Even as<br \/>\n\telection programme for the election as aforesaid to the Board of<br \/>\n\tDirectors of the specified society is declared on 21.03.2011 and the<br \/>\n\tpetitioner had filed his nomination for standing as a candidate at<br \/>\n\tthe election, respondent No.2 had raised objection against the<br \/>\n\tpetitioner&#8217;s candidature.  According to the impugned order, the only<br \/>\n\tobjection raised by the objector was that the petitioner was serving<br \/>\n\tas a Teacher in a school which was receiving grant from the<br \/>\n\tGovernment.  It was only on that ground that the objector requested<br \/>\n\tto allow or disallow nomination of the petitioner.\n<\/p>\n<p id=\"p_2\">\tSurprisingly,<br \/>\n\tthe Election Officer has, instead of calling upon the objector to<br \/>\n\tsubstantiate his objection by citing any legal provision, called<br \/>\n\tupon the petitioner to obtain  No Objection Certificate from the<br \/>\n\tDistrict Education Officer, Surat.  Then, making an opportunity<br \/>\n\tgiven to the petitioner a ground and relying upon wholly irrelevant<br \/>\n\treports received from District Registrar and District Education<br \/>\n\tOfficer and relying upon a wholly irrelevant Notification dated<br \/>\n\t09.03.2006 furnished by the Education Officer, the petitioner was<br \/>\n\theld to be not entitled to contest the election.  Although the<br \/>\n\timpugned order is concluded with a statement that the objection of<br \/>\n\trespondent No.2 was accepted and upheld in view of legal provisions,<br \/>\n\tno legal provision is in fact mentioned or cited either in the<br \/>\n\timpugned order or in defence of the impugned order by learned<br \/>\n\tAssistant Government Pleader.  Thus in short, apparently perverse<br \/>\n\torder has been made without support of any legal provision, to keep<br \/>\n\tthe petitioner out of the election.  Prima facie, this is<br \/>\n\tunbecoming of an Election Officer who is supposed to discharge his<br \/>\n\tfunctions impartially and in accordance with law so as to ensure a<br \/>\n\tfair election.  Under such circumstances, it was vehemently argued<br \/>\n\tby learned Counsel Mr. Dipen Desai that the petitioner may be<br \/>\n\tdirected to be included in the list of candidates and the ballot<br \/>\n\tpapers so as to save the election from apparent irregularity.  He<br \/>\n\tfurther submitted that although the petitioner would be hardly left<br \/>\n\twith any time to canvass for himself, he would take the risk of<br \/>\n\tcontesting the election with such handicap.\n<\/p>\n<p id=\"p_3\">\tLearned<br \/>\n\tAssistant Government Pleader made a feeble attempt at defending the<br \/>\n\timpugned order with the only submission that the petitioner was<br \/>\n\tgiven an opportunity of being heard and further submitted that it<br \/>\n\twould be highly improper and impractical for the Election Officer to<br \/>\n\tnow include the name of the petitioner either in the list of<br \/>\n\tcandidates or in the ballot papers.\n<\/p>\n<p id=\"p_4\">\tThere<br \/>\n\twas no dispute about the fact that the date of voting being round<br \/>\n\tthe corner on 30.04.2011, it would be extremely difficult, if not<br \/>\n\timpossible, to amend or reprint the ballot papers so as to allow the<br \/>\n\tpetitioner to contest the election at this stage.  Even otherwise,<br \/>\n\tit would be improper for the Court to interfere with the process of<br \/>\n\telection at this stage.  Therefore, while holding that the impugned<br \/>\n\torder dated 13.04.2011 is perverse and not supported by any legal<br \/>\n\tprovision, and deprecating the manner in which the Election Officer<br \/>\n\thas conducted himself to oust the petitioner from the fray with<br \/>\n\tintervention by the District Registrar Surat, we have to dismiss the<br \/>\n\tpetition with liberty to the petitioner to take appropriate<br \/>\n\talternative remedy after conclusion of the election process.\n<\/p>\n<p id=\"p_5\">It<br \/>\n\tis hoped that if and when the petitioner challenges the election by<br \/>\n\tan appropriate petition, his petition shall be heard and decided in<br \/>\n\taccordance with law as expeditiously as practicable.  With this<br \/>\n\tobservation, the petition is dismissed with liberty to the State<br \/>\n\tGovernment to take disciplinary actions and appropriate steps for<br \/>\n\tpreventing repetition of such waste of public resources by its<br \/>\n\tOfficers including the District Registrar concerned, appointed to<br \/>\n\tensure fair election.\n<\/p>\n<p id=\"p_6\">\t\t\t\t\t\t\t\t     Sd\/-\n<\/p>\n<p id=\"p_7\">\t\t\t\t\t\t\t[D.
