C.\n\nHon'ble Shishir Kumar,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and learned Standing<br \/>\nCounsel.\n<\/p>\n<p>Petitioner is aggrieved by the order dated 29th April, 2010, by<br \/>\nwhich the petitioner&#8217;s appointment for the post of Aanganwari<br \/>\nKaryakatri has been terminated only on the ground that she has<br \/>\nsubmitted a forged certificate of Intermediate.\n<\/p>\n<p>It appears that on the basis of some complaint, the enquiry was<br \/>\nmade and it was found that the forged certificate showing that the<br \/>\npetitioner has passed 2nd division Intermediate has been placed<br \/>\nbefore the authority concerned an enquiry to that effect was made<br \/>\nand according to the respondents it was found that the forged<br \/>\ncertificate has been submitted showing that petitioner has passed<br \/>\nthe Intermediate Examination in second class though the petitioner<br \/>\nhas passed Intermediate examination in 3rd division. A show cause<br \/>\nnotice was given, to which the petitioner submitted her reply.<br \/>\nPetitioner has denied that she has not submitted any marksheet or<br \/>\ncertificate of Intermediate. In case some certificate is on record,<br \/>\nthat cannot be taken into consideration to have been submitted by<br \/>\nthe petitioner. According to the petitioner, without considering the<br \/>\nreply of the petitioner the order dated 29th April, 2010 has been<br \/>\npassed without assigning any reason and without discussing the<br \/>\nclaim of the petitioner. According to the petitioner, four lines order<br \/>\nhas been passed without assigning any reason, therefore, there is<br \/>\nclear presumption that authority at that time of passing the order<br \/>\nhas not applied its mind. It is settled in law that the Administrative<br \/>\nauthority while considering the claim of the person has to record<br \/>\nreasons, if no reason has been recorded it will be presumed that<br \/>\norder has been passed without application of mind.\n<\/p>\n<p>I have considered the submission of the petitioner and learned<br \/>\nStanding Counsel. Learned Standing Counsel is also not in a<br \/>\nposition to justify the reasonings given in the order impugned. In<br \/>\nsuch circumstances, I am of the opinion that without inviting<br \/>\ncounter and rejoinder affidavits, this writ petition can be decided<br \/>\n as ultimately result of counter and rejoinder affidavit will be the<br \/>\nsame.Therefore, with the consent of the parties the writ petition is<br \/>\ndisposed of finally.\n<\/p>\n<p>I have perused the order impugned and found that while passing<br \/>\nthe order, the respondent has not recorded any reason while<br \/>\ndismissing the claim of the petitioner. It is settled law, in view of<br \/>\nthe decision of Constitution Bench of the Apex Court, reported in<br \/>\nAIR 1990 S.C. 1984, S. N. Mukherji versus Union of India,<br \/>\nwhich held that the Administrative authorities are also bound to<br \/>\nrecord the reasons while passing an order. If no reason has been<br \/>\nrecorded it will be treated to be an order of non application of<br \/>\nmind. From the perusal of the order it appears that the four lines<br \/>\norder in a crepting manner has been passed, therefore, in my<br \/>\nopinion that the order impugned cannot be sustained as such is<br \/>\nhereby quashed.\n<\/p>\n<p>The writ petition is allowed and the order dated 29.04.2010<br \/>\nannexure-9 to the writ petition is hereby quashed and the matter is<br \/>\nremanded back to the respondent No. 3 to pass a reasoned order<br \/>\nafter according to law after giving full opportunity to the petitioner<br \/>\nwithin a period of two months from the date of production of a<br \/>\ncertified copy of this order.\n<\/p>\n<p>The writ petition is disposed of accordingly.\n<\/p>\n<p>No order as to costs.\n<\/p>\n<p>Order Date :- 4.8.2010<br \/>\nSazia\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Usha Devi vs State Of U.P.
