As the<br \/>\n\tloan amount was not paid, the petitioner Bank filed civil suit<br \/>\n\tbefore the learned Nominee being Lavad Case No.817 of 1988.  It is<br \/>\n\tthe case of the petitioner that the summons was served to the<br \/>\n\tdeceased Mansing, but he did not appear thereafter.  Ultimately, the<br \/>\n\tlearned Nominee passed the judgement and award on 29.5.1999, whereby<br \/>\n\tthe claim of the Bank was allowed.  It appears that thereafter the<br \/>\n\tdeceased Mansing Devubhai Rathod expired and his legal heirs in the<br \/>\n\tmonth of March, 2000 preferred appeal together with the application<br \/>\n\tfor condonation of delay.  The Tribunal ultimately allowed the<br \/>\n\tappeal and remanded the matter to the learned Nominee.  It is under<br \/>\n\tthese circumstances the petitioner Bank has approached this Court by<br \/>\n\tthe present petition.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tMr.Dinesh Kapadia for Mr.Raval, learned Counsel for the petitioner.\n<\/p>\n<p id=\"p_2\">It<br \/>\n\tappears from the reasons recorded by the Tribunal, that on merits,<br \/>\n\tTribunal found a good case to be considered on the aspects of<br \/>\n\tmembership of the deceased on the relevant date when the transaction<br \/>\n\tof loan was entered into and also the aspect as to whether there was<br \/>\n\tany misuse of powers by the office-bearers of the Bank or not.<br \/>\n\tTherefore, the Tribunal exercised the discretion and set aside the<br \/>\n\taward passed by the learned Nominee and remanded the matter.  The<br \/>\n\tperusal of the reasons recorded by the Tribunal shows that it cannot<br \/>\n\tbe said that there is any error committed by the Tribunal on the<br \/>\n\tface of record or that the discretion exercised by the Tribunal is<br \/>\n\tperverse, which may attract the jurisdiction of this Court under<br \/>\n\t<a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India.\n<\/p>\n<p id=\"p_3\">The<br \/>\n\tlearned Counsel for the petitioner alternatively submitted that let<br \/>\n\tthe suit be ordered to be decided within a reasonable time, since<br \/>\n\tthe suit is of 1988 and the matter is pending for a long time.\n<\/p>\n<p id=\"p_4\">Hence,<br \/>\n\tit is directed that the learned nominee shall decide the suit as<br \/>\n\tearly as possible, preferably within one year from the date of<br \/>\n\treceipt of the order of this Court.
