No.20380 of 2010\n                           PARBATI DEVI WIFE OF METHO SAH\n                                             Versus\n                                    STATE OF BIHAR\n                                        ----\n<\/pre>\n<p id=\"p_1\">2.   16.6.2010            Heard learned counsel for the petitioner and the State.<\/p>\n<p id=\"p_1\">                          The petitioner seeks anticipatory bail in a case<\/p>\n<p>                 instituted for the offence under <a href=\"\/doc\/653797\/\" id=\"a_1\">sections 304B<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_1\">498A<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_2\">120B<\/a> and<\/p>\n<p>                 <a href=\"\/doc\/386021\/\" id=\"a_3\">201<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_4\">34<\/a> of the Indian Penal Code and \u00be of the <a href=\"\/doc\/1763444\/\" id=\"a_5\">Dowry Prohibition<\/p>\n<p>                 Act<\/a>.\n<\/p>\n<p id=\"p_2\">                          Considering that the petitioner is the mother-in-law of<\/p>\n<p>                 the deceased as also the submission that she was separate in<\/p>\n<p>                 mess, let the petitioner, above named, in the event of her<\/p>\n<p>                 surrender within four weeks from today in connection with<\/p>\n<p>                 Nayagaon P.S.case No.32 of 2009 shall be released on<\/p>\n<p>                 anticipatory bail on furnishing bail bonds of Rs. 5,000\/- (five<\/p>\n<p>                 thousand) with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of the Chief Judicial Magistrate, Begusarai, subject<\/p>\n<p>                 to the conditions as laid down u\/s.438(2) <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>. and (i) that<\/p>\n<p>                 one of the bailors will be a close relative of the petitioner, who<\/p>\n<p>                 will give an affidavit giving genealogy as to how he is related<\/p>\n<p>                 with the petitioner. The bailors will undertake to furnish<\/p>\n<p>                 information to the court about any change in the address of the<\/p>\n<p>                 petitioner, (ii) that the petitioner shall undertake to be<\/p>\n<p>                 represented on the first date after cognizance and in case she<\/p>\n<p>                 fails to do so, her bail bond shall be liable to be cancelled, (iii)<\/p>\n<p>                 that the petitioner will give an undertaking that she will receive<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -2-<\/span><\/p>\n<p>            the police papers on the given date and be present on the date<\/p>\n<p>            fixed for charge and if she fails to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, her bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse and (iv) that the petitioner will<\/p>\n<p>            be well represented on each date and if she fails to do so on<\/p>\n<p>            two consecutive dates, her bail will be liable to be cancelled.<\/p>\n<pre id=\"pre_1\">Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Parbati Devi vs State Of Bihar on 16 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
