(2) 545\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t   ORDER<br \/>\nAfter  having heard both the learned counsel, we are of\t the<br \/>\nview that the appeal will have to fail on two grounds.\t The<br \/>\ndocument Ex.  P-3, upon which the appellant bases his  claim<br \/>\ncontains  a peculiar clause to the effect that if  the\tsale<br \/>\nconsideration of Rs 12,000 (Rupees twelve thousand only) was<br \/>\nnot  paid on or before June 30, 1973, the document shall  be<br \/>\ndeemed to be cancelled.\t Therefore, this is not a case where<br \/>\nthe  sale consideration is promised to be paid on  a  future<br \/>\ndate.\tHence it will not qualify within the  definition  of<br \/>\nSection\t 54 of the Transfer of Property Act.   Further,\t the<br \/>\ndeed has been executed only by the transferor there being no<br \/>\nreciprocal  promise to pay by the transferee.  Even on\tthat<br \/>\nscore,\tit  cannot  constitute a promise  to  pay  the\tsale<br \/>\nconsideration  in future.  Therefore, the courts  below\t are<br \/>\ncorrect\t that there is no valid conveyance of the  property.<br \/>\nWe find not any merit and the civil appeal stands dismissed.<br \/>\nHowever, there shall be no order as to costs.\n<\/p>\n<p><span class=\"hidden_text\">545<\/span><\/p>\n<p><a href=\"\/doc\/310657\/\">BALBIR SINGH AND ANOTHER V. GURBACHAN KAUR AND OTHERS<br \/>\nORDER<\/a>\n<\/p>\n<p>1.   This  is an appeal against the judgment and order of  a<br \/>\nDivision  Bench\t of Andhra Pradesh High Court  at  Hyderabad<br \/>\ndated April 25, 1975 passed in Civil Appeal No. 9 of 1972.\n<\/p>\n<p>2.   The  appellant  herein  was the  plaintiff\t before\t the<br \/>\nsubordinate   judge,  seeking  under  Section  20   of\t the<br \/>\nArbitration  Act,  reference of the  subject-matter  of\t his<br \/>\ndispute with the respondent to arbitration.  The trial court<br \/>\nagreed with his plea and referred the matter to arbitration.<br \/>\nOn  appeal,  however, the High Court upset it on  the  basis<br \/>\nthat  the  trial  court\t was wrong  in\tobserving  that\t the<br \/>\nplaintiff had laid any foundation to his assertion that\t the<br \/>\n&#8216;no  claim certificates&#8217;, put up against him as\t defence  to<br \/>\ndeny  arbitration, were obtained under duress and  coercion.<br \/>\nThe  High Court went on to observe that from the perusal  of<br \/>\nthe   plaint  it  was  evident\tthat  submission   regarding<br \/>\nsignatures of the appellant having been obtained under undue<br \/>\ninfluence  and coercion, was not existing.  The\t High  Court<br \/>\nalso viewed that in the absence of any plea to that  effect,<br \/>\nit  had\t to  proceed  on  the  footing\tthat  the  plaintiff<br \/>\nvoluntarily  had executed those\t no-objection  certificates.<br \/>\nThe  High Court then took the view that since the  appellant<br \/>\nhad executed &#8216;no claim certificates&#8217;, the contract ceased to<br \/>\nexist and the arbitration clause also perished, since it was<br \/>\notherwise  provided in one of the clauses of  the  agreement<br \/>\nthat  after such satisfaction, the contractor would  not  be<br \/>\nentitled to make any claim whatsoever against the respondent<br \/>\nby  virtue  of\tits  arising  out  of  the  contract.\tThis<br \/>\naccording  to  the High Court implied that even a  claim  to<br \/>\nrefer the matter to the arbitration was barred.\n<\/p>\n<p>3.   We\t do not want to express any opinion on the  analysis<br \/>\nof the High Court since we have satisfied ourselves that the<br \/>\nHigh  Court misread the pleadings of the appellant.  A\tcopy<br \/>\nof  the plaint is annexed in the paper-book and it is  plain<br \/>\nwherefrom  that not only at one place but at more  than\t one<br \/>\nplace  the  appellant has asserted that he  signed  the\t so-<br \/>\ncalled\tno-objection certificates under undue influence\t and<br \/>\ncoercion.  If the fact asserted by the appellant was  proved<br \/>\nto  be\tcorrect then these no claim  certificates  were\t not<br \/>\nvalid  in law and everything which the High Court sought  to<br \/>\nclose becomes open, But if it is otherwise, it would perhaps<br \/>\nlead to the conclusion as arrived at by the High Court.\t  It<br \/>\nwould  therefore have to be seen as to who would decide\t the<br \/>\nquestion  of fact whether there was any undue  influence  or<br \/>\ncoercion exercised on the appellant when he signed those  no<br \/>\nclaim  certificates.  If it is referable to  the  arbitrator<br \/>\nthen the<br \/>\n<span class=\"hidden_text\">547<\/span><br \/>\narbitrator  is the sole judge.\tBut if it is not,  then\t the<br \/>\nmatter is to be decided by the trial court.  The view of the<br \/>\ntrial court in either situation is necessary.  Therefore, it<br \/>\nwould necessitate a remand to the trial court to settle\t the<br \/>\nquestion  about\t the undue influence and coercion  over\t the<br \/>\nappellant  and\twhether\t that would  vitiate  the  no  claim<br \/>\ncertificates  clearing the way for arbitration.\t If  on\t the<br \/>\nother  hand  it\t is held that no  such\tundue  influence  or<br \/>\ncoercion  was  exercised then the trial court  would  be  at<br \/>\nliberty\t to reject the application under Section 20  of\t the<br \/>\nArbitration   Act   for\t the  matter  would  then   be\t not<br \/>\narbitrament.   The appeal is allowed in terms remitting\t the<br \/>\nmatter\tto the trial court.
