In pursuance of the said impugned<br \/>\norder, the petitioner is detained in jail.\n<\/p>\n<p id=\"p_1\">Heard the learned advocate for<br \/>\nthe petitioner and the learned AGP for the respondents.\n<\/p>\n<p id=\"p_2\">2. From the grounds of<br \/>\ndetention, it appears that six offences being CR.I.Nos. 178, 1020,<br \/>\n142,143, 376 of 2006 and 286 of 2007 under sections 66 (1)b and 65(e)<br \/>\netc. under the Bombay Prohibition Act, were registered with<br \/>\nKhambhaliya, Jamnagar City &#8216;A&#8217;, Lalpur, Okha and Bhanwad police<br \/>\nstations, wherein foreign liquor was found from the possession of the<br \/>\ndetenu. On the basis of registration of these cases, the detaining<br \/>\nauthority held that the present detenu was carrying on activities of<br \/>\nselling country liquor which is harmful to the health of the public.<br \/>\nIt is held by the detaining authority that as the detenu is indulged<br \/>\nin illegal activities, it is required to restrain him from carrying<br \/>\nout further illegal activities i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance on the above registered offences and<br \/>\nstatements of unnamed witnesses. In the opinion of this court, the<br \/>\nactivities of the detenu can, by no stretch of reasoning, be said to<br \/>\nbe disturbing the public order. It is seen from the grounds that a<br \/>\ngeneral statement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health. In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of &#8216;law<br \/>\nand order&#8217; and not &#8216;public order&#8217;. Therefore, on this ground, the<br \/>\nsubjective satisfaction of the detaining authority is vitiated on<br \/>\naccount of non-application of mind and the impugned order, therefore,<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p id=\"p_3\">3. \t\tExcept two statements of<br \/>\nthe anonymous witnesses, there is no material on record which shows<br \/>\nthat the petitioner-detenu is carrying out illegal activities of<br \/>\nselling liquor which is harmful to the health of the public. In the<br \/>\ncase of <a href=\"\/doc\/687998\/\" id=\"a_1\">Ashokbhai Jivraj @ Jivabhai Solanki v. Police<br \/>\nCommissioner, Surat<\/a> (2001 (1) GLH 393), having considered the<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of <a href=\"\/doc\/1733535\/\" id=\"a_2\">Ram Manohar<br \/>\nLohia v. State of Bihar<\/a> (AIR 1966 SC 740), this court held<br \/>\nthat the cases wherein the detention order are passed on the basis of<br \/>\nthe statements of such witnesses fall under the maintenance of \u00fdSlaw<br \/>\nand order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p id=\"p_4\">4.<br \/>\n\t\tApplying the ratio of the above decisions, it is clear that before<br \/>\npassing an order of detention of a detenu, the detaining authority<br \/>\nmust come to a definite finding that there is threat to the &#8216;public<br \/>\norder&#8217; and it is very clear that the present case would not fall<br \/>\nwithin the category of threat to a public order. In that view of the<br \/>\nmatter, when the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p id=\"p_5\">5. \tIn the result, this Special<br \/>\nCivil Application is allowed. The impugned order of detention dated<br \/>\n30.11.2007 passed by the District Magistrate, Jamnagar is hereby<br \/>\nquashed and set aside. The detenu is ordered to be set at liberty<br \/>\nforthwith, if not required in any other case. Rule is made absolute<br \/>\naccordingly.
