He, therefore,<br \/>\nsubmitted that the present application may be allowed.\n<\/p>\n<p id=\"p_2\">3.<br \/>\nLearned A.P.P., Mr.Mengdey for the respondent-State resisted the<br \/>\napplication.\n<\/p>\n<p id=\"p_3\">4.<br \/>\nHaving heard learned senior counsel Mr.Lakhani and learned APP<br \/>\nMr.Mengdey and having considered the nature of offences, role<br \/>\nattributed to the applicant, manner in which it is alleged to have<br \/>\nbeen committed and also considering the guidelines laid down by<br \/>\nHon&#8217;ble Supreme Court with regard to discretion under <a href=\"\/doc\/1783708\/\" id=\"a_2\">section 438<\/a> of<br \/>\nCr.P.C., the present application deserves to be allowed.\n<\/p>\n<p id=\"p_4\">6.<br \/>\nAccordingly, the present application is allowed. The applicant is<br \/>\nordered to be released on bail in the event of his arrest in<br \/>\nconnection with I-C.R.No.5\/2010 registered with Western Railway<br \/>\nPolice Station, Ahmedabad  in respect of the offence alleged against<br \/>\nhim on him executing bond of Rs.5,000\/- (Rupees Five thousand only)<br \/>\nwith one solvent surety of the like amount, by him, by the concerned<br \/>\nPolice Officer and on conditions that he shall;\n<\/p>\n<p id=\"p_5\"> a)\tremain present before the trial Court regularly as and when directed on the dates fixed;\n<\/p>\n<p id=\"p_6\">b)\tremain present at the concerned Police Station on 17.09.2010 between 11.00 a.m. and 2.00 p.m;\n<\/p>\n<p id=\"p_7\">c)\tmake himself available for interrogation by Police Officer between 11:00 a.m. to 05:00 p.m. &#8211; before sunset;\n<\/p>\n<p id=\"p_8\">d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p id=\"p_9\">e)\tnot to obstruct or hamper the police investigation and not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p id=\"p_10\">f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, \tand shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p id=\"p_11\">g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p id=\"p_12\">h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p id=\"p_13\">7.<br \/>\nThis order will hold good if the applicant is arrested at any time<br \/>\nwithin 90 days from today. The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest,<br \/>\nduring which it will be open to the applicant to make fresh<br \/>\napplication for being enlarged on bail in usual course which when it<br \/>\ncomes before the competent Court, will be disposed of in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time uninfluenced by the fact<br \/>\nthat anticipatory bail was granted.\n<\/p>\n<p id=\"p_14\">8.<br \/>\nRule is  made absolute to the aforesaid extent.
