No.9762 of 2010\n                               BIRENDRA KUMAR SINGH\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>5\/   29.07.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the State.\n<\/p>\n<p>                               Submission of the learned counsel for the<\/p>\n<p>                  petitioner    is    that   certainly   Rs.   1,20,000\/-    was<\/p>\n<p>                  advanced by the complainant as loan which petitioner<\/p>\n<p>                  could not return due to his failure in business which<\/p>\n<p>                  is clear from the complaint itself that while the<\/p>\n<p>                  business condition of the petitioner deteriorated this<\/p>\n<p>                  amount was given meaning thereby that he was in<\/p>\n<p>                  need of money. So, the intention was not mala fide.<\/p>\n<p>                  Petitioner     is   ready    to   return     the   money    on<\/p>\n<p>                  improvement of his financial position.<\/p>\n<p>                               Taking that into consideration, prayer of the<\/p>\n<p>                  petitioner is allowed.\n<\/p>\n<p>                               In the event of arrest or surrender within<\/p>\n<p>                  one month from the date of receipt\/production of a<\/p>\n<p>                  copy of this order in connection with Complaint Case<\/p>\n<p>                  No. 729 of 2007, above named petitioner shall be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  10,000\/- (ten thousand) with two sureties of the like<\/p>\n<p>                  amount each to the satisfaction of J.M., Ist Class,<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        Chapra at Saran subject to the conditions as laid<\/p>\n<p>        down under Section 438(2) of Cr.
