No. 263 of 2008\n                   = = = = = = = = = = = = = =\n                          Dated: 24-1-2008\n\n                                 ORDER\n<\/pre>\n<p id=\"p_1\">      Petitioner who is the owner of a vehicle bearing Reg. No. KL-<\/p>\n<p>10-Z-9897, seeks interim custody of the same. The vehicle was<\/p>\n<p>seized by the      2nd respondent alleging that sand was illegally<\/p>\n<p>transported in the vehicle in contravention of the provisions of the<\/p>\n<p>Kerala Protection of River Banks &amp; Regulation of Removal of Sand<\/p>\n<p>Act, 2001 (the Act&#8221; for short). The petitioner approached the J.F.C.M.<\/p>\n<p>Manjeri for interim custody of the vehicle which was seized by the 2nd<\/p>\n<p>respondent but his request for interim custody was declined by the<\/p>\n<p>Magistrate holding that since the vehicle was not produced before<\/p>\n<p>Court and no report was forwarded under Sec. 102 (3) <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. by any<\/p>\n<p>police officer, the application for interim custody filed under Sec. 457<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. was not maintainable. Hence this Petition under Sec. 482<\/p>\n<p><a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.\n<\/p>\n<p id=\"p_1\">      2.      Even in cases where the seized vehicle is not produced<\/p>\n<p>before the Magistrate nor is the seizure reported to the Magistrate, the<\/p>\n<p>application under <a href=\"\/doc\/239420\/\" id=\"a_3\">Section 457<\/a> Cr.P.C. by the person aggrieved can be<\/p>\n<p>treated as a report of seizure. In as much as this Court has granted<\/p>\n<p>interim custody of vehicles seized under the provisions of the said Act,<\/p>\n<p>I see no reason why       this vehicle also should not be released on<\/p>\n<p>interim custody, particularly in the light of the decision reported in<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL. M.C. No. 263\/2008             : 2 :<\/span><\/p>\n<p>AIR 2003 SC 638 &#8211; Sundarbhai Ambalal Desai                  v. State of<\/p>\n<p>Gujrat. Accordingly, the Mini lorry in question shall be released to<\/p>\n<p>the petitioner on interim custody on his depositing either a cash<\/p>\n<p>security of Rs. 25,000\/-     (Rupees twenty five thousand only) or<\/p>\n<p>furnishing bank guarantee for the said amount and on his executing<\/p>\n<p>a bond for Rs. 1,50,000\/- (Rupees one lakh fifty thousand only) with<\/p>\n<p>two solvent sureties each for the like amount to the satisfaction of the<\/p>\n<p>J.F.C.M., Manjeri without insisting on solvency certificate and subject<\/p>\n<p>to the following conditions.\n<\/p>\n<p id=\"p_2\">        i) The petitioner shall keep the mini lorry in the same<br \/>\n             condition in which it is released to the petitioner.<\/p>\n<p id=\"p_3\">        ii) The petitioner shall not transfer the mini lorry and its<br \/>\n             accessories wholly or in part to any person.<\/p>\n<p id=\"p_4\">        iii) The petitioner shall not permit the mini lorry bearing<br \/>\n             Reg. No.KL-10-Z-9897, to be used for any illicit<br \/>\n             purpose<\/p>\n<p id=\"p_5\">        iv) The petitioner shall produce the vehicle before court as<br \/>\n             and when required by the Magistrate.\n<\/p>\n<p id=\"p_6\">      This order shall be subject to any order for confiscation to be<\/p>\n<p>passed under the provisions of the Act.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">                                               V.
