The  Assistant Commissioner accepted their  claim\t and\n\tdirected  that\tthe possession of the disputed land  be\t re-\n\tstored to them.\t The appellants' appeal was dismissed by the\n\tDeputy Commissioner. but their revision petition was accept-\n\ted  by\tthe  Mysore Revenue Appellate  Tribunal.   The\tHigh\n\tCourt allowed the writ petition of the respondents.  direct-\n\ting  the  Tribunal not to reopen the questions\tof  fact  in\n\trevision.  The\tmatter was remanded and\t the  Tribunal\tthen\n\tupheld the findings of the Assistant and Deputy\t Commission-\n\ters,  and  dismissed the revision  petition.  The  appellant\n\tflied a writ petition which was dismissed by the High Court.\n\tDismissing the appeal, the Court,\n\tHELD:\n\t    (1)\t The concurrent findings of fact arrived at  by\t the\n\tAssistant  Commissioner\t the  Deputy  Commissioner  and\t the\n\tTribunal cannot be set aside in the writ petition. [322 B-C]\n\t    (2)\t Principles of res judicata can be invoked not\tonly\n\tin  separate subsequent proceedings, they can also  get\t at-\n\ttracted\t in subsequent stage of the same proceedings.\tOnce\n\tan  order made in the course of a proceeding becomes  final,\n\tit would be binding at the subsequent stage of that proceed-\n\tings. Dadachanji\tand  Co.,for<br \/>\n\tRespondents 1 and 2.\n<\/p>\n<p>\tThe Judgment of the Court was delivered by<br \/>\n\t    KHANNA,  J.&#8211;This is an appeal by special leave  against<br \/>\n\tthe judgment of the Mysore High Court whereby the High Court<br \/>\n\tdismissed  petition under articles 226 and 227 filed by\t the<br \/>\n\tappellants  to challenge the order dated September 12,\t1967<br \/>\n\tof  the Mysore Revenue Appellate Tribunal  (hereinafter\t re-<br \/>\n\tferred to as the Tribunal).\n<\/p>\n<p>\t    The brief facts giving rise to this appeal are that\t the<br \/>\n\tfirst  resdent\tapplied on April 22, 1959 to  the  Assistant<br \/>\n\tCommissioner   Bagalkot\t  for\tthe   restoration   of\t the<br \/>\n\tPatilki\/watan\/lands  survey Nos. 32\/2, 54\/2, and 49\/2  under<br \/>\n\tsections 11, 11A  and  12  of  the  Bombay Hereditary  Offi-<br \/>\n\tcers Act (hereinafter referred to as the Act). Possession of<br \/>\n\tthose  lands was sought on the ground that  the\t appellants,<br \/>\n\twho  were  strangers, had taken possession  of\tthe   lands.<br \/>\n\tThe  Assistant<br \/>\n<span class=\"hidden_text\">\t321<\/span><br \/>\n\tCommissioner, as per order dated August 11,  1960,  accepted<br \/>\n\tthat  application  and directed that the possession  of\t the<br \/>\n\tlands  be restored to the respondents.\tAppeal filed by\t the<br \/>\n\tappellants  against that order was dismissed by\t the  Deputy<br \/>\n\tCommissioner  as  per  order dated January  24,\t 1961.\t The<br \/>\n\tappellantas  then went up in revision before  the  Tribunal.<br \/>\n\tThe  Tribunal  as per order dated May 5, 1962  accepted\t the<br \/>\n\trevision  petition  and held that the  appellants  were\t not<br \/>\n\tstrangers to the watan.\t In arriving as this conclusion, the<br \/>\n\tTribunal  held\tdisagreeing with the Assistant\tCommissioner<br \/>\n\tand the Deputy Commissioner that the watan had been acquired<br \/>\n\tby  Basangouda I.  The respondents challenged the  order  of<br \/>\n\tthe Tribunal by means of a writ petition. The Writ  petition<br \/>\n\tfiled  by  the respondents was accepted by the\tMysore\tHigh<br \/>\n\tCourt  as per judgment dated December 18, 1964, and  it\t was<br \/>\n\theld that it was not open to the Tribunal to reopen and\t set<br \/>\n\taside  findings\t of fact in a revision petition.   The\tcase<br \/>\n\twas  accordingly  remitted to  the Tribunal for fresh  deci-<br \/>\n\tsion in the light of the observations of the High Court.<br \/>\n\t    When  the matter came up before the Tribunal  after\t the<br \/>\n\tabove judgment of the High Court, the Tribunal as per  order<br \/>\n\tdated September 12, 1967 upheld the findings of the  Assist-<br \/>\n\tant Commissioner and the Deputy Commissioner that the  watan<br \/>\n\thad   been  acquired by Basangouda II and not by  Basangouda<br \/>\n\tI.  It\tmay  be\t stated\t that Basangouda I was the  grandfa-<br \/>\n\tther  of Basangouda II and that unless it be shown that\t the<br \/>\n\twatan had been acquired by Basangouda I, the appellant would<br \/>\n\thave  to  be held strangers qua the  lands in  dispute.\t The<br \/>\n\tTribunal accordingly dismissed the revision petition   which<br \/>\n\thad been filed by the appellants.  The appellants thereafter<br \/>\n\tfiled  petition under articles 226 and 227 before  the\tHigh<br \/>\n\tCourt  and assailed  the above order of the  Tribunal.\t The<br \/>\n\tHigh  Court dismissed the writ petition on the\tground\tthat<br \/>\n\tthe finding that the appellants were strangers to the  watan<br \/>\n\twas  one  of fact and it was not open to the High  Court  to<br \/>\n\treopen the concurrent findings of the Assistant\t Commission-<br \/>\n\ter,  the  Deputy  Commissioner and the Tribunal\t in  a\twrit<br \/>\n\tpetition.\n<\/p>\n<p>\t    In\tappeal before us Mr. Gupte on behalf of\t the  appel-<br \/>\n\tlants has contended that the High Court was in error in\t not<br \/>\n\tinterfering  with  the\torder of the  Tribunal\twhereby\t the<br \/>\n\trevision  petition  filed by the appellants  had  been\tdis-<br \/>\n\tmissed.\t  It  is urged that the Tribunal  in  affirming\t the<br \/>\n\tfindings  of  the  Assistant Commissioner  and\tthe   Deputy<br \/>\n\tCommissioner regarding the question of the appellants  being<br \/>\n\tstrangers  qua\tthe land in dispute took a  very  restricted<br \/>\n\tview  of section 79 of the Act dealing with revision.\tThis<br \/>\n\tcontention,  in our opinion, is not well founded.  The\tHigh<br \/>\n\tCourt at the time of the decision of the earlier writ  peti-<br \/>\n\ttion on December 13, 1964 recorded a finding and gave direc-<br \/>\n\ttions to the Tribunal not to reopen the questions of fact in<br \/>\n\trevision.   The Tribunal while passing the order dated\tSep-<br \/>\n\ttember\t12, 1967 complied with those directions of the\tHigh<br \/>\n\tCourt.\tThe appellants are bound by the judgment of the High<br \/>\n\tCourt and it is not open to them to go behind that  judgment<br \/>\n\tin  this appeal.  No appeal wag filed against that  judgment<br \/>\n\tand it has  become  final.  It is well settled that  princi-<br \/>\n\tples  of  res judicata can be invoked not only\tin  separate<br \/>\n\tsubsequent  proceedings, they also get attracted  in  subse-<br \/>\n\tquent<br \/>\n<span class=\"hidden_text\">\t322<\/span><br \/>\n\tstage  of the same proceedings.\t Once an order made  in\t the<br \/>\n\tcourse<br \/>\n\t    of\ta proceeding becomes final, it would be\t binding  at<br \/>\n\tthe  subsequent\t stage of that proceeding.  In view  of\t the<br \/>\n\tHigh  Court judgment dated December 18,\t 1964, the  Tribunal<br \/>\n\twhile passing the order dated September 12, 1967,  disposing<br \/>\n\tof the revision\t petition filed\t by the appellant, could not<br \/>\n\treopen\tthe questions of fact which had been decided by\t the<br \/>\n\tAssistant Commissioner and the Deputy Commissioner. The High<br \/>\n\tCourt, in our opinion, was right in holding in the  judgment<br \/>\n\tunder appeal that the concurrent findings of fact arrived at<br \/>\n\tby  the Assistant Commissioner, the Deputy Commissioner\t and<br \/>\n\tthe Tribunal cannot be set aside in the writ petition.\t The<br \/>\n\tappeal\tconsequently fails and is dismissed but in the\tcir-<br \/>\n\tcumstances with no order as  to costs.\n<\/p>\n<pre>\tM.R.\t\t\t\t\t\t      Appeal\n\tdismissed.\n<span class=\"hidden_text\">\t323<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Y.B.
