Sen.\n<\/p>\n<p id=\"p_2\">02.09. 2009        Heard the learned counsel for the petitioner and the<br \/>\nlearned counsel for the respondents.\n<\/p>\n<p id=\"p_3\">                   The petitioner in this writ petition has prayed for<br \/>\ndirection upon the respondents to reinstate them in service on the ground<br \/>\nof being displaced from their land and they are land losers.\n<\/p>\n<p id=\"p_4\">                   From the rival submissions, it appears that after<br \/>\nacknowledging the petitioners of being owners of the land which was<br \/>\nacquired by CCL and in pursuance of the scheme for payment of<br \/>\ncompensation, petitioners were given employment under the respondents,<br \/>\nbut later, a dispute arose regarding their claim of their being owners of the<br \/>\nland and they were terminated from service by the respondent CCL.<br \/>\nAgainst the order of terminations, the petitioners had filed writ petition<br \/>\nbefore this Court in CWJC No. 1980 of 1999R which was disposed of by<br \/>\norder dated 8.2.2000 with direction to the respondents to consider the<br \/>\npetitioners&#8217; claim and pass a reasoned order. Upon consideration, when<br \/>\nthe respondents rejected petitioner&#8217;s claim, another writ petition No. 1814<br \/>\nof 2000 was filed by the petitioners.\n<\/p>\n<p id=\"p_5\">                   After considering the rival submissions, this court<br \/>\ndisposed of the writ petition directing the petitioners to approach the civil<br \/>\ncourt for obtaining a declaration of their right over the disputed land.\n<\/p>\n<p id=\"p_6\">                   In compliance of the order, the petitioner filed a title<br \/>\nsuit before the Sub Judge 1, Ranchi in which the respondent CCL and the<br \/>\nState Government were impleaded as defendants. The suit was decreed by<br \/>\nthe Sub Judge by judgment and order dated 17.11.2003 in which the right<br \/>\ntitle and interest of the petitioners over the disputed land was declared.<br \/>\nBeing armed with such decree in their favour, the petitioners, again<br \/>\n approached the respondent CCL claiming their reinstatement in service,<br \/>\nbut no order has been passed despite repeated representations and notice<br \/>\nserved upon the authorities and hence the present writ petition.\n<\/p>\n<p id=\"p_7\">                   Mr. Ananda Sen, learned counsel for the respondents<br \/>\ninforms that against the judgment and decree passed in the title suit, the<br \/>\nState Government had filed an appeal before the appellate authority and<br \/>\nthe same is pending.\n<\/p>\n<p id=\"p_8\">                   Sri Rajiv Ranjan, learned counsel for the petitioner,<br \/>\nhowever informs that as per information received, the appeal preferred by<br \/>\nthe State Government has been dismissed, though for default. Learned<br \/>\ncounsel has produced a copy of the order.           Learned counsel for the<br \/>\nrespondents CCL is not able to inform as to whether any further step was<br \/>\ntaken on behalf of the State Government after dismissal of the Title Appeal<br \/>\nNo.43 of 2004 by order passed on 1.2.2006 by the learned appellate court<br \/>\nbelow.\n<\/p>\n<p id=\"p_9\">                   In the light of the above facts, inference which may<br \/>\nreasonably be drawn is that the right and title of the petitioner over the<br \/>\ndisputed land has been declared by the court below and such declaration<br \/>\nas on today, has not been overruled or set aside.\n<\/p>\n<p id=\"p_10\">                   Considering the above facts and circumstances, the<br \/>\nconcerned authorities of the respondents are directed to consider the claim<br \/>\nof petitioners and take an appropriate decision by passing a reasoned and<br \/>\nspeaking order and communicate such decision effectively to the petitioner<br \/>\nwithin two months from the date of receipt\/production of a copy of this<br \/>\norder.\n<\/p>\n<p id=\"p_11\">                   With the above observations, this application is<br \/>\ndisposed of.
