NO.1038 OF 2005<br \/>\nIN<br \/>\nCRIMINAL APPEAL NO.1266 OF 1998<\/p>\n<p>\tIn our judgment and order dated 17.11.2005 this Court while allowing the<br \/>\nappeal preferred by the State also enhanced the punishment of the accused under<br \/>\n<a href=\"\/doc\/1279834\/\" id=\"a_1\">Section 376<\/a> IPC from five years RI to RI for life, after hearing the parties. By the<br \/>\nsaid judgment the order of the High Court acquitting the accused was set aside.<br \/>\n\tOn 22.11.2005 that is after the judgment was delivered by this Court, the<br \/>\nprosecutrix, namely, Smt. Seema, daughter of accused Asha Rams has filed the<br \/>\nfollowing affidavit :\n<\/p>\n<p id=\"p_1\">&#8221;\tI, Seema daughter of Sh. Assa Ram now married wife of<br \/>\nBhag Singh resident of Shimla Tailor Ward No.11 near Post Office<br \/>\nBalachaur Distt. Nawanshahar do hereby solemnly affirm and declare<br \/>\nas under :-\n<\/p>\n<p id=\"p_2\">1.\tThat I am the daughter of Sh. Assa Ram resident of village<br \/>\nChaklu teh.Ark Disst.Solan HP.\n<\/p>\n<p id=\"p_3\">Earlier residing at Sevant Quarter Raj Bhawan Shimla.\n<\/p>\n<p id=\"p_4\">2.\tThat there was a dispute between my parents and at that<br \/>\ntime I was minor and was residing with my mother alongwith my elder<br \/>\nsister namely Uma.  At that time I was minor aged 14 years and was<br \/>\nunder the influence of my mother Kalawati who was separately residing<br \/>\nfrom my father.\n<\/p>\n<p id=\"p_5\">3.\tThat as there was a matrimonial dispute between my mother<br \/>\nand father. My mother wanted to take revenge from my father and she<br \/>\ncompelled me to lodge a false case u\/s 376 of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> against my father.\n<\/p>\n<p id=\"p_6\">4.\tThat under the influence of my mother and also being minor<br \/>\nI did not know the consequence I lodge false FIR No.110 of 1988 u\/s<br \/>\n376 of <a href=\"\/doc\/1569253\/\" id=\"a_2\">IPC<\/a> at police station Chotta Shimla and accordingly my father<br \/>\nAssa Ram was arrested. I was also compelled by my mother under<br \/>\nwhose custody I was living and also the police to depose in the court<br \/>\nagainst my father that he committed rape upon me. Accordingly  I<br \/>\ndeposed in the trial court of Addl. Sessions Judge Shimla against my<br \/>\nfather.\n<\/p>\n<p id=\"p_7\">5.\tThat the police in-connivance with my mother fabricated<br \/>\nfalse case property i.e. Salwar and under wear which did not belongs to<br \/>\nme as my father never committed rape upon me.\n<\/p>\n<p id=\"p_8\">6.\tThat my father bears a good moral character and all this<br \/>\nunfortunate happened due to my mother.\n<\/p>\n<p id=\"p_9\">6.\tThat my father was innocent and he did not commit any rape<br \/>\nwith me and case was falsely lodged against him and I also deposed<br \/>\nagainst my father in the court of Addl. Sessions Judge Shimla at the<br \/>\ninstance of my mother and police. If I did not depose so at that time<br \/>\nagainst my father then my mother would have harmed me alongwith<br \/>\npolice.\n<\/p>\n<p id=\"p_10\">7.\tThat on the day of alleged occurrence I was not living with<br \/>\nmy father nor I came to my father&#8217;s house on that day, so the questions<br \/>\nof committing rape does not arise.\n<\/p>\n<p id=\"p_11\">\t\t\t\tSeema<br \/>\n\t\t\t\tDeponent&#8230;.\n<\/p>\n<p id=\"p_12\">Verification;\n<\/p>\n<p id=\"p_13\">\tI, the above named deponent further hereby solemn and<br \/>\naffirmation that the contents of paras no.1 to 7 of my above affidavit<br \/>\nare true and correct to the best of my knowledge and belief and<br \/>\nnothing has been kept concealed therein.\n<\/p>\n<p id=\"p_14\">Verified &amp; signed at\t\tSeema<br \/>\n\t\t\t        Deponent&#8230;\n<\/p>\n<p id=\"p_15\">Dated:-22 NOV 2005.&#8221;\n<\/p>\n<p id=\"p_16\">\tThe statement of prosecutrix was examined by the trial court, examined by this<br \/>\nCourt and accepted.  Before the trial court she gave a statement that  her father<br \/>\nraped her on the fateful day. Relying upon the statement and evidence on record the<br \/>\ntrial court convicted the father of the prosecutrix. It was re-examined and accepted<br \/>\nby this Court. This Court was of the view that the statement of the sprosecutrix<br \/>\ninspired confidence.\n<\/p>\n<p id=\"p_17\">\tIn our view,  the subsequent affidavit filed by the prosecutrix on 22.11.2005,<br \/>\nread thus,  on the face of it, appears to be false and afterthought aimed at to bail out<br \/>\nher father from undergoing life imprisonment. The said affidavit, in our view, is false<br \/>\nand it would have far reaching legal consequences.<br \/>\n\tIn view thereof, this review petition is dismissed. We further direct the Sessions<br \/>\nJudge, Shimla to take the affidavit dated 22.11.2005 filed by the prosecutrix into the<br \/>\nrecord and initiate a proceeding in accordance with the provisions contained in<a href=\"\/doc\/1569253\/\" id=\"a_3\"><br \/>\nChapter XI of the Indian Penal Code<\/a>. It is open to the Sessions Judge, Shimla to<br \/>\npass any appropriate order as may deem fit and proper in accordance with law.<br \/>\n\tWith the aforesaid direction, the review petition is dismissed.
