Kumar, J.\n<\/pre>\n<p>           On 10.11.2008 we have passed the following order:-\n<\/p>\n<p>                  &#8221; During the course of arguments, two queries were<br \/>\n           posed to the learned counsel for the petitioner on account of<br \/>\n           delay in responding to the offer of possession made by the<br \/>\n           respondents. Firstly, we asked the learned counsel as to<br \/>\n           whether the petitioner had adequate amount available with her<br \/>\n           when the instalments were required to be deposited because<br \/>\n           she has deposited 10% of the amount of Rs. 72, 000\/- on<br \/>\n           1.12.1998 and Rs. 1,08,000\/- i.e. 15% on 6.1.1999 and<br \/>\n           7.1.1999.    The next instalment was required to be paid on<br \/>\n           11.12.1999 amounting to Rs. 2,17, 139\/- and the next<br \/>\n           instalment on 11.12.2000 of equivalent amount was required to<br \/>\n           be paid. The petitioner is required to show that till 2001 she<br \/>\n           had adequate amount to meet the demand of payment of<br \/>\n           instalment. Secondly, the petitioner is also required to furnish<br \/>\n           the proof that she had ever sent representation dated 3.7.2001<br \/>\n           (Annexure P-3) because admittedly the same has not been sent<br \/>\n<span class=\"hidden_text\">              CWP No. 19132 of 2008                       -2-<\/span><br \/>\n             under the registered AD cover.\n<\/p>\n<p>                    List again on 19.11.2008.&#8221;\n<\/p>\n<p>             Learned counsel for the petitioner requests for further time to<\/p>\n<p>enable him to place on record the necessary information and documents.\n<\/p>\n<p>However, it would be appropriate to direct the petitioner to file a fresh writ<\/p>\n<p>petition after placing on record the information required by order dated<\/p>\n<p>10.11.2008 or any other additional information, which the petitioner may<\/p>\n<p>file in support of the petition.\n<\/p>\n<p>             Petition is dismissed as withdrawn with liberty to the petitioner<\/p>\n<p>to file a fresh one on the same cause of action.\n<\/p>\n<p>                                                   (M.
