Agrawal Versus  State &amp; Ors \n\t\t\t        \n\t\t                   Date of Order     :::        10\/08\/2010\n\n\t\t                   Hon'ble Mr. Justice Ajay Rastogi \n\nMr. NS Chouhan, for petitioner.\n<\/pre>\n<p id=\"p_1\">\t\tCounsel submits that petitioner while  holding the post of Head Constable was placed under suspension vide order dt.20\/10\/08 (Ann.13) on account of criminal case being registered for offences punishable under the <a href=\"\/doc\/1331755\/\" id=\"a_1\">Prevention of Corruption Act<\/a>. Counsel further submits that after the challan being filed, the charges were not framed so far, the trial is lingering on and may take its own course while he is facing agony of suspension for almost one year &amp; 10 months by now.\n<\/p>\n<p id=\"p_1\">\t\tCounsel further submits that without examining the continuation of suspension as to whether it is required or not, the authorities are blindly invoking the circular of the State Government dt.10th August, 2001 while deciding representation\/review of suspension submitted by the employee under Rule 13(5) of the Rajasthan Civil Services (CCA) Rules, 1958.\n<\/p>\n<p id=\"p_2\">\t\tCounsel has further placed reliance on a judgment of this Court reported in Prem Prakash Mathur Vs. State of Rajasthan &amp; Ors (2005(9) RDD 3962 (Raj.) &amp; Vishnu Kr. Gupta Vs. State (2009 WLC (UC) 701).
