MEERA DEVI, W\/O- RAJ KUMAR DAS R\/O- JAWAYAT,\n                 PROSOTAMPUR, P.S.- HAWELLY KHARAGPUR, DISTT.\n                 MUNGER.\n\n         For the petitioners         : Mr. Manoj Kumar, Advocate\n         For the State               : Mr. Jharkhandi Upadhyay, APP\n\n                                                -----------\n<\/pre>\n<p>3   30.08.2010                   Heard learned counsel for the petitioner        and the<\/p>\n<p>                    State.\n<\/p>\n<p>                                 Petitioner is aggrieved by the order dated 23.7.2008<\/p>\n<p>                    passed by learned Chief Judicial Magistrate, Munger in S.C\/S.T.<\/p>\n<p>                    P.S. case no. 41 of 2007 whereby on a perusal of the police<\/p>\n<p>                    report, it has been found that a prima facie case is made out and<\/p>\n<p>                    has differed with the final opinion of the investigating agency not<\/p>\n<p>                    sending up the accused. It is contented that earlier to this, an<\/p>\n<p>                    F.I.R. was lodged by the same informant in which cognizance has<\/p>\n<p>                    been taken and the matter has been carried to this Court and<\/p>\n<p>                    admitted. It is next contended that both the parties are co-<\/p>\n<p>                    villagers.\n<\/p>\n<p>                                 In my view, on these submissions, the legality of the<\/p>\n<p>                    order cannot be challenged. Considering the jurisdiction invoked<\/p>\n<p>                    by learned trial court, this court does not find any illegality in the<\/p>\n<p>                    order impugned.\n<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>                   There is no merit in this application. It is accordingly<\/p>\n<p>      dismissed.\n<\/p>\n<\/p>\n<p>                               ( Kishore K.
