Mr. Vinay Kumar, Advocate as well as learned<\/p>\n<p>                      counsel for the Advocate&#8217;s Clerk Surendra Prasad Singh and learned<\/p>\n<p>                      counsel for the deponent Nawal Kishore Kumar are present in court.<\/p>\n<p id=\"p_4\">                                    3. From subsequent development it transpires that in<\/p>\n<p>                      view of orders dated 06.07.2011 and 27.07.2011 an F.I.R. bearing<\/p>\n<p>                      Kotwali P.S. Case No.403 of 2011 has been lodged on 09.08.2011<\/p>\n<p>                      against Durga @ Rahul @ Durgesh Sharma (petitioner), Chandi Lal @<\/p>\n<p>                      Ranjan Kumar (petitioner), Nawal Kishore Kumar (deponent of the<\/p>\n<p>                      bail petition), Surendra Prasad Singh @ Salendra Prasad (Advocate&#8217;s<\/p>\n<p>                      Clerk), Mr. Vinay Kumar (Advocate) and other unnamed persons for<\/p>\n<p>                      offences punishable under <a href=\"\/doc\/1436241\/\" id=\"a_1\">sections 420<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_1\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_2\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_3\">471<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_4\">120B<\/a> of the<\/p>\n<p>                      Indian Penal Code.\n<\/p>\n<p id=\"p_5\">                                    4. From a perusal of the said F.I.R. it transpires that the<\/p>\n<p>                      Deputy Superintendent of Police (Law &amp; Order), Patna who was<\/p>\n<p>                      earlier investigating the matter has been made Supervising Officer,<\/p>\n<p>                      whereas Sub-Inspector of Police of Patlipura Station has been made<\/p>\n<p>                      the Investigating Officer of the case as per the directions of the<\/p>\n<p>                      Superintendent of Police, Patna. It has been done so as the original<\/p>\n<p>                      case was lodged in Patliputra Police Station. It further transpires and<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                        -2-<\/span><\/p>\n<p>that too very strangely that in the said F.I.R. no statement of the person<\/p>\n<p>lodging F.I.R. had been given and only High Court&#8217;s orders dated<\/p>\n<p>06.07.2011 and 27.07.2011 were attached to the proforma of the F.I.R.<\/p>\n<p>and the Assistant Registrar of the High Court had been named in the<\/p>\n<p>F.I.R. as informant.\n<\/p>\n<p id=\"p_6\">               5. From order dated 06.07.2011 it is quite apparent that<\/p>\n<p>the then Investigating Officer had sought permission of this court to<\/p>\n<p>file an F.I.R. for initiating a proceeding against the persons who were<\/p>\n<p>within the ambit of suspicion and the said permission was granted to<\/p>\n<p>the then Investigating Officer with a liberty to include other persons<\/p>\n<p>also if they were found to be involved. In the said circumstances, the<\/p>\n<p>F.I.R. should have been lodged by the Investigating Officer himself as<\/p>\n<p>per the directions of this court making specific statements in that<\/p>\n<p>regard and there was no occasion for naming the Assistant Registrar of<\/p>\n<p>the High Court as the informant as he had only communicated the<\/p>\n<p>orders of this court to the said authority, nor there was any occasion<\/p>\n<p>for annexing the orders of this court as part of the F.I.R. This appears<\/p>\n<p>to be a gross violation of the specific order\/direction of this court apart<\/p>\n<p>from being illegal and perverse. In the said circumstances, the<\/p>\n<p>Superintendent of Police, Patna and the Deputy Superintendent of<\/p>\n<p>Police named above are directed to make corrections in that regard and<\/p>\n<p>submit a report in this regard before this court within two weeks.<\/p>\n<p id=\"p_7\">               6. Only thereafter letter dated 14.10.2011 sent by the<\/p>\n<p>Deputy Superintendent of Police to the Registrar General, Patna High<\/p>\n<p>Court for copies of some documents shall be considered.<\/p>\n<p id=\"p_8\">               7. Put up both the cases on 16 th of November, 2011<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              -3-<\/span><\/p>\n<p>         under the same heading.\n<\/p>\n<p id=\"p_9\">                       8. Let a copy of this order be handed over to<\/p>\n<p>         Mr. S.A.
