGM (CS) and Shri D.K.<br \/>\nSinha, DGM(I), represented the Respondents.\n<\/p>\n<p>5.    The Complainant, Shri Manoj K. Kamra, was present in person.\n<\/p>\n<p>Decision:\n<\/p>\n<p>6.    The Commission heard both the sides and noted that in response to the<br \/>\nRTI-application received by them on 13 November 2007, the Respondents<br \/>\nresponded on 14 December 2007 to which the Applicant came in a complaint to<br \/>\nthe Commission. As the reply has been delayed only marginally (by one day),<br \/>\nthe Commission feels it an appropriate case to be remanded to the first<br \/>\n Appellate Authority of the Organization. Accordingly, it directs the Appellant<br \/>\nto file his First Appeal. He may do so by 14 November 2008.\n<\/p>\n<p>7.
