3;  l:]_3rief facts ,Q_f__the case are:<\/p>\n
  25.10.2006 when the claimant and<\/p>\n
 were travelling in T ractor~Trai1er No.KA-<\/p>\n
7\/;i’~.l13;_V and KA-03\/T-370 from Hiriyur to<\/p>\n
A  Agfrlosayalanadu Viilage on NB 4 near Kolikengannas<\/p>\n
l\ufb01farm a truck bearing registration N0.KA-21\/6967 came<\/p>\n

in a rash and negligent manner and dashed agaisnt the
\ntractor–trailer, as a result claimant sustained injuries.<\/p>\n
Hence, he \ufb01led a claim petition before MACT, Davarigere<\/p>\n
seeking compensation of <\/p>\n
Tribunal has awarded compensatiouef” <\/p>\n
with interest at 6% p.a.<\/p>\n
4. As there is no disputeiiregardingl.o_cctirrence of V<\/p>\n
accident, negligence” and _1i’abilit\u00a7-vi\/l”bf_pthe’lnsurer of the
\noffending vehicle the it  remains for<\/p>\n

5. _ _ After  learned Counsel appearing for<\/p>\n
 V’  ,  parties  perusing the judgment and award of the<\/p>\n
  of the view that the compensation<\/p>\n
 the Tribunal is not just and reasonable, it<\/p>\n
 A is o’n_:t_he lower side and therefore it is deserved to be<\/p>\n

l 6. The claimant has sustained the following injuries:<\/p>\n

i) Fracture of 2%, 3″‘. 4th and 5″! metatarsais
\non left side;\n<\/p>\n
ii) Lacerated wound over right knee;<\/p>\n
iii) Closed head injury with contusion”‘of\u00ablbx’rainit <\/p>\n
Injuries sustained by him are evidenti—-fro’ml’f:wound–\u00ab.. <\/p>\n

PWS 7 and 6 respectively.   Fiidiscloses
\nthat the claimant V   Bapuji Hospital.

0 .\u00bbldone.._>”Cn”‘O2.11.2006 he was discharged from the<\/p>\n
 16.08.2008 claimant had gone for<\/p>\n
assessment of permanent\/ partial physical impairment.<\/p>\n
 .Vip5’i’t”A_\u00abthat time he complained of pain on weight bearing<\/p>\n
 over left foot, limitation of motion in the left foot,<\/p>\n
limitation of motion of right knee. Mild 0 to 110 degree
\n%,_<\/p>\n
\ufb02exion. X ~ray was taken which shows old fracture
\n2″”. 3″, 41″ and 5*” metatarsal bones with malunion and<\/p>\n
evident of secondary Osteoarthritiis seen inirtarso<\/p>\n
metatarsal ‘joints on left side. He <\/p>\n
permanent physical disability.<\/p>\n
7. Considering the nature  <\/p>\n
awarded by the Tribuna} towards   its-uuffering <\/p>\n
on the lower side aridit  to be”‘e11*hanced by
\nanother sum of  Rs.30,000\/~<\/p>\n
under this  <\/p>\n
8. ”  medical bills for
\nRs. 1V’:?,6:=30\/4 tanjajtiaecrfibu\ufb01ai has awarded Rs.22,500\/–
\ntowards’rnedicallllaridliiieidental expenses which is not<\/p>\n
  If 1._7_,t550\/– is deducted towards medical<\/p>\n
‘ Vllbiilg;._$511lvy.l:Rs.4i,85O\/- remains for incidental expenses<\/p>\n
llwlhich is’j_ on the lower side. Considering nature of<\/p>\n
injuriles and duration of treatment I award Rs.15,000\/~~<\/p>\n
” towards incidental charges.<\/p>\n
9. The claimant was a student and he was looked<\/p>\n
after by his parents leaving their regular work for 67<\/p>\n
$3.\n<\/p>\n

days. Therefore it is just and proper to award
\nRs.10,000\/– towards loss of income of the parents<\/p>\n
during treatment period and 1 award the same. <\/p>\n
10. Considering the disability stated  <\/p>\n
10% and an amount of discomfort and  he it ‘<\/p>\n
has to undergo in his future   loss <\/p>\n
