Information Sought:                               PIO&#8217;s Reply:\n<\/p>\n<p id=\"p_2\">1. What are the terms and conditions? Copy of such DDU Hospital is appointing Junior<br \/>\n     rules\/orders.                                           Residents (Dental) Doctors on<br \/>\n                                                             contract basis. Acompy of the<br \/>\n                                                             circular                   containing<br \/>\n                                                             conditions\/eligibility for J.r. Dental<br \/>\n                                                             is enclosed.\n<\/p>\n<p id=\"p_3\">2. Are such rules modified from time to time?                For regular appointment of Dental<br \/>\n                                                             doctors the R.Rs may be obtained<br \/>\n                                                             from the Dental Council of India.\n<\/p>\n<p id=\"p_4\">3. Do such modifications fall within the jurisdiction of the<br \/>\n     Medical Superintendent of the concerned hospital?\n<\/p>\n<p id=\"p_5\">4. Which is the competent authority to make such<br \/>\n     modifications?\n<\/p>\n<p id=\"p_6\">5. Who lays down the abovementioned rules?\n<\/p>\n<p id=\"p_7\">6. What were the criteria for the notification published for<br \/>\n     the recruitment of JR(Dental) in the year 2007-08 in<br \/>\n     DDU Hospital Hari Nagar, New Delhi? Supply copy of<br \/>\n     the notification.\n<\/p>\n<p id=\"p_8\">7. Can the concerned MS extend the payment period<br \/>\n     beyond 6 months as given in the advertisement? If yes,<br \/>\n     on what grounds?\n<\/p>\n<p id=\"p_9\">8. In case candidates are available as per waiting list<br \/>\n     prepared by the MS, is it mandatory to engage next<br \/>\n      candidate on the waiting list after expiry of six months<br \/>\n     term of the previous JR? Supply copy of list of selected<br \/>\n     and waited list candidates.\n<\/p>\n<p id=\"p_10\">9. How many times an extension beyond the initial 6<br \/>\n     month period can be given without the approval of<br \/>\n     competent authority?\n<\/p>\n<p id=\"p_11\">10. Which is the competent authority to give such an<br \/>\n     approval?\n<\/p>\n<p id=\"p_12\">11. Name and address of the JR (Dental) selected and<br \/>\n     engaged against the advertisement appearing in 2007-<br \/>\n     2008 till 12\/08\/2008.\n<\/p>\n<p id=\"p_13\">12. Name of the JR(Dental) engaged by extending the<br \/>\n     initial period of 6 months.\n<\/p>\n<p id=\"p_14\">13. Names of JR (Dental) engaged out of the waiting list?\n<\/p>\n<p id=\"p_15\">14. Name of JR dental pending to be engaged from the<br \/>\n     waiting list?\n<\/p>\n<p id=\"p_16\">Grounds for First Appeal:\n<\/p>\n<p id=\"p_17\">Information provided by the PIO is incomplete and irrelevant.\n<\/p>\n<p id=\"p_18\">The First Appellate Authority ordered:<br \/>\nNo hearing held.\n<\/p>\n<p id=\"p_19\">Grounds for Second Appeal:\n<\/p>\n<p id=\"p_20\">No hearing held on first appeal.\n<\/p>\n<p id=\"p_21\">Relevant Facts emerging during Hearing:<br \/>\nThe Following were present:\n<\/p>\n<p id=\"p_22\">Appellant:Absent<br \/>\nRespondent: Mr. U.S. Kalra, PIO<br \/>\nThe PIO admits that incomplete information was given and most of the information was not<br \/>\ngiven. He has shown evidence that after the FAA&#8217;s order Dr. Praveena Goyal, Dy. Medical<br \/>\nSuperintendent gave the complete information on 10\/02\/2009. The PIO claims that the gave<br \/>\ncompletely unsatisfactory and incomplete information because &#8220;I sought the assistance of Dr.<br \/>\nPraveena Goyal Dy. Medical Superintendent and this unsatisfactory and incomplete information<br \/>\nwas given to me by her which I forwarded to the Appellant. Hence I am not responsible for this.&#8221;<br \/>\nIn view of the statement of the PIO the deemed PIO as per Section 5(5) is Dr. Praveena Goyal<br \/>\nDy. Medical Superintendent who is guilty of not furnishing complete information.\n<\/p>\n<p id=\"p_23\">Decision<br \/>\nThe Appeal is allowed.\n<\/p>\n<p id=\"p_24\">The information has been provided.\n<\/p>\n<p id=\"p_25\">The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the deemed PIO Dr. Praveena Goyal<br \/>\nDy. Medical Superintendent is guilty of not furnishing complete information within the time<br \/>\nspecified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It appears that the deemed PIO&#8217;s actions attract the penal provisions<br \/>\nof <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A show cause notice is being issued to her, and she is directed give her reasons<br \/>\nto the Commission to show cause why penalty should not be levied on her for the delay in<br \/>\nproviding information at Rs.250 per day for each day of delay.
