KRUTI M SHAH for\nApplicant(s) : 1, \nMS MINI NAIR APP for Respondent(s) :\n1, \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH \n\t\t\t\n\t\t\t \n\nH.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/09\/2010  \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThe<br \/>\n\tpresent application has been filed by the applicant-accused under<br \/>\n\t<a href=\"\/doc\/1290514\/\" id=\"a_1\">section 439<\/a> of Criminal Procedure Code for regular bail after filing<br \/>\n\tof the charge sheet.\n<\/p>\n<p id=\"p_1\">\tThe<br \/>\n\tapplicant-accused are charged with having committed offences<br \/>\n\tunder <a href=\"\/doc\/1560742\/\" id=\"a_1\">sections 302<\/a>, <a href=\"\/doc\/1096965\/\" id=\"a_2\">143<\/a>, <a href=\"\/doc\/1258372\/\" id=\"a_3\">147<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_4\">148<\/a> and <a href=\"\/doc\/999134\/\" id=\"a_5\">149<\/a> of Indian Penal Code as<br \/>\n\twell as section 135(1) of Bombay Police Act, for which, FIR has been<br \/>\n\tlodged being I-C.R.No.9\/2010 at Jam-Kalyanpur Police Station,<br \/>\n\tDist.Jamnagar.\n<\/p>\n<p id=\"p_2\">\tLearned<br \/>\n\tadvocate Ms.Kruti Shah for the applicant submitted that applicant is<br \/>\n\tthe original accused No.7, who is attributed with the stick blow and<br \/>\n\tthe case of the present applicant accused is also similarly situated<br \/>\n\tto the co-accused, who has been already released on bail. Ms.Shah,<br \/>\n\tlearned advocate for the applicant referred to the First Information<br \/>\n\tReport regarding nature of offence, and the manner in which it is<br \/>\n\talleged to have been committed and submitted that it is the case of<br \/>\n\tthe circumstantial evidence and as now charge sheet has been filed,<br \/>\n\tpresent application may be allowed.\n<\/p>\n<p id=\"p_3\">\tLearned<br \/>\n\tA.P.P., Ms.Mini Nair resisted the present application. She referred<br \/>\n\tto the statements of witnesses and submitted that the role has been<br \/>\n\tattributed to the present applicant accused ad the clothes recovered<br \/>\n\tare having blood stains.\n<\/p>\n<p id=\"p_4\">\tHaving<br \/>\n\theard learned advocate Ms.Shah for the applicant and learned APP<br \/>\n\tMs.Nair and also considering the nature\/gravity of offence, manner<br \/>\n\tin which it is alleged to have been committed, role attributed that<br \/>\n\tis blow with wooden log or stick and the fact that charge sheet is<br \/>\n\tfiled, present application deserves to be allowed.\n<\/p>\n<p id=\"p_5\">\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.9\/2010<br \/>\n\tregistered at Jam-Kalyanpur Police Station, Dist.Jamnagar on his<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand Only) with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall:\n<\/p>\n<p id=\"p_6\">(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p id=\"p_7\">(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p id=\"p_8\">(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p id=\"p_9\">(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p id=\"p_10\">(e)\tmark<br \/>\nhis presence before concerned Police Station on every 1st<br \/>\nMonday of every English calender month between 11:00 AM to 2:00 PM.\n<\/p>\n<p id=\"p_11\">(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p id=\"p_12\">(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p id=\"p_13\">\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_14\">\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p id=\"p_15\">\tRule<br \/>\n\tis made absolute to the aforesaid extent.
