No. 6246 of 2010.\n<\/p>\n<p>                            (2) This is an application under Section 151<\/p>\n<p>                   C.P.C., filed by the appellant praying therein to stay further<\/p>\n<p>                   proceeding of title suit no. 326 of 2006 pending in the<\/p>\n<p>                   Court of Sub Judge I, Rohtas at Sasaram for preparation of<\/p>\n<p>                   final decree.\n<\/p>\n<p>                            (3)    The     learned     senior    counsel,    Mr.    Dhrub<\/p>\n<p>                   Narayan Singh appearing on behalf of the appellant<\/p>\n<p>                   submitted      that    in   fact,   there    had   already      been   a<\/p>\n<p>                   compromise decree with regard to subject matter of the<\/p>\n<p>                   present suit and unless that compromise decree is set<\/p>\n<p>                   aside, no decree for partition would have been granted by<\/p>\n<p>                   the Court below at the instance of the respondent no. 1,<\/p>\n<p>                   Bachani Devi, who was not a party to the said compromise<\/p>\n<p>                   decree. According to the learned counsel, her father died<\/p>\n<p>                   prior to 1956 and therefore, she had no title to the<\/p>\n<p>                   property. So, without making her party in the earlier suit<\/p>\n<p>                   i.e. partition suit no. 73 of 1974, the parties concerned<\/p>\n<p>                   compromised           and    divided    the    property      amongst<\/p>\n<p>                   themselves. The learned counsel further submitted that in<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>that suit, in fact, she applied for being added as party but<\/p>\n<p>the prayer was refused and moreover, according to the<\/p>\n<p>appellant, she was not the daughter of Vishwanath Singh,<\/p>\n<p>who died issueless in the year 1939-1940, as a result of<\/p>\n<p>which, his share devolved on his brothers on the principles<\/p>\n<p>of survivorship.       Therefore, four brothers of Vishwanath<\/p>\n<p>Singh compromised. The present suit was filed by Bachani<\/p>\n<p>Devi claiming herself to be the daughter of Vishwanath and<\/p>\n<p>the Court below has decreed the partition suit granting<\/p>\n<p>decree to the extent of 1\/5th share.     The learned counsel<\/p>\n<p>further submitted that the learned Court below has<\/p>\n<p>decreed the suit ex-parte. On these grounds, the learned<\/p>\n<p>counsel submitted that the final decree proceeding may be<\/p>\n<p>stayed.\n<\/p>\n<p>          (4) On the other hand, the learned counsel for the<\/p>\n<p>plaintiff-respondent submitted that the husband of the<\/p>\n<p>present appellant had filed a written statement in the<\/p>\n<p>present partition suit admitting the plaintiff to be the<\/p>\n<p>daughter of Vishwanath and also admitting the fact that<\/p>\n<p>Vishwanath died in December 1956.         After his death, the<\/p>\n<p>present appellant and her minor sons were substituted and<\/p>\n<p>notices were served on them. Therefore, the submission of<\/p>\n<p>the learned counsel for the appellant that the suit was<\/p>\n<p>decided ex-parte has got no substance and moreover, if, in<\/p>\n<p>fact, it is ex-parte, then, the appellant should have applied<\/p>\n<p>in the Court below for setting aside the ex-parte decree.<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>The learned counsel further submitted that the appellant<\/p>\n<p>cannot be allowed to take a different stand then, the<\/p>\n<p>original   defendant           who   had    filed   written   statement<\/p>\n<p>supporting the plaintiff&#8217;s case. The learned counsel further<\/p>\n<p>submitted     that       the    other   respondents      have       got     no<\/p>\n<p>grievance and therefore, they have not challenged the<\/p>\n<p>decree.\n<\/p>\n<p>           (5) The learned counsel submitted that final<\/p>\n<p>decree is appealable and therefore, this is not the practice<\/p>\n<p>of this High Court to stay final decree proceeding.<\/p>\n<p>           (6) It appears that the respondent no. 1 filed the<\/p>\n<p>aforesaid partition suit claiming 1\/5th share in the suit<\/p>\n<p>property on the ground that she is daughter of Vishwanath,<\/p>\n<p>who died in jointness.           According to her, the defendants<\/p>\n<p>without the knowledge of the plaintiff, filed partition suit<\/p>\n<p>and obtained a collusive compromise decree only to<\/p>\n<p>deprive the plaintiff, therefore, the compromise decree is a<\/p>\n<p>nullity and is not binding on the plaintiff, respondent no. 1.<\/p>\n<p>The learned Court below has decreed the said suit and final<\/p>\n<p>decree proceeding is going on for carving out 1\/5th share of<\/p>\n<p>the plaintiff.   From perusal of the impugned judgment, it<\/p>\n<p>appears that the husband of the appellant also filed a<\/p>\n<p>written     statement          supporting     the     plaintiff&#8217;s     case.<\/p>\n<p>Moreover, the suit properties are agricultural lands.                     It is<\/p>\n<p>not the practice of Patna High Court to stay the further<\/p>\n<p>proceeding for preparation of final decree. Final decree is<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>          also appealable.        The finding of the Court below is that<\/p>\n<p>          plaintiff has got unity of title and possession.        In view of<\/p>\n<p>          this finding, now, she has 1\/5th share in the suit property.<\/p>\n<p>          Now, therefore, for the ends of justice, it will not be proper<\/p>\n<p>          to   stay    further    proceeding   in   the   Court   below   for<\/p>\n<p>          preparation of final decree.\n<\/p>\n<p>                      (7) Accordingly, I am not inclined to stay further<\/p>\n<p>          proceeding in title suit no. 326 of 2006 pending in the<\/p>\n<p>          Court of Sub Judge I, Rohtas at Sasaram for preparation of<\/p>\n<p>          final decree.     Accordingly, the I.A.
