VENKATASWAMI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     These two\tCivil Appeals arise out of a common judgment<br \/>\nof the\tHigh Court dated 10.12.1986.  The controversy before<br \/>\nus is  limited and revolves around a patta of land measuring<br \/>\n28 acres and 82 cents, which is stated to be poramboke land.<br \/>\nThe respondents produced the said patta before the Reference<br \/>\ncourt in  the proceedings  under  <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section  18<\/a>  of  the\tLand<br \/>\nAcquisition Act\t for the first time.  The appellant issued a<br \/>\nnotice under  Section 14-A  of the  Andhra  Pradesh  (Andhra<br \/>\nArea) Inams  (Abolition and  conversion Into  Ryotwari) Act,<br \/>\n196 (hereinafter  the Inam  Abolition Act.   In that notice,<br \/>\ninter-alia,  it was stated that there was a prima-facie case<br \/>\nto suspect  that the  patta, in\t question, had been obtained<br \/>\nfradulently.  The notice went on to say :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;It is  therefore proposed\t to take<br \/>\n     up\t suomotu  enquiry  as  there  is<br \/>\n     genuineness of the patta alleged to<br \/>\n     have been issued in this case.&#8221;<\/p><\/blockquote>\n<p id=\"p_1\">     The  respondents\tfiled\tWrit   Petition\t  No.1225\/78<br \/>\nresisting the  claim of\t the Government\t that the area of 28<br \/>\nacres and  82 cents,  which was\t the subject  matter of\t the<br \/>\npatta, vested  in the Government by virtue of Section 2-A of<br \/>\nthe Inam  Abolition Act.  That Writ Petition was allowed and<br \/>\nit was\theld that  the notice  under Section 2-A of the Inam<br \/>\nAbolition Act,\tin the\tfacts of the case, was invalid.\t The<br \/>\nrespondents also  filed Writ  Petition No.1798\/85  seeking a<br \/>\ndirection to  the Govt.\t to initiate  proceedings under\t the<br \/>\n<a href=\"\/doc\/7832\/\" id=\"a_1\">Land Acquisition Act<\/a> in respect of the Patta land, measuring<br \/>\n28 acres  and 82  cents.   That Writ petition was allowed on<br \/>\n24.3.1986. Writ\t Appeal No.745\/86  was decided\tagainst that<br \/>\norder.\t  After\t notice\t under\tSection\t 14-A  of  the\tInam<br \/>\nAbolition Act was issued on 22.7.1986, the respondents filed<br \/>\nyet another  writ Petition  No.12044\/86, seeking quashing of<br \/>\nthat notice.   The  Writ  Appeal  filed\t by  the  Government<br \/>\n(W.A.No.745\/86)\t and   the  Writ   Petition  filed   by\t the<br \/>\nrespondents (W.P. 12044\/86) were heard together and disposed<br \/>\nof by  the common  judgment, against which these two appeals<br \/>\nhave been filed.\n<\/p>\n<p id=\"p_2\">     Before the Division Bench of the High Court, it appears<br \/>\nthe principle  contention that\twas convassed  was that\t the<br \/>\nRyotwari Patta,\t dated 3.10.1974,  in respect  of  the\tland<br \/>\nmeasuring 28  acres  and  82  cents,  was  a  fradulent\t and<br \/>\nspurious document.   It\t was asserted that no patta had ever<br \/>\nbeen granted  to the  respondents and that the same had been<br \/>\nmanipulated with  ulterior motives.   In  view of  the stand<br \/>\ntaken by  the appellant\t before\t the  High  Court,  and\t the<br \/>\ncounter stand  of the respondents, the Division Bench, after<br \/>\ntaking\tnote  of  the  provision  of  the  Act,\t issued\t the<br \/>\nfollowing directions :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;1) The  Government represented  by<br \/>\n     the  appropriate\tauthority  shall<br \/>\n     file a  suit  within  three  months<br \/>\n     from the  date of\treceipt of  this<br \/>\n     order under S.14 of the Act against<br \/>\n     the  petitioners\tchallenging  the<br \/>\n     genuineness of  the ryotwari  patta<br \/>\n     allegedly\t  granted     to     the<br \/>\n     petitioners on  3.10.1974,\t by  the<br \/>\n     Tahsildar, Narsipatnam  in\t respect<br \/>\n     of ac.28-82  cents of land in S.No.<br \/>\n     1, 5, 7, 8, 9, 12, 15, 18, 20, 22<br \/>\n     and  23  situated\tin  Gopalapatham<br \/>\n     village Visakhapatnam District.<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     2)\t The   petitioners  shall  prove<br \/>\n     their    claim\tregarding    the<br \/>\n     genuineness of  the  patta\t in  the<br \/>\n     aforementioned suit  directed to be<br \/>\n     filed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     3) Independent of the suit directed<br \/>\n     to be filed by the State Government<br \/>\n     as abovementioned,\t the petitioners<br \/>\n     shall also\t file  a  separate  suit<br \/>\n     against   the    Government   after<br \/>\n     complying\t with\t the   necessary<br \/>\n     formalities f  giving notice  etc.,<br \/>\n     claiming compensation  or damage in<br \/>\n     respect of\t ac.28-82 cents\t of land<br \/>\n     above  referred   and  &#8220;Veeraparaju<br \/>\n     Kathu&#8221;.   The suit\t should be filed<br \/>\n     within a  period of  4 months  from<br \/>\n     the date of receipt of this order.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>     4) The suit filed by the Government<br \/>\n     as\t well\tas  the\t petitioners  in<br \/>\n     accordance\t   with\t    the\t   above<br \/>\n     directions shall  be entertained by<br \/>\n     the court and both of them shall be<br \/>\n     tried  jointly.\tConsidering  the<br \/>\n     long-standing  claims   the   court<br \/>\n     should    make    every\tpossible<br \/>\n     endeavour to  dispose of  both  the<br \/>\n     suits  within   a\tperiod\tof  nine<br \/>\n     months from the date of institution<br \/>\n     of suits.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>     5)\t If   the  Civil  courts  should<br \/>\n     upheld  the   genuineness\tof   the<br \/>\n     patta, a  decree would be passed by<br \/>\n     the civil court granting damages or<br \/>\n     compensation as  may be  considered<br \/>\n     appropriate on such basis as may be<br \/>\n     found  reasonable\t by  the   civil<br \/>\n     court.<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     6) It is needless to state that the<br \/>\n     Government\t  as\twell   as    the<br \/>\n     petitioners  will\tbe  entitled  to<br \/>\n     seek further  remedies if\tthey are<br \/>\n     aggrieved\tby   the  judgment   and<br \/>\n     decree of the civil court.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">     Learned counsel  for the appellant submits that in view<br \/>\nof the\tprovision of  Section 14  of the Inam Abolition Act,<br \/>\nwhich bears  the  jurisdiction\tof  the\t civil\tcourts,\t the<br \/>\njudgment of  the High  Court, is  not sustainable. We cannot<br \/>\nagree.\n<\/p>\n<p id=\"p_4\">     A perusal\tof the\tnotice issued  under <a href=\"\/doc\/7832\/\" id=\"a_2\">Section 14-A<\/a> of<br \/>\nthe Act shows that the enquiry was proposed to determine the<br \/>\ngenuineness or\totherwise of  the patta\t relied upon  by the<br \/>\nrespondents.   It was, therefore, essentially the allegation<br \/>\nof the\tappellants that\t the ryotwari patta dated 3.10.1974,<br \/>\nwas a fradulent and spurious one, which had weighed with the<br \/>\nauthorities to\tissue <a href=\"\/doc\/7832\/\" id=\"a_3\">Section  14-A<\/a> notice  in the  terms in<br \/>\nwhich it  was done  in the  present case.   Considering\t the<br \/>\nlanguage of  that notice  and the facts and circumstances of<br \/>\nthis case, we find that the directions given by the Division<br \/>\nBench of the High Court (supra) do not suffer from any error<br \/>\nwhatsoever and\tcall for  no interference at our hands.\t The<br \/>\ndetermination of  the genuineness  of the patta in the civil<br \/>\ncourt, as directed by the Division Bench was a proper course<br \/>\nto be  adopted in  the peculiar\t facts and  circumstances of<br \/>\nthis case.   Section  14-A of  the Inam Abolition Act, which<br \/>\nban the\t jurisdiction of  the civil  court to  question\t the<br \/>\ndecision  of   the  Tehsildar,\tthe  Revenue  court  or\t the<br \/>\nCollector under\t the Act  itself, carves  out  an  exception<br \/>\n&#8220;where such decision is obtained by misrepresentation, fraud<br \/>\nor collusion  of parties&#8221;.  The directions given by the High<br \/>\nCourt (supra) are, therefore, justified by the provisions of<br \/>\n<a href=\"\/doc\/475622\/\" id=\"a_4\">Section 14<\/a>  itself. We\tdo not\tfind any  cause to interfere<br \/>\nwith the  impugned judgment.   The  appeals, therefore, fail<br \/>\nand are dismissed, but, without any order as to costs.\n<\/p>\n<p id=\"p_5\">     We clarify\t that because of the pendency of the appeals<br \/>\nin this\t court, the time granted by High Court, in direction<br \/>\nNo.1 and  direction No.3,  has since  expired.\t The parties<br \/>\nshall, therefore,  have the  same period, as is mentioned in<br \/>\ndirection No.1\tand direction  No.3, respectively,  to\ttake<br \/>\nappropriate action  and that period would start running from<br \/>\ntoday.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Commissioner Of Survey &#8230; vs Kunsam Saranarayana &amp; Ors on 11 September, 1997 Bench: A.
