Justice M.C.HARI RANI\n\n Dated :28\/08\/2009\n\n O R D E R\n             R.BASANT &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                    Mat.Appeal No.45 of 2007\n                    ----------------------------------------\n             Dated this the 28th day of August 2009\n\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">Basant,J<\/p>\n<p>      The appellant is the mother-in-law of the claimant that is<\/p>\n<p>the 1st respondent. The 1st respondent filed an O.P claiming<\/p>\n<p>return of gold ornaments etc. from her husband\/the 2nd<\/p>\n<p>respondent herein and her mother-in-law, the appellant herein.<\/p>\n<p>In that O.P, both respondents, that is the husband and his<\/p>\n<p>mother were served. They entered appearance also. They did<\/p>\n<p>not participate in the proceedings and an ex parte decree was<\/p>\n<p>passed on 28\/02\/2001. That decree became final. Long later, in<\/p>\n<p>2005, when steps for execution was taken up, the appellant went<\/p>\n<p>before the Family Court and prayed that the ex parte order may<\/p>\n<p>be set aside after condoning the delay exceeding four years. The<\/p>\n<p>court below, on an evaluation of all the materials, came to the<\/p>\n<p>conclusion that there was inordinate delay exceeding four years<\/p>\n<p>in filing the application for condonation of delay.             In these<\/p>\n<p>circumstances, the court below dismissed the application for<\/p>\n<p>setting aside the ex parte order. Of course,the court below taken<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Mat.Appeal No.45\/07               2<\/span><\/p>\n<p>note of the fact that no separate application for condonation of<\/p>\n<p>delay has been filed.\n<\/p>\n<p id=\"p_1\">     2.     The learned counsel for the appellant submits that the<\/p>\n<p>appellant is a 78 year old woman. According to the learned<\/p>\n<p>counsel for the appellant, the delay in filing the appeal was not<\/p>\n<p>wilful or deliberate. Her son, the 1st respondent in the O.P will<\/p>\n<p>take necessary steps, it was assumed. He did not do the same<\/p>\n<p>and hence the delay occurred.\n<\/p>\n<p id=\"p_2\">     3.     We are not satisfied that there is any sufficient reason<\/p>\n<p>to justify the challenge against the impugned order. The petition<\/p>\n<p>was hopelessly belated and no valid reason was shown to justify<\/p>\n<p>the prayer for condonation of delay. Even on merits, we note<\/p>\n<p>that the appellant, who had entered appearance through counsel<\/p>\n<p>had no justifiable reasons to suggest as to why she did not<\/p>\n<p>continue to contest the proceedings. In any view of the matter,<\/p>\n<p>the Family Court cannot be said to have committed any error or<\/p>\n<p>impropriety in passing the impugned order.<\/p>\n<p id=\"p_3\">     4.     The learned counsel for the appellant submits that a<\/p>\n<p>lenient view may be taken and the appellant may be given a<\/p>\n<p>further opportunity. That prayer is stoutly opposed. But, in the<\/p>\n<p>course of discussions, the learned counsel for the respondent<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Mat.Appeal No.45\/07              3<\/span><\/p>\n<p>also accepts the suggestion which was also put to the parties by<\/p>\n<p>the Bench which dealt with the matter on 17\/7\/2007. If the<\/p>\n<p>entire decree amounts were deposited by the appellant, the<\/p>\n<p>claimant\/1st respondent shall not raise any objections against the<\/p>\n<p>setting aside of the ex parte order, it is submitted.<\/p>\n<p id=\"p_4\">      5.    We are, in these circumstances, satisfied that this<\/p>\n<p>appeal can be allowed subject to conditions as agreed by the<\/p>\n<p>learned counsel for the respondent. Though the appellant is not<\/p>\n<p>strictly entitled for such indulgence, we accept the stand taken<\/p>\n<p>by the parties and grant the appellant such a further<\/p>\n<p>opportunity.\n<\/p>\n<p id=\"p_5\">      6.    In the result,<\/p>\n<p id=\"p_6\">      a)    This appeal is allowed subject to conditions.<\/p>\n<p id=\"p_7\">      b)    The impugned order shall stand set aside on condition<\/p>\n<p>that the appellant deposits the entire amount due under the<\/p>\n<p>decree before the Family Court within a period of sixty days from<\/p>\n<p>this date.\n<\/p>\n<p id=\"p_8\">      c)    O.P.No.647\/98 shall be called before the Family Court<\/p>\n<p>on 29\/10\/2009. If the court below is satisfied that the above<\/p>\n<p>direction regarding deposit of the entire amount due under the<\/p>\n<p>decree till that date is complied with, the court below shall<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Mat.Appeal No.45\/07              4<\/span><\/p>\n<p>proceed to dispose of O.P.No.647\/98 afresh, in accordance with<\/p>\n<p>law, as expeditiously as possible &#8211; at any rate, within a period of<\/p>\n<p>four months from 29\/10\/2009. If the amount is not deposited,<\/p>\n<p>the Family Court shall make record of that fact on 29\/10\/2009<\/p>\n<p>and thereupon the impugned order shall continue to remain in<\/p>\n<p>force.\n<\/p>\n<p id=\"p_9\">      d)     If the amount is deposited by 28\/10\/2009 as directed,<\/p>\n<p>the court below shall retainn the same in a fixed deposit such<\/p>\n<p>that the principal amount along with interest accrued can be<\/p>\n<p>released to the successful party after fresh disposal of<\/p>\n<p>O.P.No.647\/98.\n<\/p>\n<p id=\"p_10\">      7.    There is no appearance for the 2nd respondent.
