The former i.e., levy arises at initial stage by<br \/>\nvirtue of the provisions under Central Excise Act, whereas collection<br \/>\nof duty arises at a subsequent stage. Since the acts of defrauding<br \/>\nthe exchequers by the said three persons are intermingled, a<br \/>\nseparate\/proportionate liability of the said three persons cannot be<br \/>\nascertained. In such situation, whether the Tribunal was correct in<br \/>\nordering to fix individual liability of the said three persons<br \/>\nincluding the respondent, where the law itself provides that a fraud<br \/>\nand forgery vitiate everything and the person wronged has his remedy<br \/>\nagainst all, or any one or more of them at his choice; for every<br \/>\nwrong doer is jointly and severally liable for the whole damage, and<br \/>\nit does not matter whether they acted between themselves as equals,<br \/>\nor one of them as agent or broker ?&#8221;\n<\/p>\n<p>(d)\tWhether in the facts and<br \/>\ncircumstances of the case, the Tribunal has committed substantial<br \/>\nerror of law by disposing appeal of the respondent without obtaining<br \/>\nconsent of the parties and passing impugned order by applying<br \/>\ndecision of Yash Silk Mills (supra) ?\n<\/p>\n<p>(e)\tWhether the impugned<br \/>\norder passed by the Tribunal can be said to be passed in accordance<br \/>\nwith law ?&#8221;\n<\/p>\n<p>\tOn<br \/>\nhaving heard learned counsel  Shri R.J.Oza and having perused the<br \/>\norders of the adjudicating authorities with his assistance, it can be<br \/>\ngathered that the Tribunal has sought to rely on the judgment of<br \/>\nYash Silk Mills and others rendered in A\/2517-2532\/WZB\/AHD\/2008 dated<br \/>\n20th November 2008.  The said judgment was challenged by<br \/>\nthe Department before this Court  and  other such matters having<br \/>\nsimilar facts raising identical questions of law, being  Tax Appeal<br \/>\nNo.1 to 3 of 2011, while considering the issues proposed by the<br \/>\nDepartment, the Tax Appeals were not  entertained on the ground that<br \/>\nthere was no question of law which  was found to be emerging from the<br \/>\nrecord and those Tax Appeals have been accordingly not entertained.\n<\/p>\n<p>\tAs<br \/>\nfacts in the  present appeal and the questions proposed are<br \/>\nidentical, this Tax appeal deserves no further meritorious<br \/>\nconsideration   as no other and further grounds are raised to decide<br \/>\notherwise.
