No.1518 of 2007\n                               SUBHASH PRASAD MEHTA\n                                          Versus\n                                 JAY NARAYAN MAHTO\n                                        -----------\n<\/pre>\n<p id=\"p_1\">10\/   16-12-2010            Though question of maintainability of the present<\/p>\n<p>                   civil revision application has been placed for consideration<\/p>\n<p>                   by this Court, but in view of nature of controversy between<\/p>\n<p>                   the petitioner and sole opposite party, it would be<\/p>\n<p>                   appropriate that question of maintainability is considered<\/p>\n<p>                   in presence of the opposite party.\n<\/p>\n<p id=\"p_1\">                            Mr. Rajendra Prasad, learned Senior counsel<\/p>\n<p>                   appearing on behalf of the petitioner submits that Lunacy<\/p>\n<p>                   Case No. 206 of 1996 was filed by the opposite party with a<\/p>\n<p>                   prayer that he should be appointed as a guardian of one<\/p>\n<p>                   Krishna Mahto, a lunatic . The Opposite party is said to be<\/p>\n<p>                   the uncle of aforesaid Krishna Mahto (lunatic).         The<\/p>\n<p>                   petitioner claims to be cousin of aforesaid Krishna Mahto.<\/p>\n<p>                   Aforesaid Lunacy Case No. 206 of 1996 was decided by a<\/p>\n<p>                   judgment and decree dated 25.02.2006 and opposite party<\/p>\n<p>                   was appointed as a guardian of the aforesaid lunatic. The<\/p>\n<p>                   petitioner has filed a First Appeal bearing F.A. No. 78 of<\/p>\n<p>                   2006 before this Court, which is still pending. In the<\/p>\n<p>                   meantime, the aforesaid Krishna Mahto, lunatic, has died<\/p>\n<p>                   on 16.07.2009. Thus, it appears that the whole dispute<\/p>\n<p>                   regarding guardianship has come to an end. Only dispute<\/p>\n<p>                   would be as to who would be the legal heir and<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>           representative   of    the   aforesaid   Krishna   Mahto.   The<\/p>\n<p>           grievance of the petitioner is that by virtue of the aforesaid<\/p>\n<p>           previous judgment and decree, the opposite party is<\/p>\n<p>           mismanaging the property and is making preparation for<\/p>\n<p>           alienating certain properties.\n<\/p>\n<p id=\"p_2\">                      In the aforesaid circumstances, issue notice to<\/p>\n<p>           sole opposite party in admission matter for which requisite<\/p>\n<p>           etc. must be filed by ordinary process as well as registered<\/p>\n<p>           post with A\/D, within a week failing which this application<\/p>\n<p>           shall stand rejected without further reference to a Bench.<\/p>\n<p id=\"p_3\">                      The question of maintainability of the present<\/p>\n<p>           civil revision application shall be taken up either on service<\/p>\n<p>           of notice or on appearance of opposite party, whichever is<\/p>\n<p>           earlier.\n<\/p>\n<p id=\"p_4\">                      During the pendency of the present application,<\/p>\n<p>           the parties shall maintain status quo with respect to<\/p>\n<p>           properties belonging to aforesaid Krishna Mahto (lunatic),<\/p>\n<p>           who is said to be now dead.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                 ( Birendra Prasad Verma, J.)<br \/>\nBTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Subhash Prasad Mehta vs Jay Narayan Mahto on 16 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA C.R.
