Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :28\/10\/2008\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                   W.P(C).No.31591 OF 2008\n                  -------------------------------------------\n             Dated this the 28th day of October, 2008\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">     Heard learned counsel for the petitioner and learned<\/p>\n<p>counsel for the respondents.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">     The petitioner&#8217;s husband availed a loan from the first<\/p>\n<p>respondent on 20.3.1996 to start a medical shop. On account of<\/p>\n<p>default in repayment, the first respondent initiated proceedings<\/p>\n<p>under the Kerala Co-operative Societies Act, 1969, and that has<\/p>\n<p>become final. Presently, the amounts have accrued to around<\/p>\n<p>Rs.4,70,000\/-. The sale is listed on 30.10.2008. I do not find any<\/p>\n<p>jurisdictional error     or     legal     infirmity        in the impugned<\/p>\n<p>proceedings. The petitioner states that the shop room where the<\/p>\n<p>medical shop was housed was required for land acquisition in<\/p>\n<p>connection with widening of road and as of now, there is no<\/p>\n<p>activity going on there.         Obviously therefore, the petitioner<\/p>\n<p>cannot aspire to generate income from the shop and repay the<\/p>\n<p>outstandings.   As a last resort, the petitioner seeks to pay off<\/p>\n<p>WPC.31591\/08<\/p>\n<p>                           Page numbers<\/p>\n<p>the outstandings in instalments and to save the property from<\/p>\n<p>distress action.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      In the result, repelling all other contentions, this writ<\/p>\n<p>petition is ordered directing that if the petitioner deposits an<\/p>\n<p>amount of Rs.75,000\/- at or before the time fixed for sale on<\/p>\n<p>30.10.2008 and continues to remit amounts at the rate of Rupees<\/p>\n<p>One Lakh per month, payable on or before the last working day<\/p>\n<p>of every month commencing from November, 2008, the<\/p>\n<p>impugned distress action will be held back and later dropped on<\/p>\n<p>satisfaction of the recoveries.
