3.   Appellant has filed this appeal against the judgment and<\/p>\n
order dated 23.02.2006 passed by a Division Bench of the<\/p>\n
High Court of Judicature of Bombay, Bench at Aurangabad in<\/p>\n
Criminal Appeal No.649\/2004 confirming the conviction and
\n                              2<\/span><\/p>\n
sentence of imprisonment for life in respect of an offence<\/p>\n
punishable under Section 302<\/a> of the Indian Penal Code [for<\/p>\n
short `IPC<\/a>‘] and a fine of Rs.500\/- with a default stipulation of<\/p>\n
imprisonment    for   six months    awarded      by the   learned<\/p>\n
Additional   Sessions   Judge,    Amalner   on    29.09.2004   in<\/p>\n
Sessions Case No.28\/2000.\n<\/p>\n
\n
4.   Brief facts, which led to the trial of the appellant, are as<\/p>\n
     follows:\n<\/p>\n
     Kallu @ Kalyan Atmaram Patil, appellant herein, along<\/p>\n
with 16 others were tried for the offences of rioting, murder of<\/p>\n
Shivaji Patil and causing grievous hurt to PW-12 Deepak on<\/p>\n
31.12.1999 at about 7.47 p.m. The prosecution case was that<\/p>\n
on the day of the incident at village Mhasave one Vimalbai<\/p>\n
Patil was elected as a Sarpanch of the village. PW-12 Deepak<\/p>\n
Patil and his father Shivaji Patil were the supporters of<\/p>\n
Vishwas Pahelwan, whereas the appellant and other accused<\/p>\n
persons supported Vimalbai Patil.      The prosecution alleged<\/p>\n
that the appellant along with 20 to 25 more persons armed
\n                              3<\/span><\/p>\n
with sticks and wooden rods proceeded towards the house of<\/p>\n
PW-12 Deepak. They asked PW-12 as to why he canvassed for<\/p>\n
the group of Vishwas Pahelwan in the Gram Panchayat<\/p>\n
Election. The accused persons allegedly inflicted sticks blows<\/p>\n
on the head and forehead of PW-12 Deepak and also gave<\/p>\n
beating to Shivaji Patil, who was standing on the platform of<\/p>\n
his house. The appellant alleged to have given stick blow on<\/p>\n
the head of Shivaji Patil, who as a result thereof fell down and<\/p>\n
became unconscious.      PW-13 Vithoba and PW-14 Sukdeo<\/p>\n
were also assaulted by the accused. On seeing the co-villagers<\/p>\n
coming on the scene of occurrence, the accused persons went<\/p>\n
away.   Thereafter, PW-15 Arun Patil with the help of one<\/p>\n
Nimba and Vijay shifted PW-12 Deepak and his father Shivaji<\/p>\n
Patil to Cottage Hospital at Parola.        After the first-aid<\/p>\n
treatment, PW-12 lodged complaint [Ext. 152], on the basis of<\/p>\n
which First Information Report bearing Crime No.210\/1999<\/p>\n
came to be registered against 17 accused persons under<\/p>\n
Sections 307<\/a>, 143<\/a>, 147<\/a>, 148<\/a>, 149<\/a> and 452<\/a> of IPC with the<\/p>\n
Parola Police Station.   Shivaji Patil was shifted for medical<\/p>\n
treatment to Civil Hospital, Dhule.    On 01.01.2000, Shivaji
\n                                4<\/span><\/p>\n
Patil succumbed to the injuries.       On his death, the offence<\/p>\n
came to be converted to under Section 302<\/a> of IPC. In Civil<\/p>\n
Hospital at Dhule, Inquest panchnama [Ext. 118] came to be<\/p>\n
recorded in the presence of panch witness Vishwas Patil.<\/p>\n
5.   PW-23 Dr. Avinash Ruikar conducted autopsy on the<\/p>\n
     dead body of Shivaji Patil and noticed the following two<\/p>\n
     external injuries:-\n<\/p>\n
     “[i] C.L.W. on right front parietal region 8.5
\n          cm. x 1.4 cm. Scalp deep.\n<\/p>\n
     [ii] Abrasion on left arm medially upper 1\/3rd
\n          3.8 x 0.2 cm.”\n<\/p>\n
\nBoth the injuries were found ante mortem.             On internal<\/p>\n
examination, doctor noticed haemorrhage all over the skull.<\/p>\n
There was also a crack fracture of left parietal bone. As per<\/p>\n
the post mortem notes [Ext. 212], Dr. Avinash opined that the<\/p>\n
cause of death of the deceased Shivaji Patil was due to head<\/p>\n
injury.\n<\/p>\n
6.   PW-19    Jagatrao     Patil,   Police   Constable,   prepared<\/p>\n
     Panchnama [Ext. 171] of the clothes of the deceased.
\n                             5<\/span><\/p>\n
     Spot Panchnama [Ext. 116] was recorded in the presence<\/p>\n
     of PW-1 Hemant Patil. PW-22 P.I. Mahajan arrested the<\/p>\n
     accused persons on different dates.    At the instance of<\/p>\n
     the appellant, sticks were discovered which were seized<\/p>\n
     under Panchnama [Ext. 126].      The seized articles were<\/p>\n
     sent to the Chemical Analyser. On receipt of the reports<\/p>\n
     of chemical analysis [Exts. 200 and 211], charge sheet<\/p>\n
     was filed against the appellant and 16 other accused<\/p>\n
     persons in the Court of J.M.F.C. at Parola, who<\/p>\n
     committed the case to the Court of Additional Sessions<\/p>\n
     Judge at Amalner by order dated 31.03.2000.<\/p>\n
7.   The trial court found a prima facie case against the<\/p>\n
     appellant and other accused persons under Sections<\/p>\n
     143<\/a>, 147<\/a>, 148<\/a>, 452<\/a> and 302<\/a> read with Sections 149<\/a> and<\/p>\n
     324<\/a> read with Section 149<\/a> of IPC.        All the accused<\/p>\n
     pleaded not guilty to the charges and claimed to be tried.<\/p>\n
     During trial of the case, the prosecution examined as<\/p>\n
     many as 23 witnesses.       The accused persons in their<\/p>\n
     statements recorded under Section 313<\/a> of the Criminal
\n                                6<\/span><\/p>\n
     Procedure Code<\/a> pleaded that Pankaj Suryabhan Patil<\/p>\n
     (accused No.7) was elected as Deputy Sarpanch, so the<\/p>\n
     prosecution witnesses belonging to opposite group were<\/p>\n
     annoyed and they had assaulted Suresh Suka, father of<\/p>\n
     Ananda Suresh Patil (accused no. 1). The said incident<\/p>\n
     was reported to the Police and crime was registered<\/p>\n
     against prosecution witnesses and because of political<\/p>\n
     rivalry, the accused have been falsely implicated in the<\/p>\n
     case.\n<\/p>\n
8.   The learned trial Judge, on analysis of the entire oral and<\/p>\n
     documentary evidence on record, held the appellant and<\/p>\n
     five other accused persons guilty under Sections 148<\/a>,<\/p>\n
     302<\/a>, 325<\/a> read with Section 149<\/a> of IPC. They have been<\/p>\n
     acquitted for the offences under Sections 452<\/a>, 504<\/a> read<\/p>\n
     with Section 149<\/a> of IPC.         Other accused have been<\/p>\n
     acquitted for all the charges.\n<\/p>\n
9.   Being   aggrieved,   the   appellant   and   other   accused<\/p>\n
     persons filed three separate sets of appeals before the<\/p>\n
     High Court.\n<\/p>\n
                              7<\/span><\/p>\n
\n
10.   The High Court acquitted the other accused for offence<\/p>\n
      under Sections 148<\/a> and 302<\/a> read with Section 149<\/a> of IPC<\/p>\n
      and convicted them for lesser offences.   Criminal Appeal<\/p>\n
      No.649 of 2004 filed by the appellant was partly allowed<\/p>\n
      to the extent that his conviction under Sections 148<\/a>, 325<\/a><\/p>\n
      read with Section 149<\/a> of IPC and Section 302<\/a> read with<\/p>\n
      Section 149<\/a> of IPC is set aside and instead he is<\/p>\n
      convicted under Section 302<\/a> IPC for murder of Shivaji<\/p>\n
      Patil and aforesaid sentence has been imposed upon<\/p>\n
      him.\n<\/p>\n
11.   Hence, the appellant has filed this appeal by special<\/p>\n
      leave questioning the correctness and legality of the<\/p>\n
      judgment of the High Court.\n<\/p>\n
12.   This   Court   on   21.01.2008   issued   notice   to   the<\/p>\n
      respondent-State limited to the question of sentence.<\/p>\n
13.   We have heard Mr. Naresh Kumar, Advocate for the<\/p>\n
      appellant, and Mr. Ravindra Keshavrao Adsure, Advocate<\/p>\n
      for the respondent-State and with their assistance<\/p>\n
      examined the material on record.\n<\/p>\n
                                 8<\/span><\/p>\n

14.     On scrutiny of the oral evidence of PW-12 Deepak, it<\/p>\n
stands proved that the appellant has inflicted single stick blow<\/p>\n
on the head of Shivaji Patil which proved to be fatal.             The<\/p>\n
second injury found on the person of the deceased by Dr.<\/p>\n
Avinash was in the nature of abrasion on left arm. The other<\/p>\n
eyewitnesses   including   the       injured   witnesses    have   not<\/p>\n
supported the prosecution case.           The evidence of PW-12<\/p>\n
Deepak is not sufficient to establish that the appellant<\/p>\n
inflicted fatal injury on the head of the deceased with an<\/p>\n
intention to cause his death or with a knowledge that the<\/p>\n
injury so inflicted shall cause the death of the deceased in the<\/p>\n
ordinary course of nature. It is also found from the evidence<\/p>\n
of PW-12 that no other injury was caused by the appellant to<\/p>\n
the deceased after he became unconscious.                  The ocular<\/p>\n
evidence of PW-12 Deepak corroborated by the medical<\/p>\n
evidence, in our opinion, would prove that the offence<\/p>\n
committed by the appellant fell under Section 304<\/a> Part-I of<\/p>\n
IPC and not under Section 302<\/a> of IPC.              We, accordingly,<\/p>\n
convict the appellant under Section 304 Part-I, IPC<\/a>, for<\/p>\n
causing the death of Shivaji Patil and sentence him to suffer
\n                                9<\/span><\/p>\n
rigorous imprisonment for ten years and to pay a fine of<\/p>\n
Rs.500\/-.   In default of payment of fine, the appellant shall<\/p>\n
undergo simple imprisonment for one month.<\/p>\n
15.   In the result, for the afore-said reasons, this appeal is<\/p>\n
partly allowed to the extent of holding the appellant guilty of<\/p>\n
the offence punishable under Section 304 Part-I, IPC<\/a>, and<\/p>\n
imposing the aforesaid sentence upon him. The judgment and<\/p>\n
order of the High Court confirming the conviction of the<\/p>\n
appellant under Section 302<\/a>, IPC<\/a>, and sentencing him to<\/p>\n
undergo imprisonment for life shall stand modified to the<\/p>\n
extent indicated hereinabove.\n<\/p>\n
