Justice ANTONY DOMINIC\n\n Dated :20\/08\/2010\n\n O R D E R\n                        ANTONY DOMINIC, J.\n               --------------------------------------------------\n                  W.P.(C) NO.23987 OF 2010(W)\n               --------------------------------------------------\n            Dated this the 20th day of August, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner is working as Chief Medical Officer (Ayurveda) in<\/p>\n<p>the District Govt. Ayurveda Hospital, Ernakulam since August,<\/p>\n<p>2009. It is stated that she is due to retire on 31.3.2011. While so<\/p>\n<p>by Ext.P2 order dated 29.7.2010, petitioner has been transferred<\/p>\n<p>and posted to Government Ayurveda Hospital, Thalavoor, Kollam<\/p>\n<p>District. It is challenging Ext.P2 order that this writ petition has<\/p>\n<p>been filed.        While admitting the writ petition on 30.7.2010,<\/p>\n<p>this court also passed an interim order permitting the petitioner to<\/p>\n<p>continue at Ernakulam.\n<\/p>\n<p id=\"p_1\">      2. Respondents have filed a counter affidavit justifying the<\/p>\n<p>transfer and also stating that the 3rd respondent who is posted in<\/p>\n<p>the petitioner&#8217;s place assumed charge before the order dated<\/p>\n<p>30.7.2010 was communicated.\n<\/p>\n<p id=\"p_2\">      3. From the counter affidavit filed on behalf of the first<\/p>\n<p>respondent what emerges is that there were certain complaints<\/p>\n<p>against the petitioner, and enquiry has been held. It              would<\/p>\n<p>appear that according to them proceedings are to be initiated<\/p>\n<p>WPC.No.23987 \/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   :2 :<\/span><\/p>\n<p>against the petitioner. It is stated that, in view of the above, it<\/p>\n<p>will not be in public interest to allow the petitioner to continue in<\/p>\n<p>Ernakulam and therefore Ext.P2 transfer order was issued.<\/p>\n<p id=\"p_3\">       4. Admittedly the petitioner is holding a transferable post.<\/p>\n<p>An order of transfer issued, even deviating from the guidelines,<\/p>\n<p>can be interfered by this court, only if the same is vitiated for<\/p>\n<p>mala fides or arbitrariness. In this case, from the averments in the<\/p>\n<p>counter affidavit, it is seen that it is on account of the proceedings<\/p>\n<p>which are contemplated against the petitioner, that she has been<\/p>\n<p>transferred. Such a decision taken cannot be said to be mala fide<\/p>\n<p>or arbitrary.
