Justice R.BASANT\n\n Dated :17\/09\/2007\n\n O R D E R\n                                R.BASANT, J\n                         ------------------------------------\n                         B.A.No. 5440 of 2007\n                        -------------------------------------\n             Dated this the 17th day of September, 2007\n\n                                     ORDER\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail.           The petitioner, an Advocate,<\/p>\n<p>faces allegations for offences punishable, inter alia, under <a href=\"\/doc\/1466184\/\" id=\"a_1\">Sections 471<\/a><\/p>\n<p>and <a href=\"\/doc\/1436241\/\" id=\"a_1\">420<\/a> I.P.C.\n<\/p>\n<p id=\"p_1\">      2.    The petitioner had allegedly purchased a vehicle, which<\/p>\n<p>stood in the name of one Ravindran as per the registration certificate,<\/p>\n<p>from one Jobin. He had paid the amount due to the said Jobin. After<\/p>\n<p>getting the relevant documents from the said Jobin, he had submitted<\/p>\n<p>the registration certificate along with the requisite applications to<\/p>\n<p>transfer the vehicle to his name. At the office of the Motor Vehicles<\/p>\n<p>Department, it was realised that there was some fraud in respect of<\/p>\n<p>the registration certificate.      The authority complained to the local<\/p>\n<p>police. Crime has been registered. Investigation is in progress. The<\/p>\n<p>petitioner apprehends imminent arrest.\n<\/p>\n<p id=\"p_2\">      3.    The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. The petitioner had no knowledge of<\/p>\n<p>the alleged fraud in respect of the registration certificate. If he had<\/p>\n<p>known of such fraud, it is improbable &#8211; nay impossible, that the<\/p>\n<p>petitioner, an Advocate, would have chosen to get the vehicle<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No. 5440 of 2007                2<\/span><\/p>\n<p>transferred to his name.      This must convey to the Court that the<\/p>\n<p>petitioner is himself an innocent victim of the fraud played by some<\/p>\n<p>other person. The petitioner is not now able to specify whether his<\/p>\n<p>transferee Jobin or the registered owner Ravindran or any other<\/p>\n<p>person is really responsible for the commission of the offence. The<\/p>\n<p>petitioner only submits that the petitioner is absolutely innocent. The<\/p>\n<p>petitioner shall co-operate with the investigator to ascertain the truth.<\/p>\n<p>The learned counsel for the petitioner submits that another person,<\/p>\n<p>who purchased a vehicle from the said Jobin does find himself also in a<\/p>\n<p>similar situation as the vehicle sold to such person by the said Jobin is<\/p>\n<p>also found to be not having a proper registration certificate.      That<\/p>\n<p>registration certificate also has the same engine and chasis numbers,<\/p>\n<p>submits the learned counsel. The learned counsel for the petitioner<\/p>\n<p>submits that the petitioner shall co-operate with the investigator in<\/p>\n<p>every possible manner, but the petitioner may be saved of the<\/p>\n<p>undeserved trauma of arrest and detention in custody.<\/p>\n<p id=\"p_3\">      4.    The learned Public Prosecutor        does not oppose the<\/p>\n<p>application.   The learned Public Prosecutor     only submits that the<\/p>\n<p>contumacious and culpable role if any of the petitioner has got to be<\/p>\n<p>further probed into in detail. The prosecution has no objection in grant<\/p>\n<p>of anticipatory bail to the petitioner. But the same may be done only<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No. 5440 of 2007                  3<\/span><\/p>\n<p>subject to appropriate conditions which shall ensure the interests of a<\/p>\n<p>fair, efficient and expeditious investigation.     I am satisfied that the<\/p>\n<p>petitioner can be granted anticipatory bail.         In the circumstances<\/p>\n<p>explained above, it is not necessary to advert to facts in any greater<\/p>\n<p>detail.\n<\/p>\n<p id=\"p_4\">      5.     In the result, the Bail Application is, allowed. The following<\/p>\n<p>directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section 438<\/a> Cr.P.C.<\/p>\n<p id=\"p_5\">      i)     The petitioner shall appear before the learned Magistrate at<\/p>\n<p>11 a.m on 24.09.2007. He shall be enlarged on regular bail on his<\/p>\n<p>executing a bond for Rs.50,000\/- (Rupees Fifty thousand only) with<\/p>\n<p>two solvent sureties each for the like sum to the satisfaction of the<\/p>\n<p>learned Magistrate;\n<\/p>\n<p id=\"p_6\">      ii)    The petitioner shall make himself available for interrogation<\/p>\n<p>before the Investigating Officer between 10 a.m and 3 p.m on<\/p>\n<p>25.09.2007 and 26.09.2007 and thereafter between 10 a.m and 12<\/p>\n<p>noon on all Mondays and Fridays for a period of one month.<\/p>\n<p>Subsequently     the   petitioner   shall  make     himself  available  for<\/p>\n<p>interrogation before the Investigating Officer as and when directed by<\/p>\n<p>the Investigating Officer in writing to do so;\n<\/p>\n<p id=\"p_7\">      iii)   If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">B.A.No. 5440 of 2007               4<\/span><\/p>\n<p>thereafter stand revoked and the police shall be at liberty to arrest the<\/p>\n<p>petitioner and deal with him in accordance with law as if those<\/p>\n<p>directions were not issued at all;\n<\/p>\n<p id=\"p_8\">      iv)  If the petitioner were arrested prior to his surrender on<\/p>\n<p>24.09.07 as directed in clause (1) above, he shall be released from<\/p>\n<p>custody on his executing a bond for Rs.50,000\/- (Rupees Fifty<\/p>\n<p>thousand only) without any sureties undertaking to appear before the<\/p>\n<p>learned Magistrate on 24.09.07.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                                 (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Adv.Joseph Prakash vs State Of Kerala on 17 September, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 5440 of 2007(A) 1.
