Justice S.S.SATHEESACHANDRAN\n\n Dated :14\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.7577   OF 2009\n           --------------------------\n     Dated this the 14th day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">        i)   Issue appropriate writ direction or<\/p>\n<p>order to quash Ext.P2 and P3 orders passed by the<\/p>\n<p>II Additional Munsiff Court, Thiruvananthapuram and<\/p>\n<p>Principal District Court, Thiruvananthapuram or on<\/p>\n<p>the  alternative   direct   the   District   Court,<\/p>\n<p>Thiruvananthapuram to hear and pass appropriate<\/p>\n<p>orders  de-novo  pending  disposal   of  the   writ<\/p>\n<p>petition.\n<\/p>\n<p id=\"p_3\">W.P.(C).No.7577 OF 2009      Page numbers<\/p>\n<p id=\"p_4\">          ii)     Grant such other relief that are<\/p>\n<p>deemed fit and proper in the circumstances of the<\/p>\n<p>case.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">          2.    Petitioner    is the plaintiff in O.S<\/p>\n<p>No. 279 of 2008 on the file of the II Additional<\/p>\n<p>Munsiff Court, Thiruvananthapuram.         Suit is for<\/p>\n<p>specific performance of an oral agreement of sale<\/p>\n<p>and the respondent is the defendant.       In the above<\/p>\n<p>suit    the    respondent    \/    defendant   moved   an<\/p>\n<p>application    for    interim  injunction   which  after<\/p>\n<p>hearing both sides was allowed by the learned<\/p>\n<p>Munsiff.       Petitioner   challenged   that  order  by<\/p>\n<p>preferring an appeal before the District Court, but<\/p>\n<p>the order of the learned Munsiff was confirmed<\/p>\n<p>dismissing the appeal.        Impeaching the propriety<\/p>\n<p>and correctness of the judgment rendered by the<\/p>\n<p>appellate court the writ petition has been filed<\/p>\n<p>seeking the aforementioned reliefs invoking the<\/p>\n<p>W.P.(C).No.7577 OF 2009     Page numbers<\/p>\n<p>supervisory jurisdiction vested with this court<\/p>\n<p>under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India.<\/p>\n<p id=\"p_7\">          3.    I heard the learned counsel for the<\/p>\n<p>petitioner.     Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented     with    reference   to   Ext.P3  judgment<\/p>\n<p>impugned in the petition, I find no notice to the<\/p>\n<p>respondent is necessary and it is dispensed with.<\/p>\n<p>The learned counsel for the petitioner submits that<\/p>\n<p>some observations in Ext.P3 judgment rendered by<\/p>\n<p>the learned Munsiff are likely to cause prejudice<\/p>\n<p>to the petitioner, and it may influence the mind of<\/p>\n<p>the trial judge while disposing the suit on merit,<\/p>\n<p>I find no reason for such an apprehension because<\/p>\n<p>the observations or opinions expressed in orders in<\/p>\n<p>interlocutory proceedings in a suit will not have<\/p>\n<p>any reflection in the final disposal of the suit,<\/p>\n<p>which has to be done on the      basis of the materials<\/p>\n<p>W.P.(C).No.7577 OF 2009     Page numbers<\/p>\n<p>to be tendered in the case.      However, to alley the<\/p>\n<p>apprehension expressed by the learned counsel for<\/p>\n<p>the petitioner,       I direct the learned Munsiff to<\/p>\n<p>dispose    the   suit   untrammelled    by any  of   the<\/p>\n<p>observations     in   his  order   or   Ext.P3  judgment<\/p>\n<p>rendered by the learned District Judge.
