No.7742\/2010-P\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n            Dated this the 10th day of June, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The   writ  petition  was  dismissed  as  withdrawn  on<\/p>\n<p>08\/06\/2010.  The matter was reposted on the request made by<\/p>\n<p>the learned counsel appearing for the third respondent.<\/p>\n<p>Therefore, after  hearing  the  parties,  the  Judgment  is<\/p>\n<p>recalled.\n<\/p>\n<p>    2.   The learned counsel for the petitioner submitted<\/p>\n<p>that Ext.P8 order passed by the learned Ombudsman was<\/p>\n<p>stayed by this Court as per interim order dated 10\/03\/2010<\/p>\n<p>and,  during  the  pendency  of   the  interim  order,  the<\/p>\n<p>maintenance work in respect of Pangode-Vennikkulam Harijan<\/p>\n<p>Colony road has already been completed.   This was reported<\/p>\n<p>to the learned Ombudsman and a complaint pending before the<\/p>\n<p>said authority has already been closed leaving open the<\/p>\n<p>remedy of the third respondent to agitate the matter in<\/p>\n<p>accordance with law.   It is therefore submitted that since<\/p>\n<p>the entire work is over and as the impugned order has<\/p>\n<p>worked  out,  the   petitioner  is   withdrawing the   writ<\/p>\n<p>petition.\n<\/p>\n<p>    3.   The  learned  counsel  for  the  third  respondent<\/p>\n<p>submitted that the withdrawal of the writ petition may not<\/p>\n<p>W.P.(C). No.7742\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>stand in the way of the third respondent moving appropriate<\/p>\n<p>authorities.       It is clarified that the dismissal of the<\/p>\n<p>writ petition will be without prejudice to the right of the<\/p>\n<p>third respondent to agitate any matter as permissible under<\/p>\n<p>law.
