Amas, District- Gaya\n                                                       Versus\n                                              The State Of Bihar\n                                          ----------------------------------\n<\/pre>\n<p id=\"p_1\">3   24.10.2011                  Heard learned counsel for the petitioners and learned<\/p>\n<p>                      counsel for the State.\n<\/p>\n<p id=\"p_1\">                                The petitioners are apprehending their arrest in connection<\/p>\n<p>                      with Amas P.S. Case No. 86 of 2011 for the offence punishable under<\/p>\n<p>                      <a href=\"\/doc\/162506\/\" id=\"a_1\">Sections 447<\/a>, <a href=\"\/doc\/1599401\/\" id=\"a_1\">341<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a> of the Indian Penal Code and <a href=\"\/doc\/42436223\/\" id=\"a_4\">Sections<\/p>\n<p>                      3(X)(XI)<\/a> of the Scheduled Castes and <a href=\"\/doc\/25085007\/\" id=\"a_5\">Scheduled Tribes (Prevention<\/p>\n<p>                      of Atrocities) Act<\/a> (hereinafter referred to as the &#8216;Act&#8217;).<\/p>\n<p id=\"p_2\">                                The allegation against the petitioners is of assaulting the<\/p>\n<p>                      lady members of the family of the first informant at night. It is further<\/p>\n<p>                      alleged that on the following day when the first informant went to the<\/p>\n<p>                      house of the petitioners to question their misdeeds, the petitioners<\/p>\n<p>                      assaulted them and called them by their caste name and thus causing<\/p>\n<p>                      insult to them punishable under the provisions of the Act.<\/p>\n<p id=\"p_3\">                                Learned counsel for the petitioners while denying the<\/p>\n<p>                      allegations with reference to the provisions of <a href=\"\/doc\/42436223\/\" id=\"a_6\">Section 3(X)(XI)<\/a> of the<\/p>\n<p>                      Act, submits that the provisions thereunder in no uncertain terms<\/p>\n<p>                      mandates the insult to be made in full public view. It is contended<\/p>\n<p>                      that nodoubt the provisions of <a href=\"\/doc\/1233094\/\" id=\"a_7\">Section 438<\/a> of the Code of Criminal<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                2<\/span><\/p>\n<p>          Procedure is not available to an accused under the Act but it is only in<\/p>\n<p>          circumstances where the allegations made out in the F.I.R. constitute<\/p>\n<p>          any offence under the provisions of the Act. He submits that a bare<\/p>\n<p>          perusal of the allegations as set out in the F.I.R. does not constitute<\/p>\n<p>          any offence punishable under the Act inasmuch as no details have<\/p>\n<p>          been given as to the public place or the persons before whom the<\/p>\n<p>          alleged insult had been made.
