Respondents\n\n        This Writ Petition is filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the  Constitution  of\nIndia praying for the issuance of a writ of Mandamus directing the respondents\nto  absorb  the  services  of  the workers represented by the petitioner Union\nwhose names are found in the annexure to the writ petition on a regular  basis\nas  per  G.O.Ms.No.125,  Municipal  Administration and Water Supply Department \ndated 27.5.1999 with effect from 23.5.2006.\n                For petitioner :  Mr.D.Nagasaila\n                For respondents :  Mr.Mathi\n\nO R D E R \n<\/pre>\n<p id=\"p_1\">        The cause of the sixteen members of the petitioner-Union are  espoused<br \/>\nin  this  writ petition for a direction against the first respondent to absorb<br \/>\nthem on a regular basis as per  G.O.Ms.No.125,  Municipal  Administration  and<br \/>\nWater Supply Department dated 27.5.1999 with effect from 23.2.2006.\n<\/p>\n<p id=\"p_1\">        2.   The  case  of the petitioner-Union is that other 912 workers, who<br \/>\nare also situated similarly to that of the  sixteen  persons  whose  cause  is<br \/>\nbeing  espoused  by  the petitioner-Union, have been absorbed with effect from<br \/>\n23.2.2006.  However, the names of these sixteen persons, who are mentioned  in<br \/>\nthe annexure  to  the writ petition, have been left out.  It is also seen that<br \/>\nthe Zonal Office has recommended the names of these sixteen persons on various<br \/>\ndates to the respondent, namely, 13.12.2004, 23.2.2006 and 28.2.2006.  In view<br \/>\nof the same, the present writ petition has been filed for a direction.\n<\/p>\n<p id=\"p_2\">        3.  Heard M\/s.D.Nagasaila, learned  counsel  for  the  petitioner  and<br \/>\nMr.Mathi, who takes notice on behalf of the respondents.\n<\/p>\n<p id=\"p_3\">        4.   Considering  the  fact,  which  remains  final,  namely, that 912<br \/>\nworkers, who are similarly situated to that of the  sixteen  persons  who  are<br \/>\nmentioned  in  the  annexure  to  the  writ  petition,  have  been absorbed on<br \/>\n23.2.2006 and in the circumstance that the Zonal Office  has  recommended  the<br \/>\nnames  of  the  petitioners,  I  do not think that there is any reason for the<br \/>\nfirst respondent to deny the  same  to  the  petitioners  also,  if  they  are<br \/>\notherwise  entitled to it, for which course of action, the learned counsel for<br \/>\nthe respondents cannot have any objection.\n<\/p>\n<p id=\"p_4\">        6.  In view of the same, the respondents are directed to consider  the<br \/>\nnames  of  the  sixteen persons, who are mentioned in the annexure to the writ<br \/>\npetition, and absorb them in the regular vacancies as  per  G.    O.Ms.No.125,<br \/>\nMunicipal  Administration  and  Water  Supply  Department dated 27.5.1999 with<br \/>\neffect from the date of their eligibility, namely, 2 3.2.2006, provided  there<br \/>\nis no  legal  impediment  for the respondents to do so.  Such process shall be<br \/>\ncompleted within a period of four weeks from the date of receipt of a copy  of<br \/>\nthis order.\n<\/p>\n<p id=\"p_5\">        The writ petition is ordered accordingly.
