SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/05\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThe<br \/>\npresent application under <a href=\"\/doc\/100581\/\" id=\"a_1\">Section 5<\/a> of the Limitation Act has been<br \/>\npreferred by the applicants-original appellants to condone the delay<br \/>\nof 53 days in preferring the First Appeal challenging the judgment<br \/>\nand award dated 24\/11\/2009 passed by the learned Motor Accidents<br \/>\nClaim Tribunal (Auxiliary), City Civil Court No. 8, Ahmedabad in<br \/>\nM.A.C.P. No. 533\/2004 in so far as not awarding full claim as prayed<br \/>\nfor.\n<\/p>\n<p id=\"p_1\">2.\tShri<br \/>\nBhatia, learned advocate appearing on behalf of the applicants has<br \/>\nstated at the bar that opponent no. 2 is already served by direct<br \/>\nservice.\n<\/p>\n<p id=\"p_2\">3.\tThough<br \/>\nserved, nobody appears on behalf of opponent no. 1.\n<\/p>\n<p id=\"p_3\">4.\tHaving<br \/>\nheard Shri Bhatia, learned advocate appearing on behalf of the<br \/>\napplicants and Shri Acharya, learned advocate appearing on behalf of<br \/>\nopponent no. 3 and considering the averments made in the application<br \/>\nand so as to give one<br \/>\nadditional opportunity to the applicants to submit the case on merits<br \/>\nrather than non-suiting them on the technical ground of delay, the<br \/>\ndelay caused in preferring the First Appeal is hereby condoned and<br \/>\nthe present application is allowed.
