OF BIHAR, PATNA.\n                                    2\n\n\n\n\n                   4.THE DIRECTOR, SECONDARY EDUCATION, NEW\n                   SECRETARIAT, PATNA.\n                   5.THE    DISTRICT     EDUCATION    OFFICER,\n                   MUZAFFARPUR.\n                                         ...........................RESPONDENTS.\n                                 -----------\n<\/pre>\n<p id=\"p_1\">05\/   05.08.2011          No one appears for the petitioners.\n<\/p>\n<p id=\"p_1\">                            Counsel for the State is present.\n<\/p>\n<p id=\"p_2\">                            From perusal of the report it would<\/p>\n<p>                   appear that the petitioner&#8217;s grievance in<\/p>\n<p>                   this writ application remains confined to<\/p>\n<p>                   payment of salary and to that extent the<\/p>\n<p>                   relief     prayed   by   the   petitioner    in<\/p>\n<p>                   paragraph no. 1 reads as follows:-\n<\/p>\n<p id=\"p_3\">                            &#8220;For issuance of appropriate<br \/>\n                     writ\/order of direction commanding the<br \/>\n                     respondents to make full payment of<br \/>\n                     salary on monthly basis from Treasury<br \/>\n                     to the petitioners who are teaching<br \/>\n                     and non-teaching staffs of Urdu Girls<br \/>\n                     High School, Chandwara, Muzaffarpur<br \/>\n                     which is a recognized minority School.\n<\/p>\n<p id=\"p_4\">                            II. For issuance of appropriate<br \/>\n                     writ\/order or direction commanding the<br \/>\n                     respondents to make payment of arrear<br \/>\n                     salary   since   July    1998   to   the<br \/>\n                     petitioners which has not been paid to<br \/>\n                     them.\n<\/p>\n<p id=\"p_5\">                            III.     For      issuance     of<br \/>\n                     appropriate writ\/order or direction<br \/>\n                     commanding the respondents to make<br \/>\n                     payment   of   teaching       allowance,<br \/>\n                     regional allowance, interim relief,<br \/>\n                     bonus, uniform allowance to Class IV<br \/>\n                     staffs,   Leave   Travel    Concessions,<br \/>\n                     Group     Insurance     Coverage     and<br \/>\n                     contingency etc. to the petitioners<br \/>\n                     like   Government   Nationalised    High<br \/>\n                     Schools.\n<\/p>\n<p id=\"p_6\">                            IV. For issuance of appropriate<br \/>\n                     writ\/order of direction commanding the<br \/>\n                     respondents to give all facilities of<br \/>\n                     Government Nationalised High Schools<br \/>\n                     concerning salary, interim relief,<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    3<\/span><\/p>\n<p>  earned leave after retirement, payment<br \/>\n  of leave travel concession, Bonus, D.A<br \/>\n  and T.A, two days special leave to<br \/>\n  lady teachers etc., to the employee<br \/>\n  working in the school.\n<\/p>\n<p id=\"p_7\">         V. For issuance of appropriate<br \/>\n  writ\/order or direction commanding the<br \/>\n  respondents to make payment to the<br \/>\n  petitioners the amount of enhancement<br \/>\n  of salary, D.A etc. time to time as<br \/>\n  per with Nationalised High Schools in<br \/>\n  the State.\n<\/p>\n<p id=\"p_8\">         VI. For issuance of appropriate<br \/>\n  writ\/order or direction     commanding<br \/>\n  the respondents to make payment of all<br \/>\n  arrears salary     from 1981 and also<br \/>\n  grant any other relief for which the<br \/>\n  petitioners are found entitled in the<br \/>\n  opinion of this Hon&#8217;ble Court at the<br \/>\n  time of hearing.&#8221;\n<\/p>\n<p id=\"p_9\">      From   the    counter  affidavit   on<\/p>\n<p>record, it would be clear that some of the<\/p>\n<p>grievances    of       the    petitioners   had     been<\/p>\n<p>redressed and that for rest of them they<\/p>\n<p>were awaiting the result of civil review<\/p>\n<p>application no.         83 of 2000 arising out of<\/p>\n<p>C.W.J.C No. 8084 of 1998 involving similar<\/p>\n<p>questions with regard to payment of salary<\/p>\n<p>for the teaching and non-teaching staff of<\/p>\n<p>the Minority School.\n<\/p>\n<p id=\"p_10\">       This Court, therefore, would direct<\/p>\n<p>the Director Secondary Education, to look<\/p>\n<p>into the grievances of the petitioners and<\/p>\n<p>take   a   decision      as    with   regard   to    the<\/p>\n<p>grievances made in this writ application.\n<\/p>\n<p id=\"p_11\">It is however, made clear that as this writ<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             4<\/span><\/p>\n<p>         application      was   filed     on   30.07.1999,   the<\/p>\n<p>         petitioners      would not be entitled to claim<\/p>\n<p>         arrears of salary from 1981 and their such<\/p>\n<p>         arrears of salary, if, at all found payable<\/p>\n<p>         would    be     paid   from    30.07.1996,      onwards<\/p>\n<p>         being a period of three years in which even<\/p>\n<p>         money    claim could have been entertained by<\/p>\n<p>         the     Civil     Court.
